Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ

Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή: Άρθρο πρώτο

Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η «Συμφωνία μεταξύ του Υπουργείου Εθνικής Άμυνας της Ελληνικής Δημοκρατίας και του Ομοσπονδιακού Υπουργείου Άμυνας της Ομοσπονδιακής Δημοκρατίας της Γιουγκοσλαβίας για τη συμμετοχή στο Πολυεθνικό Κέντρο Εκπαίδευσης Επιχειρήσεων Υποστήριξης της Ειρήνης (Π.Κ.Ε.Ε.Υ.Ε.)» που υπογράφηκε στην Αθήνα στις 16 Μαΐου 2001, της οποίας το κείμενο, σε πρωτότυπο στην ελληνική και αγγλική γλώσσα, έχει ως εξής:

ΚΑΙ

ΤΟΥ ΟΜΟΣΠΟΝΔΙΑΚΟΥ ΥΠΟΥΡΓΕΙΟΥ ΑΜΥΝΑΣ

ΤΗΣ ΟΜΟΣΠΟΝΔΙΑΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΤΗΣ ΓΙΟΥΓΚΟΣΛΑΒΙΑΣ ΓΙΑ ΤΗ ΣΥΜΜΕΤΟΧΗ ΣΤΟ ΠΟΛΥΕΘΝΙΚΟ ΚΕΝΤΡΟ ΕΚΠΑΙΔΕΥΣΗΣ ΕΠΙΧΕΙΡΗΣΕΩΝ ΥΠΟΣΤΗΡΙΞΗΣ ΤΗΣ ΕΙΡΗΝΗΣ (MPSOTC)

Το Υπουργείο Εθνικής Άμυνας της Ελληνικής Δημοκρατίας, εφεξής καλούμενο ως «το Συμβαλλόμενο Μέρος Υποδοχής», και το Ομοσπονδιακό Υπουργείο Άμυνας της Ομοσπονδιακής Δημοκρατίας της Γιουγκοσλαβίας, εφεξής καλούμενο ως «το Συμβαλλόμενο Μέρος»,

ΕΠΑΝΑΕΠΙΒΕΒΑΙΩΝΟΝΤΑΣ την αφοσίωσή τους στους σκοπούς και τις αρχές του Χάρτη των Ηνωμένων Εθνών,

ΘΕΩΡΩΝΤΑΣ ότι η ανάπτυξη αμοιβαίας συνεργασίας θα συμβάλλει στην σταθερότητα στην ευρύτερη περιοχή και θα βοηθήσει στη βελτίωση των καλών σχέσεων,

ΓΝΩΡΙΖΟΝΤΑΣ ότι η πολιτικο-στρατιωτική συνεργασία αποτελεί το βασικό στοιχείο ενίσχυσης των δυνατοτήτων των Ηνωμένων Εθνών για την ασφάλεια και τη διατήρηση της ειρήνης,

ΕΧΟΝΤΑΣ ΤΗΝ ΠΕΠΟΙΘΗΣΗ ότι θα πρέπει να υπάρξει περαιτέρω ανάπτυξη στη συνεργασία και το διάλογο μεταξύ των χωρών σε θέματα Επιχειρήσεων Υποστήριξης της Ειρήνης (PSOs),

ΕΠΙΘΥΜΩΝΤΑΣ ΝΑ ΣΥΜΒΑΛΛΟΥΝ στη βελτίωση της εκπαίδευσης και της διαλειτουργικότητας των Ενόπλων Δυνάμεών τους, σύμφωνα με τις νέες επιχειρησιακές απαιτήσεις των Επιχειρήσεων Υποστήριξης της Ειρήνης,

ΣΥΜΦΩΝΗΣΑΝ ΤΑ ΑΚΟΛΟΥΘΑ:

ΑΡΘΡΟ 14 ΛΗΞΗ

1. Η παρούσα Συμφωνία μπορεί να καταγγελθεί από οποιοδήποτε από τα Συμβαλλόμενα Μέρη ανά πάσα στιγμή.

