Κύρωση της Συμφωνίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ρωσικής Ομοσπονδίας για την ίδρυση και τους όρους δραστηριοτήτων Πολιτιστικών Κέντρων.

Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ

Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή:

Άρθρο πρώτο

Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η Συμφωνία μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ρωσικής Ομοσπονδίας για την ίδρυση και τους όρους δραστηριοτήτων Πολιτιστικών Κέντρων, που υπογράφηκε στην Αθήνα στις 6 Δεκεμβρίου 2001, το κείμενο της οποίας σε πρωτότυπο στην ελληνική και αγγλική γλώσσα έχει ως εξής:

ΣΥΜΦΩΝΙΑ

Μεταξύ της Κυβερνήσεως της Ελληνικής Δημοκρατίας και της Κυβερνήσεως της Ρωσσικής Ομοσπονδίας για την Ίδρυση και τους Όρους Δραστηριοτήτων Πολιτιστικών Κέντρων

Η Κυβέρνηση της Ελληνικής Δημοκρατίας και η Κυβέρνηση της Ρωσσικής Ομοσπονδίας αναφερόμενες στο εξής ως τα «Μέρη»,

Εκφράζοντας την επιθυμία τους για διεύρυνση των υφισταμένων μεταξύ των δύο χωρών σχέσεων φιλίας και συνεργασίας στους τομείς του πολιτισμού, της επιστήμης και της εκπαιδεύσεως,

Ενεργώντας στο πνεύμα της καταρτισθείσας Τελικής Πράξεως της Διασκέψεως για την Ασφάλεια και τη Συνεργασία στην Ευρώπη, που υπεγράφη στο Ελσίνκι την 1 Αυγούστου 1975, καθώς και της Χάρτας των Παρισίων για μια Νέα Ευρώπη, της 21 Νοεμβρίου 1990,

Λαμβάνοντας υπόψη τις διατάξεις του Συμφώνου Φιλίας και συνεργασίας μεταξύ της Ελληνικής Δημοκρατίας και της Ρωσικής Ομοσπονδίας, της 30 Ιουνίου 1993,

Ενεργώντας στο πλαίσιο των διατάξεων της Συμφωνίας μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ρωσσικής Ομοσπονδίας, για πολιτιστική και επιστημονική συνεργασία, της 30

Ιουνίου 1993,

Συμφώνησαν τα ακόλουθα:

Άρθρο 16

Η παρούσα Συμφωνία τίθεται σε ισχύ από την ημερομηνία λήψης της τελευταίας έγγραφης ειδοποίησης, που επιβεβαιώνει ότι τα Μέρη ολοκλήρωσαν τις αντίστοιχες εσωτερικές διαδικασίες, που απαιτούνται για να τεθεί αυτή σε ισχύ.

Η παρούσα Συμφωνία ισχύει για χρονικό διάστημα πέντε ετών, και θα ανανεώνεται αυτομάτως για τα επόμενα πέντε έτη, εκτός εάν ένα από τα Μέρη, σε διάστημα όχι λιγώτερο των έξι μηνών από της λήξεως της πενταετούς ισχύος, ειδοποιήσει εγγράφως το άλλο Μέρος για την πρόθεση του να παύσει την ισχύ της.

Ολοκληρώθηκε στην Αθήνα, την 6η Δεκεμβρίου 2001 εις διπλούν, στην Ελληνική, τη Ρωσσική και την Αγγλική γλώσσα. Τα κείμενα έχουν την ίδια ισχύ, σε περίπτωση δε διαφωνίας ως προς τη μετάφραση, θα χρησιμοποιηθεί το Αγγλικό κείμενο.

ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΤΗΣ ΡΩΣΣΙΚΗΣ ΟΜΟΣΠΟΝΔΙΑΣ

AGREEMENT Between the Government of the Hellenic Republic

and the Government of the Russian Federation on the Establishment and Conditions for Activities of Cultural Centres

The Government of the Hellenic Republic and the Government of the Russian Federation, hereinafter referred to as "the Parties",

Expressing their desire to broaden the existing relations of friendship and co-operation between the two countries in the areas of culture, science and education,

Acting within the spirit of the Final Act of the Conference on Security and Co-operation in Europe, signed in Helsinki on 1 August 1975, as well as the Charter of Paris for a New Europe of 21 November 1990,

Having regard to the provisions of the Friendship and Cooperation Pact between the Hellenic Republic and the Russian Federation of 30 June 1993,

Acting within the framework of the provisions of the Agreement between the Government of the Hellenic Republic and the Government of the Russian Federation, on cultural and scientific co-operation of 30 June 1993,

Have agreed as follows :

Article 1

Both Parties may establish cultural centres on a mutual basis, hereinafter referred to as "the Centres".

The Greek Party may establish a Hellenic Cultural Centre in Moscow.

The Russian Party may establish a Russian Centre for Science and Culture in Athens.

The Parties may also establish their Centres in other cities of the receiving state, following consultations through diplomatic channels.

Article 2

The Centres shall contribute to the development of the relations between the Hellenic Republic and the Russian Federation, encouraging exchanges and the transmission of information on the values and achievements of each country in the areas of culture, education and science.

Article 3

The Centres shall enjoy of the rights of legal entities and operate in compliance with the legislation of the receiving state.

Article 4

The Parties shall provide the citizens of the Hellenic Republic and of the Russian Federation with free access to the premises of the Centres for participating in the events held by the Centres.

Article 5

The Hellenic Cultural Centre in Moscow shall develop its activities under the general supervision of the head of the Diplomatic Mission of the Hellenic Republic in the Russian Federation.

The Russian Centre for Culture and Science in Athens shall develop its activities under the general supervision of the head of the Diplomatic Mission of the Russian Federation in the Hellenic Republic. Such activities shall be ensured by the Russian Centre for International Scientific and Cultural Co-operation of the Government of the Russian Federation.

Article 6

The activities of the Centres shall include :

Holding cultural and informative events, such as exhibitions, theatrical performances and concerts, including events on the occasion of national holidays, national and international conferences, symposiums and festivals, as well as projecting cinema films, videos and television broadcasts.

Organising lectures, round tables, seminars and meetings on matters of culture, information and other issues of interest to both countries.

Holding meetings and press conferences with the participation of representatives of the public and prominent figures of both countries.

Establishing an information library, reading room, cinema halls and video projection rooms.

Teaching the Greek and Russian languages respectively, according to the legislation of the receiving state.

Disseminating books, periodicals, newspapers, journals and other printed and audio-visual materials, including information on the educational system of the sending state.

Presenting information on issues connected with the activities of the Centres and publishing a newsletter with a view to the regular information of the public on the activities of the Centres and the events of common interest to both countries.

Establishing an information bank on issues of cultural, scientific and other exchanges between the two countries, as well as providing assistance in the area of modem information services.

Holding cultural, educational and informative events for the children and the youth of both countries.

The Centres may establish direct links with Governmental Bodies, Local Authorities and non-governmental and social institutions of the receiving state as well as to hold events outside their premises.

The Centres shall inform about their plans for their activities the Ministry of Foreign Affairs of the receiving state.

Article 7

The Centres shall be non - profit foundations. However, without prejudice to the provisions of Article 8 of this Agreement, they may collect payments for covering part of their expenses from:

teaching of languages, the examinations and other services connected therewith ;

admission to the events and exhibitions ;

use of the libraries, repting of audio-visual facilities or other material related to the activities of the Centres, as well as sale of

catalogues, books, programmes, periodicals, other publications and audiovisual editions.

The exhibits of the exhibitions organised by the Centres in their premises and other spaces may only be sold subject to the payment of the duties and taxes provided for by the legislation of the receiving state.

