Άρθρο 6

Το παρόν Μνημόνιο θα τεθεί σε ισχύ με τη λήψη της τελευταίας γραπτής ανακοίνωσης, με την οποία τα Μέρη θα ενημερώνουν το ένα το άλλο, δια της διπλωματικής οδού, για την ολοκλήρωση των απαραίτητων νομικών διαδικασιών.

Το παρόν Μνημόνιο θα παραμείνει σε ισχύ για περίοδο πέντε (5) ετών. Η Συμφωνία θα εξακολουθεί να ισχύει αυτομάτως για περίοδο δύο (2) επιπλέον ετών, εκτός εάν οποιοδήποτε από τα Μέρη γνωστοποιήσει εγγράφως στο άλλο, δια της διπλωματικής οδού, τουλάχιστον έξι (6) μήνες πριν την εκπνοή της αρχικής ή οποιαδήποτε άλλης περιόδου ισχύος, την πρόθεσή του να λήξει την παρούσα Συμφωνία.

Υπεγράφη στο Μπακού στις 2 Αυγούστου 2007, σε δύο πρωτότυπα, έκαστο στην Αζερική, Ελληνική και Αγγλική γλώσσα, όλα τα κείμενα εξίσου αυθεντικά.

Σε περίπτωση διαφορετικής ερμηνείας το Αγγλικό κείμενο υπερισχύει.

Memorandum of Cooperation between

the Government of the Hellenic Republic and the Government of the Republic of Azerbaijan in the Field of Natural Gas and Oil

The Government of the Hellenic Republic and the Republic of Azerbaijan (hereinafter referred to individually as the "Party" and collectively as the "Parties"):

Stressing that cooperation at all times shall be based on the respect and adherence to the principles and norms of international law;

Intending to extend their cooperation in the energy sector with the aim of increasing cooperation in the natural gas and oil sectors;

Expressing their willingness to contribute to the security of energy supply of the European Union;

Taking note of the European Union's Decision No. 1229/2003/EC for the development of the Trans European Energy Networks;

Taking note of the decision of the European Commission (No CAB D (2007)/629/ 22.05.07) regarding the granting of an exemption from the Third Party Access Requirements (hereinafter referred to as "TPA") for the new gas offshore interconnection infrastructure between Greece and Italy (hereinafter referred to as "Poseidon pipeline");

Respecting the Hellenic Republic's obligations arising from its membership to the European Union;

Recalling the Agreement between the Government of the Hellenic Republic and the Government of the Republic of Azerbaijan on Economic, Industrial and Technological Cooperation, signed in Baku on 26 July 1994;

Have agreed as follows:

Article 1

The subject of this Memorandum of Cooperation is to establish a framework for the basis of joint cooperation between the Parties in the field of supply and transit of natural gas, as well as in the field of research, extraction and exploitation of oil and exchange of know-how in these fields.

Article 2

Cooperation in the energy sector, in the fields of natural gas and oil is a priority for both Parties.

The Parties shall assess, evaluate the possibility and study the related terms of selling and transiting through pipelines natural gas originating from the Republic of Azerbaijan, to Greece destined for the domestic market and also for transit through the Poseidon pipeline to Italy and other European countries.

Article 3

The Parties will exchange relevant information, which may be of interest to each other or may assist them in making their decisions regarding the above mentioned objectives.

Article 4

The Parties will establish a Joint Sub-Committee in the framework of the Joint Intergovernmental Committee on Economic, Industrial and Technological Cooperation between the Hellenic Republic and the Republic of Azerbaijan in order to examine the above mentioned objectives in articles 1 and 2 and choose which ever option that achieves the interests of both Parties. The Joint Sub-Committee shall meet in Athens or in Baku, to be decided through diplomatic channels. The first meeting of the Joint Sub-Committee shall be held within two (2) months from the date of the entry into force of the Memorandum.

Article 5

The Memorandum does not constitute any selling, purchasing nor transfer obligations to either Party.

Article 6

The present Memorandum shall enter into force on the date of the last written notification by which the Parties inform each other through diplomatic channels of the completion of the necessary legal procedures.

The present Memorandum shall remain into force for a period of five (5) years. It shall thereafter be automatically renewed for a further two (2) year period, unless either Party notifies in writing the other, through diplomatic channels, at least six (6) months prior to the expiration of the initial or subsequent period, of its intention to terminate the present Memorandum.

Done at Baku on 2 August 2007 in duplicate each one in the Greek, Azerbaijani and English languages, all texts being equally authentic.

In case of divergence the English text shall prevail.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευση του στην Εφημερίδα της Κυβερνήσεως και του Μνημονίου Συνεργασίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 6 αυτού.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.