2. Οποιοδήποτε από τα δύο Συμβαλλόμενα Μέρη ενδιαφέρεται να καταγγείλει την παρούσα Συμφωνία, θα αποστείλει μία έγγραφη ειδοποίηση προς το άλλο Συμβαλλόμενο Μέρος.

3. Η λήξη θα πραγματοποιήσει αποτελέσματα ένα μήνα μετά τη λήψη της έγγραφης ειδοποίησης που αναφέρεται στην παράγραφο 2 του παρόντος άρθρου.

4. Σε περίπτωση που υπάρχουν εκκρεμή οικονομικά ζητήματα ή αξιώσεις κατά το χρόνο της λύσης, το παρόν Σύμφωνο θα παραμείνει σε ισχύ μέχρι να τακτοποιηθούν οριστικά τα συγκεκριμένα θέματα.

Η παρούσα Συμφωνία συντάχθηκε σε δύο πρωτότυπα αντίτυπα, το καθένα από αυτά στην αγγλική, την ελληνική και τη σερβική γλώσσα. Όλα τα κείμενα είναι εξίσου αυθεντικά. Σε περίπτωση διαφορών στην ερμηνεία, θα υπερισχύει το κείμενο στην αγγλική γλώσσα.

Υπογράφηκε στην Αθήνα στις 16 Μαΐου 2001.

AGREEMENT BETWEEN

THE MINISTRY OF NATIONAL DEFENCE OF THE HELLENIC

REPUBLIC AND

THE FEDERAL MINISTRY OF DEFENCE OF THE FEDERAL REPUBLIC OF YUGOSLAVIA

ON PARTICIPATION IN THE MULTINATIONAL PEACE SUPPORT OPERATIONS TRAINING CENTRE (MPSOTC)

The Ministry of National Defence of the Hellenic Republic, hereinafter referred to as "the Host Party" and the Federal Ministry of Defence of the Federal Republic of Yugoslavia, hereinafter referred to as "the Party".

Reaffirming their dedication to the purposes and principles provided by the United Nations Charter.

Assuming that development of mutual co-operation will contribute to the stability of the wider region and will help improve good relations.

Knowing that politico - military co-operation constitutes the basic element to enhance the UN capabilities in security and peacekeeping.

Confident that there must be a further development in the co-operation and the dialogue between the countries in Peace Support Operations (PSOs) issues.

Wishing to contribute in the enhancement of training and interoperability of their armed faeces, according to the new operation requirements of the PSOs.

Have agreed as follows:

ARTICLE 1 AIM

The basic aim of the Multinational Peace Support Operations Training Center (hereinafter referred to as "MPSOTC"), is to improve training according to the new operations requirements of PSOs, and to provide the appropriate venue for exchanging ideas and experiences regarding PSO issues.

ARTICLE 2 PRINCIPLES

1. The Host Party undertakes the obligation to provide for the required installations/facilities and the appropriate infrastructure for Communications and Information Systems Support, as well as the necessary Logistic and "Host Nation Support" for the unimpeded function of the MPSOTC and fulfillment of its mission.

2. The Host Party and the Party (hereinafter referred to as "the Parties") assure that the MPSOTC activities are in accordance with the purposes and principles of UN.

3. The participation in the MPSOTC activities is not directed against any other state, and it does not intend to train personnel or military forces against any other country or group of countries.

4. Training offered by MPSOTC will be transparent. The Academic Calendar will be promulgated in time, according to article 5 para 3, to the Party and to the international organisations.

5. The Centre activities are in accordance with the OSCE founding principles and will help the training of individuals and units from the Party, in the accomplishment of PSOs possibly assigned to them by international organisations.

6. This Agreement will not affect in any way the rights and obligations of the Parties, deriving from treaties and agreements that they have already signed.

7. The Host Party retains the full right to start discussions and conclude other bilateral Agreements of similar nature with other countries or international organisations. The Party will be promptly informed upon conclusion of any such Agreement.

