Άρθρο 7

Αυτή η Συμφωνία θα τεθεί σε ισχύ κατά την ημερομηνία, που το ένα από τα Συμβαλλόμενα Μέρη θα ειδοποιήσει γραπτώς το άλλο, έχοντας ολοκληρώσει τις απαραίτητες εσωτερικές διαδικασίες.

Αυτή η Συμφωνία θα παραμείνει σε ισχύ για πέντε έτη και θα ανανεωθεί αυτομάτως για μια περίοδο πέντε ετών, εκτός εάν ένα από τα δύο Μέρη ειδοποιήσει γραπτώς το άλλο έξι μήνες πρίν από την ημερομηνία λήξεως.

Εγινε εις διπλούν στο Πεκίνο, στις 3 Ιουνίου 2002, στην Ελληνική, Κινεζική και Αγγλική γλώσσα, όπου και τα τρία κείμενα είναι εξίσου αυθεντικά. Σε περίπτωση αποκλίσεων κατά την ερμηνεία της Συμφωνίας αυτής, θα υπερισχύσει το Αγγλικό κείμενο.

AGREEMENT BETWEEN THE MINISTRY OF AGRICULTURE OF THE HELLENIC REPUBLIC AND THE STATE ADMINISTRATION OF THE PEOPLE'S

REPUBLIC OF CHINA

ON FORESTRY COOPERATION

The Ministry of Agriculture of the Hellenic Republic and the State Administration of the People's Republic of China (hereinafter referred to as «the Parties*),

Desiring to implement the Agreement on Economic, Industrial and Technical Cooperation between the Government of the Hellenic Republic and the Government of People's Republic of China, signed on 25th of June 1992,

Acknowledging the significance of forestry in social and economic development, as well as the environmental protection in both countries,

Desiring to sustain experts of both countries making joint efforts in scientific and technical forestry fields,

Recognizing that cooperation in forestry research has to be carried out to mutual benefit of both Parties,

Article 1

The Parties agree to undertake efforts to develop cooperation in forestry administration, scientific and technical research in line with the existing laws and regulations, bearing in mind that the Hellenic Republic is a memberslate of the European Union, therefore is..........to observe

and to act in conformity with the European Union's legislation.

Article 2

The Parties agree that the fields of forestry cooperation may include the following:

1. Exchange of technical information, publications, documents and other research outputs

2. Exchange of experts and consultants

3. Implementation of joint research, joint surveys and experiments

4. Training

5. Study tours

Article 3

The Parties agree that the fields of mutual cooperation include mainly olive oil industry, research on non-timber forest products, chemical forest products, timber processing, forest pest and diseases control, forest fire control, desertification combating, processing and trade of forest products, forest management, natural forest protection, conservation of biological diversity, and other fields of common interests. Within the outline of this Agreement, both parties will jointly develop relevant plans, according to the specific fields of interest.

Article 4

The Parties will designate the specific liaison agency to be responsible for contacling and coordinating joint research projects. The liaison agency of the Hellenic Republic is the Ministry of Agriculture. The liaison agency of the People's Republic of China is the Department of International Cooperation of the State Forestry Administration. The liaison agencies will discuss in details the fields and means of joint plans through letters and will also hold working conferences, when this appears necessary.

Article 5

On the expenses arising from the exchange of delegations, experts and consultants, the sending party shall bear all the expenses including board and lodging and will inform the host country of the visit at least one month before the arrival of the delegation.

The two Parties shall explore all the possibilities to ensure the availability of financial resources from the European Union and/or international organizations and funding agencies.

If financing is to be undertaken by either of the two Parties, it shall be subject to the availability of their financial resources.

The activities in the framework of Official Bilateral Development Assistance shall be financed by the Hellenic Party.

Article 6

The Parties share the joint achievements. The Parties are responsible for neither transferring nor publicizing the information provided by either party and achievements through cooperation to a third party, unless the common consensus in writing granted in advance.

Article 7

This Agreement shall enter into force on the date when a Contracting Party gives the other notice in writing, after it completes all the necessary procedures internally.

This Agreement shall remain into force for five years and be automatically prolonged for a period of five years, unless either of the two Parties gives the other notice in writing six months in advance, before the expiring date.

Done in duplicate in Bcijing, on 3rd of June 2002, in the Hellenic, Chinese and English languages, where all three texts are equally authentic. In case there is any divergence of interpretation, the English text shall prevail.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευ-σή του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 7 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως Νόμου του Κράτους.
