Κύρωση Συμφωνίας Στρατιωτικής Συνεργασίας μεταξύ του Υπουργείου Εθνικής Άμυνας της Ελληνικής Δημοκρατίας και του Υπουργείου Άμυνας της Δημοκρατίας της Κροατίας.
Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ
Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή: Άρθρο πρώτο
Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η Συμφωνία Στρατιωτικής Συνεργασίας μεταξύ του Υπουργείου Εθνικής Άμυνας της Ελληνικής Δημοκρατίας και του Υπουργείου Άμυνας της Δημοκρατίας της Κροατίας, που υπογράφηκε στην Αθήνα στις 27 Ιουνίου 2000, του οποίου το κείμενο σε πρωτότυπο στην ελληνική και αγγλική γλώσσα έχει ως εξής:

ΚΑΙ
ΤΟΥ ΥΠΟΥΡΓΕΙΟΥ ΑΜΥΝΑΣ ΤΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΤΗΣ ΚΡΟΑΤΙΑΣ
ΠΡΟΟΙΜΙΟ
Το Υπουργείο Εθνικής Άμυνας της Ελληνικής Δημοκρατίας και το Υπουργείο Άμυνας της Δημοκρατίας της Κροατίας, εφεξής επονομαζόμενα: «Τα Μέρη».
Καθοδηγούμενοι από το Άρθρο III των κειμένων της Βιέννης του 1992 σχετικά με τις διαπραγματεύσεις για τα μέτρα οικοδόμησης εμπιστοσύνης και ασφάλειας.
Επιβεβαιώνοντας τις δεσμεύσεις τους στο πλαίσιο του Καταστατικού Χάρτη των Ηνωμένων Εθνών, όπως και των βασικών κειμένων του Οργανισμού για την Ασφάλεια και Συνεργασία στην Ευρώπη, ειδικά όσον αφορά το απαραβίαστο των συνόρων, την εδαφική ακεραιότητα, την μη ανάμιξη στις εσωτερικές υποθέσεις και την ειρηνική επίλυση των διαφορών.
Θεωρώντας αναγκαίο να διευρύνουν και να ενισχύσουν τις σχέσεις μεταξύ των δύο κρατών, των λαών τους και
του στρατιωτικού προσωπικού των Ε.Δ. της Ελλάδας και της Κροατίας.
Αναγνωρίζοντας τη σημασία του διαλόγου για την διατήρηση της ειρήνης, της διεθνούς ασφάλειας και σταθερότητας, των αρχών της εθνικής ασφάλειας, της αμυντικής στρατηγικής και των προγραμμάτων αμυντικής ανάπτυξης.
Το Υπουργείο Εθνικής Αμύνης της Ελληνικής Δημοκρατίας και το Υπουργείο Αμύνης της Δημοκρατίας της Κροατίας επιβεβαιώνουν την επιθυμία τους να συνεργαστούν στον τομέα της άμυνας και για αυτό το σκοπό έχουν συμφωνήσει τα ακόλουθα:
ΚΕΙΜΕΝΟ ΚΑΙ ΥΠΟΓΡΑΦΗ
Η Συμφωνία αυτή θα τεθεί σε ισχύ από την ημερομηνία κατά την οποία τα δύο Μέρη θα ειδοποιήσουν το ένα το άλλο ότι έχουν ολοκληρώσει τις διαδικασίες κύρωσης σύμφωνα με την εσωτερική τους νομοθεσία.
Υπογράφτηκε στην Αθήνα την 27 Ιουνίου 2000 σε δύο πρωτότυπα αντίγραφα, στην Κροατική, Ελληνική και Αγγλική γλώσσα, τα οποία είναι εξ' ίσον αυθεντικά. Σε περίπτωση διαφορών στην ερμηνεία, το κείμενο στην αγγλική γλώσσα θα υπερισχύει.
