ΝΟΜΟΣ ΥΠ' ΑΡΙΘ. 3179

Κύρωση της Συμφωνίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης του Βασιλείου της Σουηδίας για τη συμμετοχή σουηδικού στρατιωτικού ή πολιτικού προσωπικού στο Πολυεθνικό Κέντρο Εκπαιδεύσεως Επιχειρήσεων Υποστήριξης της Ειρήνης (Π.Κ.Ε.Ε.Υ.Ε.).

Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ

Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή: Άρθρο πρώτο

Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η Συμφωνία μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης του Βασιλείου της Σουηδίας για τη συμμετοχή σουηδικού στρατιωτικού ή πολιτικού προσωπικού στο Πολυεθνικό Κέντρο Εκπαιδεύσεως Επιχειρήσεων Υποστήριξης της Ειρήνης (Π.Κ.Ε.Ε.Υ.Ε.), που υπογράφηκε στην Αθήνα στις 18 Ιουνίου 2002, της οποίας το κείμενο σε πρωτότυπο στην αγγλική γλώσσα και σε μετάφραση στην ελληνική έχει ως εξής:

The Government of the Hellenic Republic, hereinafter referred to as the "Host Party" and the Government of the Kingdom of Sweden, hereinafter referred to as "the Party", collectively hereinafter referred to as "the Parties".

Reaffinrjing their dedication to the purposes and principles provided by the Charter of the United Nations.

Assuming that development of mutual cooperation will contribute to the stability of the wider region of Europe and will help improve the good relations between the Parties.

Recognizing that the politico-military cooperation constitutes the basic element to enhance the UN capabilities in security and peacekeeping.

Being confident that there must be a further development in the cooperation and dialogue between the countries related to Peace Support Operations, hereinafter referred to as "PSOs".

Desiring to contribute in the enhancement of training and interoperability of their Armed Forces, according to the new operation requirements of the PSOs.

Have airreed as follows:

ARTICLE 1 PURPOSE

The purpose of the present Agreement. is to establish the legal framework which is necessary for the participation of the Swedish military or civilian personnel in the Multinational Peace Support Operation Training Center (MPSOTC), hereinafter referred to as "the Center".

ARTICLE 2 PRINCIPLES

1. The Host Party undertakes the obligation to provide the required installations/facilities, the appropriate infrastructure for communications and information systems support, as well as the necessary logistics and "Host Nation Support" for the unimpeded functioning of the Center and the fulfillment of its missions.

2. The Parties assure that the activities of the Center are in

accordance with the purposes and principles of the UN.

3. The participation in the activities of the Center is not directed against any other state and it does not intend to train personnel or military

forces against any other country or group of countries.

4. The training offered at the Center will b£ transparent. The academic calendar will be provided in time by the Host Party, according to article 5 para 3 of the present Agreement.

5. The Center's activities are in accordance with the OSCE founding principles which are also included in the framework of PfP. These activities will help the training of individuals and units of the Party on the accomplish e-τ of PSOs, possibly assigned to them by international organizations.

6. Tins Agreement will not affect in any way the rights and obligations of the Parties deriving from treaties or agreements that they have previously signed.

7. The Host Party retains the full right to start discussions and sign other bilateral agreements of similar nature with other countries or international organizations. The Party will be . promptly informed upon signature of any ζagreement.

8. The working language of the Center will be the English language.

ARTICLE 3 MISSION OF THE CENTER

1. The mission of the Center is to provide high level theoretical and practical education and training, with comprehensive coverage of PSOs, to cadres (staff officers, platoon leaders, company and unit commanders, observers), as well as to multinational troops (platoons-companies-units), according to the standards of the appropriate international organizations, such as the UN, OSCE, NATO, EU.

2. Moreover, the Center has the task to provide the appropriate mission oriented pre-deployment training, on all relevant aspects of PSOs, to staff officers, military observers and national or multinational contingents, before their deployment for a specific mission, as well as to their replacements .

ARTICLE 4 ORGANISATION

1. The Center is an establishment staffed with personnel of the three Branches of the Hellenic Armed Forces which is subordinated to the National Defense General Staff of the Host Party.

2. The organizational chart of the Center is in ANNEX "A" which may be modified by the Host Party in accordance with the functional requirements of the Center .

3. The Center's permanent Staff (both teaching and administrative) will be consisted of military (Army, Navy, Air Force) , as well as of civilian personnel.

4. The Host Party will provide all necessary military and civilian personnel, except for the following posts which should be filled by international personnel:

a. Staff Officers.

(3) The purpose of the course is to train and prepare platoons and companies for participation in PSOs, either in multinational or national formations and to provide the necessary mission tailored pre-deployment training. The course curriculum provides for both theoretical and practical (exercises) lessons, to be conducted "in-door" and in the field.

(4) Minimum national participation: one organic

platoon.

c Multinational PSOs Logistics Course

(1) Duration: one (1) week.

