ΑΡΘΡΟ 5

Η παρούσα Συμφωνία θα τεθεί σε ισχύ την ημερομηνία λήψεως της δευτέρας διακοινώσεως, με την οποία τα Συμβαλλόμενα Μέρη γνωστοποιούν το ένα στο άλλο την ολοκλήρωση των σχετικών εσωτερικών τους διαδικασιών, που αφορούν τη θέση της σε ισχύ.

Η παρούσα Συμφωνία υπεγράφη στη Σόφια, στις i- ^ Απριλίου 2006, σε δύο πρωτότυπα, το καθένα από τα οποία στην Ελληνική, στη Βουλγαρική και την Αγγλική. Όλα τα κείμενα είναι εξίσου αυθεντικά. Σε περίπτωση διαφοράς υπερισχύει το αγγλικό κείμενο.

AGREEMENT BETWEEN THE GOVERNMENT OF THE HELLENIC REPUBLIC AND THE GOVERNMENT OF THE REPUBLIC OF BULGARIA ON THE OPENING OF A NEW BORDER-CROSSING POINT

AND THE CONNECTING ROAD BETWEEN THE TWO COUNTRIES, CONNECTING THE TOWN OF KYPRINOS, IN THE HELLENIC REPUBLIC, WITH THE TOWN OF IVAYLOVGRAD, IN THE REPUBLIC OF BULGARIA

The Government of the Hellenic Republic and the Government of the Republic of Bulgaria, hereinafter referred to as "The Contracting Parties",

Considering the relations of friendship, cooperation and good-neighbourliness between the two States,

Considering the possibilities for further strengthening and

promotion of the mutually advantageous and equitable regional

cooperation between the two States and wishing to create the most favourable conditions for its development,

Considering, as well, the expressed wishes of the local authorities,

have agreed as follows:

ARTICLE 1

The Contracting Parties shall construct and open a new border crossing point of a local character and the road connecting the town of Kyprinos, on the territory of the Hellenic Republic with the town of Ivaylovgrad, on the territory of the Republic of Bulgaria.

This border crossing point will be used for the crossing of persons and private use vehicles.

ARTICLE 2

Each of the Contracting Parties shall build or update within its territory, the appropriate road connecting the town of Kyprinos, on the territory of the Hellenic Republic with the new border crossing point, as well as the town of Ivaylovgrad on the territory of the Republic of

Bulgaria with the new border crossing point. Each of the Contracting Parties shall also construct the remaining necessary infrastructure for the functioning of this border-crossing point.

The exact point of intersection with the border and the exact location of the new border crossing point, as well as its technical parameters shall be specified by a Joint Expert Committee provided for in Article 3 herein.

ARTICLE 3

The Contracting Parties shall establish a Joint Expert Committee, which shall determine the main technical characteristics of the connecting roads, the point of intersection with the border, the location of the new border crossing point, the regime of functioning, the infrastructure, the buildings, as well as all matters of general interest, related to the implementation of the present Agreement. Tins Committee shall be composed of the delegations of the Contracting Parties.

The Contracting Parties will further examine, in the framework of the Joint Expert Committee, the possibility of construction of a joint border station and the settlement of any legal and regulatory issue set by the sharing of these premises.

The Joint Expert Committee shall function and decide in accordance with the instructions issued by the Governments of the two states.

The Joint Expert Committee shall hold its first session within two months from the entry into force of the present Agreement.

ARTICLE 4

Any dispute between the Contracting Parties concerning the interpretation or application of this Agreement between the Contracting Parties shall be resolved by the Joint Expert Committee referred to in Article 3. Where the Joint Expert Committee i^ unable to propose a mutually acceptable settlement within three months, the dispute shall be resolved through negotiations between the two Governments.

ARTICLE 5

This Agreement shall enter into force on the date of receipt of the second notification by which the Contracting Parties inform- each other about the completion of their relevant internal procedures for its entry into force.

This Agreement was signed in Sofia, on April IΗ , 2006 in two originals, each in the Greek, Bulgarian and English languages, all texts being equally authentic. In case of any difference as to the interpretation, the English text shall prevail.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευση του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 5 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.