AGREEMENT ON MILITARY COOPERATION
BETWEEN
THE MINISTRY OF NATIONAL DEFENCE OF THE HELLENIC REPUBLIC AND
THE MINISTRY OF DEFENCE OF THE REPUBLIC OF CROATIA
PREFACE
The Ministry of National Defence of the Hellenic Republic and the Ministry of Defence of the Republic of Croatia, hereinafter referred as "the Parties".
Guided by the Article III of the Vienna Document 1992 concerning negotiations on confidence and security building measures.
Reaffirming their commitments under the Charter of the United Nations, and the basic documents of the Organization for Security and Cooperation in Europe, in particular in respect of the inviolability of borders, territorial integrity, non interference in internal affairs and peaceful settlement of disputes;
Considering it necessary to expand and reinforce partner relations between the two countries, their peoples and military personnel of the AF of Greece and Croatia;
Identifying the importance of dialogue for maintaining peace, international security and stability, principles of national security, defence strategy and defence development programs;

The Ministry of National Defence of the Hellenic Republic and the Ministry of Defence of the Republic of Croatia reaffirm their wish to establish cooperation in the field of defence, and to this end
have agreed on the following:
ARTICLE 1 PURPOSE OF THE AGREEMENT
The purpose of this Agreement is to provide the necessary framework for cooperation between the Parties in the field of defence on matters of mutual interest, within the limits of their competence, established for them by their respective national law.
ARTICLE 2 BASIC PRINCIPLES OF COOPERATION
1. The Parties shall maintain relations on the basis of mutual respect for principles of equality.
2. The Parties shall effect cooperation on the basis of respect for mutual interests.
3. Any differences that may arise in the course of cooperation the present Agreement.
4. The cooperation between the two countries shall be without prejudice to the interests of the armed forces of any third Party.
ARTICLE 3 AREAS OF COOPERATION
1. Development of connections concerning the defence, the strengthening of bilateral cooperation, the implementation of joint programs.
2. Consultations, conferences and meetings on issues of regional security.
3. Exchange of information, and cooperation regarding the experience acquired during the inventions of new military products, and assistance by establishing connections between the national military programs for research and development.
4. Exchange of information and cooperation in military training.
5. Regular exchange of experience on logistics and technical issues.
6. Development of short-term and long-term cooperation programs.
7. Establishment of a continuing cooperation and coordination between naval forces.
8. Cooperation in other areas of mutual interest such as :
a. Peace support operations
b. Crises management
c. Military medicine
d. Special services
e. Military scientific research (theoretical and applied)
f. Armament programs issues - Defence programs issues 9. For the purpose of implementing cooperation in the above mentioned areas, or any other which may be agreed upon, separate agreements or additional protocols may be concluded, which shall be signed by authorized representatives of the Ministries of Defence.
ARTICLE 4 MANNER OF COOPERATION
1. The cooperation between the two Parties -will be implemented in the following ways:
a. official and working visits of delegations headed by high representatives of the Parties
b. exchanges of experience between experts of the Parties relating to their particular fields of activity.
c. arranging of joint educational and research activities.
d. participation of observers in military exercises and joint training in simulation devices.
e. contacts between specialized military institutions and organizations.
f. exchanges of lecturers, and attendance at courses, seminars and conferences, arranged by either Party.
g. contacts between related military institutions.
h. visits of naval vessels in accordance with the legislation in force of the two countries.
i. establishing of joint expert teams, especially for conducting research in the sea.
k. exchanges regarding cultural and sporting events.
2. Areas and ways of cooperation specified by this Agreement may be extended or limited by mutual agreement between the Parties, in accordance with the procedure set forth by Article 10 of the present Agreement.
3. The Parties undertake that information obtained in the course of cooperation shall be safeguarded. For this purpose, they will start preliminary discussions with a view of reaching a covenant concerning protection of confidential information.
ARTICLE 5
OBLIGATIONS IN RESPECT TO SAFEGUARDING CLASSIFIED INFORMATION
1. Personnel having access to protected information obtained under this Agreement shall act in accordance with their respective national regulations concerning protection of confidential information obtained from the other Party in the course of cooperation. Such information shall be used solely for the purposes for which it has been provided or obtained.