8. English will be the working language of the MPSOTC. Interpretation services may be available in other languages, within means and capabilities, after co-ordination between the Parties.

ARTICLE 3 MISSION OF THE MPSOTC

1. The mission of the MPSOTC is to provide high level theoretical and practical education and training, with comprehensive coverage of PSOs, to cadres (Staff Officers, Platoon Leaders, Company and Unit Commanders, Observers), as well as to multinational troops (Platoons, Companies, Units), according to current international standards.

2. In addition, the MPSOTC has the task to provide the appropriate mission oriented pre-deployment training, on all relevant aspects of PSOs, to staff officers, military observers and national or multinational contingents, before their deployment for a specific mission, as well as to their replacements.

ARTICLE 4

ESTABLISHMENT - ORGANISATION ■ SUBORDINATION

1. The MPSOTC is an establishment staffed with personnel of the three Branches of the Armed Forces which is subordinated to the National Defence General Staff of the Host Party.

2. The organisational chart of the MPSOTC is depicted in ANNEX "A" which may be modified by the Host Party in accordance with the functional requirements of the MPSOTC.

3. The MPSOTC's permanent staff (both teaching and administrative) will be consisted of military (Army, Navy, Air Force), as well as civilian personnel.

4. The Host Party will provide all necessary military and civilian personnel, except of the following posts which should be filled by international personnel, after previous agreement between the Host Party and any other interesting country and the signing of a'relevant MOU:

a. Staff Officers.

b. Instructors

5. The Party may provide instructors after signing of a relevant MOU.

6. The Party maintains the right to withdraw its personnel from the MPSOTC, after a timely notice to the Host Party. This notice must be a formal written notification from the competent authority of the Party provided to the Host Party one (1) month in advance.

ARTICLE 5 TRAINING

a. Multinational PSOs Officers (basic and advanced^

(3) The purpose of the course is to train and prepare officers from different countries for assignment as Logistic Staff Officers in Multinational Brigade HQs, or Multinational service support HQs and/or in National Contingents for the conduct of PSOs.

(4) Course curriculum provides for both theoretical and practical (exercises) lessons conducted in-door and in the field.

(5) Maximum National participation: five (5) trainee

officers.

d. CFE Inspectors/Escorts Course

(1) Duration: two (2) weeks.

(2) Number of courses per year: One (1)

(3) The purpose of the course is to train and prepare designated individuals to perform duties as Inspectors and Escorts in the framework of the Conventional Forces Europe (CFE) Treaty.

(4) Course curriculum provides for both theoretical and practical (exercises) lessons.

(5) Maximum National participation: five (5) trainee

officers.

2. Upon graduation, the trainees will receive official course certificates, prepared by the MPSOTC .

3. During May every year, the Host Party shall provide the Academic Calendar for the next year to the Party and to international organisations.

4. The provisions of this article concerning the courses may be modified at any time by the Host Party, which is obliged to notify the Party six (6) months before the new provisions come into force.

ARTICLE 6 PROCEDURES

1. The necessary information concerning the size of the participation (number of cadres or troops) and the procedures of transportation, armament, clearance during entrance and exit, as well as other details, will be provided by the responsible body of the Party to the respective body of the Host Party, to enable the Host Party to plan for the reception and transportation from the entry point to the MPSOTC.

2. The above information has to be provided at least one month before the date of arrival of the participants, by sending a "Joining Report."

3. The Party may dispatch to tne MPSOTC for troops training organic platoons or companies, fully equipped, and will co-ordinate with the Host Party the structure of its contingent, as well as the arrival, accommodation and departure details.

4. The MPSOTC retains the right, during the course, to specifically organise the trainees, in order to form the suitable force for the conduct of the training.

5. Leaves or days off are normally not authorized during the course. In emergency situations and after a written notification from the relevant authority of the Party, the Commander of MPSOTC can grant short leaves either for Greece or for the country of origin.