Article 8

The Parties shall provide mutual assistance for finding the appropriate facilities, premises and plots for the Centres. Particular terms will be regulated by respective documents to be signed by the competent Greek and Russian authorities.

The Centres may be equipped with audio-visual, informative, computering and other facilities required for carrying out their activities according to this Agreement.

The Parties, according to the legislation of their States, shall permit the duty and tax free importation or shall exempt from the payment of custom duties and taxes, under temporary admission status, subject to reexportation, of goods which are not intended for sale, such as :

the equipment, furniture and other objects required for the operation of the Centres ;

the cinema films to be projected within the premises of the Centres or outside their premises, always, however, within the framework of the events organised by the Centres ;

the objects intended for the holding, of the exhibitions and other cultural - artistic events ;

any other material or object required for the decoration and for ensuring the operation of the Centres with the exception of spirits, tobacco and oil products as well as transport vehicles.

Article 9

The taxation of the revenues and the property of the Centres and the employees sent thereto to work shall be regulated by the tax legislation of the receiving state.

Article 10

Each Party shall appoint the personnel of its Centre. This personnel may consist of citizens of the sending state, the receiving state or persons domiciled in the receiving state.

The Directors of the Centres and their Deputies shall be citizens of the sending state and they may have diplomatic status on a mutual basis. The Parties shall inform each other on their appointment through diplomatic channels.

The Parties shall inform each other on the composition of the personnel of the Centres, as well as their assumption of duties or their dismissal from the Centres.

Article 11

The legal and social guarantees enjoyed by the citizens of the sending state shall apply to the employees of the Centres who are citizens of the sending state and are not domiciled in the receiving state, as well as the members of their families residing with them.

The labour legislation and social security regulations of the sending state shall apply for these persons.

Article 12

Each Party, on the basis of reciprocity and in accordance with the national legislation, shall permit the employees of the Centres of the other Party - citizens of the Hellenic Republic and citizens of the Russian Federation, as well as to the members of their families residing with them - to temporarily import, within 12 months from the date of their arrival, personal effects and transport vehicles (not more than two for every family), with exemption from the payment of custom duties and taxes, on condition of reexportation upon their definitive departure.

Exemption shall not extend to special or periodically payable taxes, dues and fees on the use of personal effects and transport vehicles within the receiving state, or levied in return for the provision of services.

The personal effects and the transport vehicles may be transferred to another legal or physical person by approval of the competent customs authorities and subject to prior payment of the corresponding duties, taxes and fees, in compliance with the customs and other procedures provided for by the legislation of the receiving state.

Exemptions referred to in this article shall not be granted to the employees of the Centres who are citizens of the receiving state or are domiciled or have their habitual residence in the Russian Federation or in the Hellenic Republic respectively.

Article 13

According to international treaties in force between the Hellenic Republic and the Russian Federation and to their national legislation as well as such other international contractual obligations they have, the Parties shall contribute to the timely examination of applications for entry permits for the employees of the Centres and the members of their families residing with them, as well as applications for temporary stay permits and other permits provided for by the legislation of the receiving state on the employment activities of aliens. .

The Parties shall also provide necessary assistance to those participating in the cultural events and exchanges organised by the Centres according to Article 6 of this Agreement.

Article 14

Hiring, dismissal and other matters concerning the conditions of employment of citizens of the receiving state or persons domiciled therein shall be regulated by the legislation of the receiving state.

Article 15

Any problems arising out of the interpretation and implementation of this Agreement shall be resolved through diplomatic channels.

Article 16

This Agreement shall enter into force on the date of receipt of the last written notification confirming that the Parties have completed respective internal procedures required for its entry into force.

This Agreement shall be valid for a time period of five years and shall be renewed automatically for further five - year periods, unless either Party notifies in writing the other Party of its intention to terminate the Agreement not less than six months before the expiry of the five-year period.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευση του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 16 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.
