ΑΡΘΡΟ 13

Το παρόν Μνημόνιο θα παραμείνει σε ισχύ επί πέντε (5) χρόνια και εφεξής θα ανανεώνεται για μεταγενέστερες πενταετείς περιόδους, εκτός εάν το ένα Συμβαλλόμενο Μέρος γνωστοποιήσει στο άλλο, δια της διπλωματικής οδού, την πρόθεσή του να το τερματίσει, τουλάχιστον έξι (6) μήνες πριν από την ημερομηνία εκπνοής της τρέχουσας περιόδου.

Ο τερματισμός του παρόντος Μνημονίου, ωστόσο, δεν θα επηρεάσει τις μελέτες, προγράμματα και όποιες άλλες πρωτοβουλίες που βρίσκονται σε εξέλιξη, που μπορούν να ολοκληρωθούν πλήρως, εκτός εάν διαφορετικά αποφασιστεί από τα Συμβαλλόμενα Μέρη.

Την ημερομηνία κατά την οποία το παρόν Μνημόνιο θα τεθεί σε ισχύ, η Συμφωνία μεταξύ του Βασιλείου της Ελλάδος και της Ηνωμένης Αραβικής Δημοκρατίας για Συνεργασία σε θέματα Τουρισμού, που υπεγράφη στην Αθήνα στις 23 Ιουλίου 1968 θα τερματιστεί.

Έγινε στο Κάιρο, την 30η Μαΐου 2005, σε δύο πρωτότυπα, το κάθε ένα στην Ελληνική, Αραβική και Αγγλική γλώσσα και τα δύο κείμενα είναι εξ' ίσου αυθεντικά. Σε περίπτωση απόκλισης ως προς την ερμηνεία θα υπερισχύει το Αγγλικό κείμενο.

MEMORANDUM OF

UNDERSTANDING on cooperation in the field of Tourism between

the Government of the Hellenic Republic and

the Government of the Arab Republic of Egypt

The Government of the Hellenic Republic and the Government of the Arab Republic of Egypt, hereinafter referred to as "the Contracting Parties",

Wishing to strengthen the friendly relations between the two countries, as well as to promote co-operation between their tourist Authorities,

Recognizing the importance of tourism in promoting economic development, mutual understanding, goodwill and close relations between peoples,

Taking into account the intention of both States to establish long term and close relations in the field of Tourism on mutually profitable terms,

Agreed on the following:

Article 1

The Contracting Parties, within the framework of this Memorandum and in accordance with their national legislation will promote the development and strengthening of cooperation in the field of tourism between their countries.

Article 2

The Contracting Parties shall endeavour to facilitate tourist traffic between their countries in accordance with their respective laws and regulations and without prejudice to their international obligations and shall encourage the cooperation between their enterprises and organizations operating in the field of Tourism.

Article 3

With the view to making better known to the public of the other Contracting Party their tourist attractions and increasing the bilateral tourist movement the Contracting Parties shall encourage mutual tourist promotion through the exchange of information, publicity and other promotion materials in accordance with their respective laws and regulations. For that purpose they shall also examine the possibility of participating in tourist fairs, exhibitions, seminars and other tourist events held in the territory of the other Contracting Party and of organizing familiarization trips for travel agents, travel journalists and other mass media personnel.

Article 4

The Contracting Parties shall seek to encourage in accordance with the internal legislation in force in each of the two countries, the investments by Greek and Egyptian entrepreneurs as well as joint ventures in their respective tourism sectors.

For this purpose, they will also regularly communicate to each other the incentives for tourist investments provided by their national legislation as well as the possibilities for such investments existing in each of the two countries.

Article 5

The Contracting Parties shall encourage all possible forms of bilateral cooperation, with particular emphasis on the exchange of know-how and practical experience between organizations and institutions of their countries active in the field of Tourism.

Article 6

The Contracting Parties shall exchange the rules and legislations governing tourist professions including those related to hotels and tourist villages classification authorities, tourist profession associations as well as quality control systems in the field of tourism and hotel industry.