(2) Number of courses per year: one (1)

(3) The purpose of die course is to train and prepare officers from different countries for assignment as logistic staff officers in multinational brigade HQs, or multinational service support HQs and/or in national contigents for the conduct of PSOs.

(4) The course curriculum provides for both theoretical and practical (exercises) lessons, to be conducted "in-door", classrooms, command points and in the field.

(5) Maximum national participation per course: five (5) trainee officers.

d. CFE Inspectors/Escorts Course

(1) Duration: two (2) weeks.

(2) Number of courses per year: one (1)

(3) The purpose of die course is to train and prepare the designated personnel to perform duties as inspectors and escorts in the framework of the Conventional Forces Europe (CFE) Treaty.

(4) The course curriculum provides for both theoretical and practical (exercises) lessons.

(5) Maximum national participation per course: five

(5) trainee officers.

e. Military Observers Course

(1) Duration: one (1) week.

(2) ■ Number of courses per year: one (1)

(3) The purpose of die course is to train and prepare officers from different countries for assignment as military observers in PSOs and to familiarize the trainees with NATO C2 structure procedures,

SOPs and terminology.

(4) The course curriculum provides for both

theoretical and practical (exercises) lessons, conducted "in-door " and in the field.

(5) Maximum national participation per course: five

(5) trainee officers.

f. Border Confrrol/Seciflrity Course

(1) Duration: one (1) week.

(2) Number of courses per year: one (1)

(3) The purpose of the course is to train and familiarize officers and NCOs from different countries with all aspects of border control regime, to be capable to establish, organize, man, equip and

train Border Control Units.

(4) The course curriculum provides for both theoretical and practical (exercises) lessons, to be conducted "in-door" and in the field.

(5) Maximum national participation per course: five

(5) trainee officers.

2. Upon graduation, the trainees will receive official course certificates, prepared by the Center.

3. During May every year, the Host Party shall provide the academic calendar for the next year to the Party and to the appropriate international organizations.

4. The provisions of this article may be modified at any time by the Host Party, which is obliged to notify the Party at least six (6) months before the new provisions enter into force .

ARTICLE 6 PROCEDURES

1. All necessary information concerning the size of the participation (number of cadres or troops) and the procedures of transportation, armament clearance during entrance and exit, as well as other details will be provided by the responsible body of the Party to the respective body of the Host Party, to enable the latter to plan for the reception and transportation from the entry point to the Center.

2. The above information shall be included in a "Joining Report", to be sent to the Hellenic National Defence General Staff at least one month prior to the date of the arrival of the Swedish personnel.

3. The Party may dispatch to the Center for troop training fully equipped organic platoons or companies, in such a case, it will consult with the Host Party on the structure of its contingent, as well as on all details concerning its arrival, accommodation and departure.

4. The Center maintain the right, during the course, to specifically organize the trainees, in order to form the suitable force for the conduct of the framing.

5. Leaves or days off are normally not authorized during the course. However, in emergency situations and after a written notification from the responsible authority of the Party , the Commandant of the Center can grant short leaves either for Greece or for the country of origin.

6. The trainees, during the course, have to wear either duty uniforms or field uniforms, as it will be indicated in die course schedule.

7. Foreign trainees should conform with the security regulations of the Host Party.

ARTICLE 7 LEGAL ISSUES

1. The legal status of the personnel sent by the Party to the Greek territory according to the present Agreement, shall be governed by the Agreement among the States Parties ίο the North Atlantic Treaty and the other States participating in the Partnership for Peace regarding the status of their forces, signed in Brussels on 19 June 1995.

2. The Commandant of the Center has the authority to issue orders, regarding the functioning of the Center to all his subordinates, as well as to all trainees. The Swedish personnel will obey to such orders as long as they do not contradict with their national laws and regulations.

3. The chain of command and discipline within each national contingent of the Party is governed by its own national regulations .

4. The Centers official correspondence wife the Party will be conducted through the appropriate directorate, to be designated by the latter.

ARTICLE 8 HOST NATION SUPPORT

1. The logistic support of the Center is a responsibility of the Host Party.

2. The necessary details concerning "Host Nation Support" appear in the attached Annex "B" of the present Agreement.

3. The Host Party is responsible for keeping a logistic and adiriirustrative support platoon at the appropriate strength and readiness in order to provide the necessary support for the smooth functiomng of the Center.

ARTICLE 9 SETTLEMENT OF DISPUTES

All disputes arising from the interpretation or application of diis Agreement shall be settled by direct consultations between the Parties, without recourse to outside jurisdiction .

ARTICLE 10 AMENDMENTS

1. The Parties have the right to propose written amendments to any article of this Agreement.

2. If agreed upon by the Parties, these amendments shall enter into force according to the procedure described in Article 11 of the present Agreement.

3. The provisions of paras 1 and 2 of this article are without prejudice to articles 4 para 2 and 5 para 4 which provide for amendments to be unilaterally effected by the Host Party.

