Άρθρο 7

1. Η παρούσα Συμφωνία τίθεται σε ισχύ τριάντα (30) ημέρες από την ημερομηνία κατά την οποία τα Μέρη αντήλλαξαν, δια της διπλωματικής οδού, έγγραφες γνωστοποιήσεις, με τις οποίες πληροφορούν σχετικά με την ολοκλήρωση των απαιτούμενων για τη θέση της σε ισχύ εσωτερικών τους διαδικασιών.

2. Η παρούσα Συμφωνία θα παραμείνει σε ισχύ για περίοδο πέντε (5) ετών από την ημερομηνία που τίθεται σε ισχύ, και παρατείνεται εν συνεχεία σιωπηρά για ετήσιες διαδοχικές περιόδους, εκτός εάν ένα από τα Μέρη καταγγείλει εγγράφως τη Συμφωνία, δια της διπλωματικής οδού, τουλάχιστον έξι (6) μήνες πριν από την ημερομηνία λήξης της αρχικής ή όποιας μεταγενέστερης περιόδου ισχύος της.

3. Η λήξη της παρούσης Συμφωνίας δεν θίγει μη εκ-πληρωθείσες υποχρεώσεις που απορρέουν από συμφωνίες και συμβάσεις που συνήφθησαν μεταξύ οικονομικών παραγόντων των Μερών ή στο πλαίσιο της επιστημονικής και τεχνολογικής συνεργασίας, κατά τη διάρκεια της ισχύος της, εκτός αν διαφορετικά συμφωνηθεί αμοιβαία από τα Μέρη.

4. Τροποποιήσεις της παρούσας Συμφωνίας θα τίθενται σε ισχύ με την διαδικασία που προβλέπεται στην πρώτη παράγραφο του παρόντος Αρθρου.

Έγινε εις διπλούν, στην Αθήνα, την 3η Απριλίου 2009, έκαστο στην ελληνική, πορτογαλική και αγγλική γλώσσα και όλα τα κείμενα είναι εξ ίσου αυθεντικά. Σε περίπτωση διαφοράς ως προς την ερμηνεία υπερισχύει το αγγλικό κείμενο.

COOPERATION AGREEMENT BETWEEN THE GOVERNMENT OF THE HELLENIC REPUBLIC AND THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL ON ECONOMIC, SCIENTIFIC, TECHNOLOGICAL AND INNOVATION MATTERS

The Government of the Hellenic Republic and

The Government of the Federative Republic of Brazil (hereinafter referred to as "Parties"),

Desiring to promote the development of economic, scientific and technological cooperation between them, in areas of mutual interest, on the basis of equality, mutual benefit and reciprocity; and

Recognising the importance of long term measures for the successful development of the cooperation and the strengthening of ties between both countries at various levels and, in particular, at the level of their economic operators,

Have agreed as follows:

ARTICLE 1

1. The Parties shall, in compliance with their respective laws and regulations and taking into account their international obligations, as well as any Agreements between the Federative Republic of Brazil and the European Community, develop and strengthen the bilateral cooperation on economic, scientific, technological and innovation matters, on as broad a basis as possible, in all fields deemed to be in their mutual interest and benefit.

In applying this Agreement, the Hellenic Republic shall respect the obligations arising from its membership to the European Union.

2. Such cooperation shall be aimed in particular at:

a) strengthening and diversifying economic links between the Parties; and

b) encouraging cooperation between economic operators, particularly small and medium sized enterprises, with a view to promoting investment, joint ventures, licensing agreements and other forms of cooperation between them.

ARTICLE 2

1. The cooperation provided for in Article 1, shall-comprise, inter alia, the following sectors:

a) industry, in particular, ship building, ship repairing, aerospace, environment protection technologies, renewable sources of energy, construction and housing;

b) agriculture, including agro-industry and forestry development; and

c) services, in particular, transport, including maritime transport, banking, insurance and other financial services, tourism, vocational and management training and other service activities of mutual interest.