Article 7

The Contracting Parties shall exchange information and documentation in the field of vocational training of personnel employed in the tourist sector, create the necessary conditions and consider all possible forms of cooperation in that field including on the job training and exchange of students, instructors and experts of their respective schools of tourist professions and the organization of seminars for tourist officials and professionals.

Article 8

The Contracting Parties shall encourage the cooperation between their travel agencies in order to increase tourist traffic between them and attract tourists and promote travel from third countries.

Article 9

The National Tourism authorities of the two countries shall develop their cooperation within the framework of the World Tourism Organization, as well as of other international organizations of which both are members.

Article 10

Taking into account that Greece is a Member-State of the European Union, the two Parties will explore the possibilities for submitting joint projects, particularly in the field of tourism education and training, in the context of existing community initiatives and programmes.

In applying this Memorandum the Hellenic Republic shall respect its obligations arising from its membership to the European Union.

Article 11

With the aim of implementing this Memorandum through bilateral consultations and through the submission of recommendations to the appropriate Authorities of the two Contracting Parties a Joint Commission shall be convened periodically composed of equal number of authorized representatives of each Contracting Party. The protocols signed at the conclusion of each meeting of the above Joint Commission shall mention specific measures and actions to be taken and common programmes to be set up for the further promotion of the cooperation of the two countries in the field of tourism.

The Commission's meetings shall take place in each of the two countries alternately at a time agreed upon by the Contracting Parties through diplomatic channels.

The Commission's meetings shall be presided over by the Head of the Delegation of the country that hosts the meeting.

Article 12

This Memorandum shall enter into force on the date upon which both Contracting Parties will have notified each other.; through diplomatic channels, of the completion of the legal formalities required in each country for the entry into force of the Memorandum.

Article 13

This Memorandum shall remain in force for five (5) years and shall thereafter be renewed for subsequent five year periods, unless one Contracting Party notifies the other, through diplomatic channels, of its intention to terminate it, at least six (6) months prior to the expiration date of the current period.

The termination of this Memorandum, however, shall not affect the projects, programmes and any other initiatives in execution, that may be fully completed, unless otherwise decided by the Contracting Parties.

On the date this Memorandum enters into force, the Agreement between the Kingdom of Greece and the United Arab Republic on Cooperation on Tourist matters signed in Athens on July 23rd 1968 will be terminated.

Done at Cairo , on the 30 of May, 2005, in two originals, each in the Greek, Arabic and English languages, all texts being equally authentic. In case of divergence of interpretation the English text shall prevail.

Άρθρο δεύτερο

Τα Πρωτόκολλα που καταρτίζονται από τη Μεικτή Επιτροπή του άρθρου 11 του Μνημονίου εγκρίνονται με κοινή πράξη των αρμόδιων κατά περίπτωση Υπουργών.

Άρθρο τρίτο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευσή του στην Εφημερίδα της Κυβερνήσεως και του Μνημονίου που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 12 αυτού.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.

* Η πληρωμή του υπέρ ΤΑΠΕΤ ποσοστού που αντιστοιχεί σε συνδρομές, εισπράττεται και από τις ΔΟΥ.

* Οι συνδρομητές του εξωτερικού έχουν τη δυνατότητα λήψης των δημοσιευμάτων μέσω internet, με την καταβολή των αντίστοιχων ποσών συνδρομής και ΤΑΠΕΤ .

* Οι Νομαρχιακές Αυτοδιοικήσεις, οι Δήμοι, οι Κοινότητες ως και οι επιχειρήσεις αυτών πληρώνουν το μισό χρηματικό ποσό της συνδρομής και ολόκληρο το ποσό υπέρ

του ΤΑΠΕΤ.

* Η συνδρομή ισχύει για ένα ημερολογιακό έτος. Δεν εγγράφονται συνδρομητές για μικρότερο χρονικό διάστημα.

* Η εγγραφή ή ανανέωση της συνδρομής πραγματοποιείται το αργότερο μέχρι την 31ην Δεκεμβρίου κάθε έτους.

* Αντίγραφα διπλοτύπων, ταχυδρομικές επιταγές και χρηματικά γραμμάτια δεν γίνονται δεκτά.