ARTICLE 11 ENTRY INTO FORCE

The present Agreement with its Annex "A" and "B" shall enter into force on the date of die receiving of the last notification whereby the Parties notify each other, in written form, that the requirements of their internal legislation for its entry into force have been fufilled. However, where feasible, the Parties shall act according to the provisions of this Agreement from the date of its signature.

ARTICLE 12 DURATION-TERMINATION

1. This Agreement shall remain in force for an unlimited period of time. It may be denounced by either Party through a written notification which is to be sent to the other Party. The Agreement shall be terminated in six months from die date that the otiier Party receives a written notification of such an intention.

2. In the event that there are financial issues or claims which remain unresolved at the time of termination, the provisions of the present Agreement which are related to those issues or claims shall remain in force, until the specific issues are definitely settled.

(3) Postal service.

(4) Telephone communications - FAX- Internet connection will be provided to satisfy official service needs.

(5) Banking Exchange.

(6) Courtesies (Plaques- souvenirs -ceremonies-cultural activities-tours).

(7) The trainees will be accomodated without charge in an apartment, rent by the Host Party, or in of /"BOoTsln the Center when constructed.

(8) Food full board without charge is offered for the trainees.

c. The Party may submit any additional requirements of Host Nation Support different from those defined in this Annex, which will be considered, but

the cost will be born by the Party.

d. Other Facilities

The entrance and use of the Officer's Mess .Seaside Resorts and Commissary is permitted under the same conditions as it is provided to Host Party military personnel and their dependents.

e. Transportation.

The Host Party will provide the following transportation :

(1) Domestic Transportation support (from the points of entry in Greece to the Center and vice versa).

(2) Transportation from the Center to the training fields and

vice-versa.

(3) Transportation for participation in official cultural activities, visits to Museums and archeologicai sites.

(4) Transportation to hospital if needed.

4. RESPONSIBILITIES OF THE PARTY:

a. The personnel of the Party haye to respect the laws of the Host Party as well as the culture, customs and traditions of its population.

b. The personnel of the Party shall be respectful to the Host Party environmental regulations.

5. ASSIGNMENT OF PERMANENT PERSONNEL:

a. The assignment will be done after consultation between the Party and the Host Party.

b. The Party will send to the appropriate directorate of the Hellenic National Defense of the Host Party an "Assignment Letter of Intent" which will include :

(1) Name-Rank

(2) Curriculum vitae (CV)

(3) The time period of the assignment.

c. The Hellenic National Defence of General Staff of the Host Party within ten (10) working days after the receipt of the Party letter will send back a letter accepting the assignment.

d. A week after the completion of letter exchanging the Party personnel may report to the Center.

6. FINANCIAL CONSIDERATIONS:

The salary of the permanent personnel will be paid by the Party.

7. DISCLOSURE OF INFORMATION

a. Information provided in confidence between the Parties will either retain its original classification or be assigned a classification that will ensure a degree of protection against disclosure.

b. Each Party will take all lawful steps to keep free from disclosure all confidential information exchanged under this agreement.

c. This agreement wiil be given an appropriate security classification to ensure the protection on its contents. This classification may be changed by mutual agreement.

Η Κυβέρνηση της Ελληνικής Δημοκρατίας, που εφεξής θα καλείται το "Φιλοξενόν Μέρος" και η Κυβέρνηση του Βασιλείου της Σουηδίας, που εφεξής θα καλείται το "Μέρος", και που από κοινού θα καλούνται "τα Μέρη".

Επαναδιαβεβαιώνοντας την αφοσίωσή τους στους σκοπούς και τις αρχές που προβλέπει ο Καταστατικός Χάρτης των Ηνωμένων Εθνών.

Θεωρώντας ότι η ανάπτυξη αμοιβαίας συνεργασίας θα συμβάλει στην σταθερότητα της ευρύτερης περιοχής της Ευρώπης και θα βοηθήσει στην βελτίωση των καλών σχέσεων μεταξύ των Μερών.

Αναγνωρίζοντας ότι η πολιτικο - στρατιωτική συνεργασία συνιστά το βασικό στοιχείο της ενίσχυσης των δυνατοτήτων των Ηνωμένων Εθνών στην ασφάλεια και την διατήρηση της ειρήνης. Πεπεισμένες ότι πρέπει να υπάρξει περαιτέρω εξέλιξη στην συνεργασία και τον διάλογο μεταξύ των χωρών σε σχέση με τις Επιχειρήσεις Υποστήριξης της Ειρήνης, που εφεξής θα καλούνται "PSOs".

Επιθυμώντας να συνεισφέρουν στην ενίσχυση της εκπαίδευσης και της διαλειτουργικότητας των Ενόπλων Δυ-νάμεών τους, σύμφωνα με τις νέες επιχειρηματικές απαιτήσεις των PSOs.