2. The Parties shall hold regular consultations in order to identify priority cooperation areas as well as new sectors of economic, scientific and technological cooperation.

ARTICLE 3

1. The economic cooperation provided for in this Agreement shall be carried out, mainly, through agreements and contracts between Brazilian and Greek enterprises, organisations and firms, in accordance with the legislation of each Party.

2. The implementation of the scientific and technological cooperation under this Agreement shall be done in accordance with programs, projects and activities agreed upon and defined, where appropriate, through Complementary Agreements.

3. In implementing this Agreement, the Parties shall endeavor to create favourable conditions for economic cooperation and for the development of innovative products and services, in particular, by:

a) developing a favourable environment for investment;

b) stimulating research in the private sector;

c) facilitating the exchange of commercial and economic information;

d) facilitating the exchanges and contacts between their economic operators;

e) facilitating the organisation of fairs, exhibitions and symposia; and

f) encouraging trade promotion activities.

ARTICLE 4

1. The Parties shall encourage and facilitate, on the basis of mutual benefit and common interest, exchanges and scientific cooperation in the fields of Research, Technology, Innovation and Development, as well as provide appropriate opportunities for partnerships between scientific institutions and organisations, research institutes, universities, technological incubators and other institutions of higher education, other entities of the public and private sectors, scholars, researchers and specialists of the two countries. The Parties shall also encourage joint activities in specialised areas and topics of common interest.

2. In order to develop and expand scientific cooperation, the Parties shall facilitate:

a) visits, study-trips and consultations of researchers, scientists and other specialists;

b) the joint elaboration and implementation of research and innovation programs, projects and exchange of the results thereof;

c) the organization of joint courses, conferences and symposia;

d) the exchange of audiovisual material of scientific nature;

e) the organization of scientific exhibitions and displays, particularly with a focus on innovation; and

f) the exchange of scientific literature, documentation and information.

ARTICLES

1. A Joint Committee is hereby established, with the aim of ensuring the implementation of this Agreement.

2. The Joint Committee shall be composed of representatives of the Parties and shall meet, at the request of either Party, in each of the two countries alternately, at a time to be mutually agreed upon, through diplomatic channels. Each meeting shall be presided by the Head of the Delegation of the host country.

3. The Joint Committee shall review the progress made towards achieving the objectives of this Agreement and, if necessary, formulate recommendations for its implementation to the Parties.

ARTICLE 6

Any dispute arising from the interpretation or implementation of the present Agreement shall be settled amicably by the Parties by direct consultations through diplomatic channels.

ARTICLE 7

1. This Agreement shall enter into force thirty (30) days after the date of the last written notification by which the Parties inform each other, through diplomatic channels, that their respective internal requirements for the entry into force of this Agreement have been fulfilled.

2. This Agreement shall remain in force for a period of five (5) years from the date of its entry into force and shall thereafter be tacitly renewed for consecutive periods of one (1) year, unless either Party notifies the other, in writing and through diplomatic channels, of its intention to terminate this Agreement six -(6) months prior to the expiration of its initial or any subsequent period of duration.

3. The termination of this Agreement shall not affect any unfulfilled obligations arising from agreements and contracts concluded between economic operators of the Parties, or in the framework of scientific and technological cooperation, during its period of validity, unless mutually agreed upon by the Parties.

4. Amendments to this Agreement shall enter into force through the same procedure indicated in the first paragraph of this Article.

Done in duplicate, in Athens on April 3^rd, 2009, each in the Greek, Portuguese, and English languages, all texts being equally authentic. In case of divergence, the English text shall prevail.

Άρθρο δεύτερο

Η ισχύς του νόμου αυτού αρχίζει από τη δημοσίευση του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την ολοκλήρωση των προϋποθέσεων του άρθρου 7 παράγραφος 1 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.