6. The trainees during the course have to wear either duty uniform or field uniform, as it will be indicated in the course schedule.

7. Foreign trainees (military or civilian) shall conform with the security regulations of the Host Party's Armed Forces.

ARTICLE 7 LEGAL ISSUES

1. For any act or omission committed in the territory of the Host Party, the military and civilian personnel of the Party will be under the exclusive jurisdiction of the penal authorities of the latter.

2. The Commander of the MPSOTC has the authority to issue orders regarding the function of the MPSOTC, to all of his subordinates, as well as to all trainees. All personnel has to obey such orders, as long as they do not contradict with their national laws and regulations.

3. The Chain of Command and discipline within the national contingent of the Party are defined according to its national regulations.

4 The MPSOTC's official correspondence will be conducted through the competent authorities of the Parties.

ARTICLE 8 CLAIMS

1. The Parties renounce any claim to compensation in case of death, injury or damages that may occur to personnel or to the Parties' property arising from acts or omissions caused by the personnel of the other Party during the rendering of services under the terms of this Agreement. Claims may only be raised if the action or omission took place deliberately or out of gross negligence. In such a case, claims shall be settled by direct negotiations between the Parties without recourse to the jurisdiction of a third party.

2. In case of death, injury or damages caused to third parties by personnel of the Party acting under the terms of this Agreement, the Parties shall agree on payment of compensation. If agreement cannot be reached, the case shall be submitted to the competent Courts of the Hellenic Republic.'

3. In case of claims against members of the personnel of the Party arising out of acts or omissions not done in the execution of their duties under the terms of this Agreement, the Parties shall agree on the payment of compensation by direct negotiations, taking into account all the circumstances of the case. If an agreement that satisfies the claimant cannot be reached, the case shall be submitted to the competent Courts of the Hellenic Republic'

ARTICLE 9 HOST NATION SUPPORT

1. The logistic support of the MPSOTC is a Host Party responsibility.

2. Details of "Host Nation Support" will be defined in a separate MOU to be signed between the Parties.

3. The Host Party is responsible to keep the "Logistic and Administrative Support Platoon" at the appropriate strength and readiness in order to provide the necessary support for the smooth function of the MPSOTC.

ARTICLE 10 SETTLEMENT OF DISPUTES

Any dispute arising from the interpretation or application of this Agreement shall be directly resolved by the Parties themselves through mutual negotiation and without recourse to outside jurisdiction.

ARTICLE 11 AMENDMENTS

1. The Parties have the right to propose written amendments to any article of this Agreement.

2. If agreed upon by the Parties, the amendments shall enter into force according to the procedure described in Article 12 of the present Agreement.

3. The provisions of paras 1 & 2 of this article are without prejudice to articles 4 para 2 and 5 para 4 which provide for changes unilaterally effected by the Host Party.

ARTICLE 12 ENTRY INTO FORCE

This Agreement shall enter into force on the date of exchange of diplomatic notes on the completion of internal legal procedures. However, where feasible, the Parties shall act according to the provisions of this Agreement from the date of its signature

ARTICLE 13 DURATION

This Agreement will be valid for an indefinite period of time, unless the Parties decide otherwise.

ARTICLE 14 TERMINATION

1. The present Agreement may be denounced by either Party at any time.

2. Either Party which is interested in terminating this Agreement will send a written notification to the other Party.

3. The termination shall take effect one month after the receipt of the written notification mentione'd in para 2 of this article.

4. In the case that there are financial matters or claims pending at the time of termination, the present Agreement will remain in force until the specific issues are definitely settled.

The present Agreement is written in two original copies, each drawn up in the English, Greek and Serbian languages, ail texts being equally authentic. In case of differences in interpretation, the text in the English language shall prevail.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευσή του στην Εφημερίδα της Κυβερνήσεως, και της Συμφωνίας που κυρώνεται προσωρινώς και οριστικώς σύμφωνα με τα οριζόμενα στο άρθρο 12 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.
