Κύρωση της Συμφωνίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ρωσικής Ομοσπονδίας περί συνεργασίας στους τομείς των ταχυδρομείων και των τηλεπικοινωνιών.

Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ

Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή:

Άρθρο πρώτο

Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η Συμφωνία μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ρωσικής Ομοσπονδίας περί συνεργασίας στους τομείς των ταχυδρομείων και των τηλεπικοινωνιών, που υπογράφηκε στην Αθήνα στις 29 Ιουλίου 1999, της οποίας το κείμενο σε πρωτότυπο στην ελληνική και αγγλική γλώσσα έχει ως

εξής:

ΜΕΤΑΞΥ ΤΗΣ ΚΥΒΕΡΝΗΣΗΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΚΑΙ ΤΗΣ ΚΥΒΕΡΝΗΣΗΣ ΤΗΣ ΡΩΣΙΚΗΣ ΟΜΟΣΠΟΝΔΙΑΣ ΠΕΡΙ ΣΥΝΕΡΓΑΣΙΑΣ ΣΤΟΥΣ ΤΟΜΕΙΣ ΤΩΝ ΤΑΧΥΔΡΟΜΕΙΩΝ ΚΑΙ

ΤΩΝ ΤΗΛΕΠΙΚΟΙΝΩΝΙΩΝ

Η Κυβέρνηση της Ελληνικής Δημοκρατίας και η Κυβέρνηση της Ρωσικής Ομοσπονδίας, αναφερόμενες στη συνέχεια της παρούσας ως Μέρη,

ΟΔΗΓΟΥΜΕΝΕΣ από την επιθυμία να αναπτύξουν και να εμβαθύνουν αμοιβαίως επωφελή συνεργασία στους τομείς των ταχυδρομείων και των τηλεπικοινωνιών προς συνολικό όφελος της πολιτικής, οικονομικής και κοινωνικής ανάπτυξης των αντίστοιχων χωρών τους,

ΣΥΜΦΩΝΗΣΑΝ ΩΣ ΑΚΟΛΟΥΘΩΣ:

Άρθρο 24

Η παρούσα Συμφωνία θα τεθεί σε εφαρμογή κατά την ημερομηνία της τελευταίας γραπτής ανακοίνωσης από τα Μέρη της υλοποίησης των εσωτερικών διαδικασιών που είναι αναγκαίες για να καταστεί η Συμφωνία ενεργή.

Η παρούσα Συμφωνία θα παραμένει σε ισχύ για διάστημα έξι μηνών από την ημερομηνία που ένα από τα Μέρη ανακοινώσει γραπτώς προς το άλλο Μέρος την πρόθεση του να τερματίσει την εφαρμογή της Συμφωνίας.

Συντάχθηκε στην Αθήνα, στις 29 Ιουλίου 1999, σε δύο αντίγραφα, το καθένα στην ελληνική, ρωσική και αγγλική γλώσσα. Όλα τα κείμενα είναι εξίσου αυθεντικά.

Σε περίπτωση που υπάρξει διάσταση επί της ερμηνείας το αγγλικό κείμενο θα υπερισχύει.

AGREEMENT

between the Government of the Hellenic Republic and the Government of the Russian Federation on cooperation in the field of Posts and Telecommunications

The Government of the Hellenic Republic and the Government of the Russian Federation hereinafter referred to as Parties,

guided by the desire to develop and deepen mutually beneficial cooperation in the field of posts and telecommunications for the overall benefit of political, economic and social development of their respective countries,

have agreed as follows:

Article 1

Matters relating to the provision and operation of postal and telecommunication services, not provided for by this Agreement, will be regulated by the provisions of the Constitution, Convention and Postal Parcels Agreement of the Universal Postal Union (UPU), as well as those of the Constitution, Convention, Administrative Regulations and Recommendations of the International Telecommunication Union (ΠΌ).

Article 2

Between the Hellenic Republic and the Russian Federation there shall exist both direct and transit exchanges of ordinary and registered letter post such as letters, postal cards, printed matter, small packets, insured letters and postal parcels, ordinary and insured ones.

Article 3

The Postal Administrations of the Party States shall determine by correspondence the offices and points of mail

exchange and inform each other of the anticipated changes in time.

Article 4

The Postal Administrations of the Party States shall inform in time each other of the restrictions relating to the conditions of posting and delivery and the to content of postal items in accordance with the national legislation of the Party States.

Article 5

The Postal Administrations of the Party States shall endeavor to render mutual assistance in matters relating to the transit of letter post and postal parcels destined to third countries with which they have postal traffic.

Article 6

The Postal Administrations of the Party States shall endeavor to take necessary measures for improvement of forms and methods of mail exchange to expedite transportation of the mail and secure its safety.