2. All information classified as military secret exchanged directly between the Parties, and information of mutual interest obtained in some other way by either Party, shall be protected in accordance with the following principles:
a. The Party receiving information shall not relate information to any third parry without prior consent of the Party providing the information.
b. The Party receiving information shall accord such information the same security classification as the Party providing information and shall take all necessary measures to safeguard it accordingly.
3. Information shall be conveyed through official channels and only authorized personnel shall have access to such information taking
into account that it may be used solely for the purposes of this cooperation.
4. Any copying, transmittal or assignment to a third party, of information, documents, equipment and technology produced in the course of cooperation, either temporary or permanent, shall be subject to prior written consent of the other Party.
ARTICLE 6 JOINT MILITARY COMMISSION
1. For the purposes of implementing the provisions of this Agreement, the Parties have agreed to set up a Joint Military Commission, hereinafter referred to as the "Commission".
2. For the purposes of this Agreement, the Commission shall work out an Annual Plan of Cooperation which shall be signed by representatives authorized by the Ministers of Defence before December 1st of the year preceding the year to which the Plan shall apply.
3. The Parties shall exchange their proposals on the Annual Plan before April 15lh of the year, except of the year when the Agreement is signed.
4. The Annual Plan shall include details on activities and tasks, place and time of the meetings, number of those participating, manner of implementation and other relevant matters.
5. The Parties shall exchange, through their responsible for international cooperation bodies, proposals on the Annual Cooperation Plan with their comments before June Is- of the year preceding the year to which the plan shall apply.
6. Any amendment concerning cooperation shall be decided by the Ministries of Defence and competent bodies of the armed forces .
ARTICLE 7 FINANCIAL ARRANGEMENTS
1. The Parties shall bear the costs for the implementation of this Agreement and of the Annual Plan of Cooperation based on reciprocity.
2. The host Party shall bear the costs of board and lodging, transportation in the countries, provisions at the scene of occurrence, as well as the costs of emergency medical care.
3. The visiting Party shall bear the costs of international transportation and any other costs except as specified before.
4. The host Party shall provide for health care needs as may be required, however the visiting Party shall bear the costs of sick persons' transportation back to their country.
5. The costs of personal, expenditures of the visiting personnel shall be borne by the visiting Party.
ARTICLE 8 SETTLEMENT OF DISPUTES
Any differences concerning the interpretation of the provisions or implementation of this Agreement shall be resolved through consultations within the framework of the Commission.
ARTICLE 9
COMMITMENTS UNDER OTHER INTERNATIONAL
AGREEMENTS
This Agreement shall not affect commitments which the Parties have already undertaken in accord with other international agreements to which they are also a Party.
ARTICLE 10 AMENDMENTS
1. Either Party may propose amendments to this Agreement at any time and they shall begin the consultations within the framework of the Commission, with a view of reaching agreement on proposed amendments.
2. Concerted amendments shall constitute an integral part of
this Agreement and shall become in effect in accordance with the provisions of Article 12 of this Agreement.
ARTICLE 11 DURATION AND TERMINATION
1. This Agreement has been concluded for a term of five (5) years and shall automatically be extended for a periods of one (1) year, unless written notification for termination is given by either Party to the other at least six months before the date of expiry.
2. In case of termination, the Parties shall make every effort to complete unfinished activities and shall begin consultations in order to resolve contentious issues.
ARTICLE 12 TEXT AND SIGNATURE
This Agreement shall become in effect on the date on which both Parties have notified each other that they have fulfilled the ratification process in regard with their respective internal legal procedures.
Signed in Athens on June 27*. 2000, in two original copies, in the Croatian. Greek and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English version shall prevail.

Άρθρο δεύτερο
To Ετήσιο Σχέδιο Συνεργασίας που προβλέπεται στο άρθρο 6 της Συμφωνίας εγκρίνεται με απόφαση του Υπουργού Εθνικής Άμυνας.
Άρθρο τρίτο
Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευσή του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 12 αυτής.
Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.