Article 7

The Postal Administrations of the Party States shall bear liability for the loss, theft or damage to the registered letter post, insured letters and postal parcels except for «force majeure» cases.

The amount of damage compensation and the liability shall be regulated by the provisions of the Convention and Postal Parcels Agreement of the Universal Postal Union.

Article 8

The Postal Administrations of the Party States shall promote the development of cooperation in the field of philately including the organization of philatelic exhibitions.

Article 9

Telecommunications between the Hellenic Republic and the Russian Federation shall be performed through telephone, facsimile, telex and data services as well as telecommunication channels for transmission and reception of television and radio broadcasting programs.

The Communications Administrations of the Party States may agree on setting up other services.

Article 10

All kinds and categories of telecommunications services set forth in the provisions of the Constitution, Convention, Administrative Regulations and Recommendations of the International Telecommunication Union shall be allowed unless there are any restrictions declared by the Communications Administrations of the Party States through the International Telecommunication Union.

Article 11

The Communications Administrations of the Party States shall endeavor to take measures, as may be necessary, to further develop all kinds of telecommunications services.

Article 12

The Parties shall promote the development of space communication systems.

Article 13

In case of mutual interest the Parties shall promote cooperation in the framework of international projects on the construction of telecommunications objects.

Cooperation on international projects shall be implemented on the basis of separate agreements concluded between the concerned organizations of the Party States. Article 14

The Communications Administrations of the Party States shall endeavor to render mutual assistance in ensuring telecommunications transit to third countries.

Article 15

If necessary, the Communications Administrations of the Party States shall render assistance in drawing up plans to implement the provisions set forth in Articles 9, 10, 11, 12, 13 and 14 of this Agreement by mutual consent. Article 16

The Communications Administrations of the Party States, in the required cases, shall coordinate the use of frequencies by radio services which are within their competence in accordance with the legislation of the Party States. Such coordination shall be finalised by exchanging letters or signing separate documents.

Article 17

The Communications Administrations of the Party States shall cooperate with the organizations and enterprises of other Party which provide telecommunications services based on the license issued by the respective Communications Administration.

Article 18

The Communications Administrations of the Party States shall promote the expansion of business contacts between companies and specialists to get acquainted with the operation of communication facilities and enterprises of both countries through the exchange of experience and scientific and technical information in the field of posts and telecommunications, provided no contractual and/or other obligations of the Parties and/or their Communications Administrations are infringed.

The Communications Administrations of the Party States shall inform each other of their liberalization programs in the communications sector and investment programs in the field of posts and telecommunications which may be of mutual interest with a view to encourage participation in the implementation and operation of telecommunications projects of companies from the other Party State.

Article 19

When establishing tariffs and charges as well as drawing up accounts for postal and telecommunications services, a special drawing right (SDR) unit shall be used or, by agreement between the Communications Administrations of the Parties, any other monetary unit defined by the Conventions of the Universal Postal Union and the International Telecommunication Union may be used.

Article 20

Tariffs and charges for postal and telecommunications services shall be established in accordance with the provisions of the Convention and Postal Parcels Agreement of the Universal Postal Union, and the Convention, Administrative Regulations and, as appropriate, Recommendations of the International Telecommunication Union. These matters will be the subject of separate agreements between the concerned international operators of both countries.

Article 21

The Communications Administrations of the Party States shall endeavor to settle their accounts for postal and

telecommunication services in accordance with the provisions of the Convention and Postal Parcels Agreement of the universal Postal Union and the Convention, Administrative Regulations and, as appropriate. Recommendations of the International Telecommunication Union. The balance payment shall be considered as a current banking operation and be effected in conformity with the existing agreements concluded between the Russian Federation and the Hellenic Republic on the matter of mutual settlements and banking operations.

Article 22

Communication on service matters between the Communications Administrations of the Party States and their enterprises shall be conducted in English or French.

Article 23

The Communications Administrations of the Party-States, subject to obligations and commitments imposed on them by international Agreements and Treaties and due to their participation in International bodies, if required, shall exert their influence to the greatest possible extent in order to simplify formalities and procedures and to have tari'ffs reduced for exchange of postal and telecommunication traffic between the Hellenic Republic and the Russian Federation.

Article 24

This Agreement shall come into effect on the date of the last written notification of the implementation by the Parties of internal procedures necessary for the Agreement to be effective.

This Agreement shall remain effective within six months from the date when one of the Parties notifies the other Party in writing of its intention to terminate the execution of the Agreement.

Done in Athens on 29.7.1999, in two copies, each in the Greek, Russian and English languages, all the texts being equally authentic.

In case of any divergence of interpretation, the English text shall prevail.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευση του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 24 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεση του ως νόμου του Κράτους.
