ΑΡΘΡΟ 13

ΚΕΙΜΕΝΟ ΚΑΙ ΥΠΟΓΡΑΦΗ

Η παρούσα Συμφωνία θα τεθεί σε ισχύ την ημερομηνία κατά την οποία και τα δυο Μέρη θα έχουν ειδοποιήσει το ένα το άλλο για την ολοκλήρωση των εσωτερικών τους διαδικασιών που απαιτούνται για την ισχύ της παρούσας.

Υπογράφεται στην Αθήνα στις 16 Σεπτεμβρίου 2003, σε δύο πρωτότυπα αντίγραφα, το κάθε ένα στην Ελληνική, Μολδαβική και Αγγλική γλώσσα, όπου όλα τα κείμενα είναι εξίσου αυθεντικά. Σε περίπτωση αποκλίσεων στην ερμηνεία, θα υπερισχύει το Αγγλικό κείμενο.

AGREEMENT

ON MILITARY CO-OPERATION

BETWEEN

THE MINISTRY OF NATIONAL DEFENCE OF THE HELLENIC REPUBLIC

AND

THE MINISTRY OF DEFENCE OF THE REPUBLIC

OF MOLDOVA

The Ministry of National Defence of the Hellenic Republic and the Ministry of Defence of the Republic of Moldova, here forth called "Parties",

Reaffirming their devotion to the aims and principles of the United Nations Charter,

Recalling that the aims and principles of the Paris Charter for a New Europe as well as the signature of the Treaty on Conventional Armed Forces in Europe by the European countries, provides a new dimension to their relations,

Taking into account the commitments undertaken by the conference on Security and Co-operation in Europe to promote a larger openness and transparency of their rnilitary activities and to strengthen the security by means of Confidence and Security Building Measures,

Aiming to implement in their bilateral relations other Confidence and Security Building Measures, in addition to the Vienna Document of Negotiations on Confidence and Security Building Measures adopted in 1994,

Emphasising their intention to promote the existing relations on the basis of friendship and co-operation.

Have agreed the following:

ARTICLE 1 PURPOSE OF THE AGREEMENT

The purpose of this Agreement is to establish the Co-operation between the Ministry of National Defence of the Hellenic Republic and the Ministry of Defence of the Republic of Moldova in the Military field within the limits of their competencies, stipulated by their national legislation.

ARTICLE 2

THE FIELDS OF MILITARY CO-OPERATION

The Military Co-operation between the two Parties will be accomplished in the following fields:

Armament programs issues - Defence Industry.

Activities in the PfP framework.

Peace support operations.

Crisis management.

Defence and Military legislation.

Military aspects of arms control and disarmament.

Organizational structure of Armed Forces.

Selection, education and training of military and civil personnel.

Education of the reserves.

Economic accounting system of the Armed Forces (budget, procurement). Military medicine.

Topo-geodesy and hydro graphic services responsibilities. Military history, military publications and military museums Logistics-supplies

Cultural and sports activities in the Armed Forces. Military scientific research.

Military justice and military legislation matters related to International Law.

The activities mentioned in the Agreement can be extended or limited by mutual Agreement between the Parties, under the form of an additional Protocol, which shall enter into force in accordance with the provisions of Article 13.

In order to implement the co-operation in certain fields, mentioned above, additional agreements or protocols for implementation could be concluded, containing the details concerning the respective issues.

ARTICLE 3

MEANS FOR IMPLEMENTING CO-OPERATION

The cooperation between the Parties will be implemented in the following means:

Official and working visits of delegations, headed by high level representatives of the Parties,

Exchange of experience between experts of the Parties in various fields of

activities.

Contacts between similar military institutions.

Mutual invitations to the exhibits of the equipment, armaments and military exercises.

Contacts of lecturers and students between educational military institutes as well as teaching material.

Attendance of courses, seminars and symposiums. Exchange of documentary materials and studies. Cultural and sports activities.

ARTICLE 4

OBLIGATIONS OF THE PARTIES ON THE PROTECTION OF MILITARY INFORMATION

The rnilitary personnel will comply with the regulations of each Party concerning the protection of secret classified information obtained from the other Party within the co-operation framework.

All rnilitary secret classified information directly communicated between the Parties and the information of common interest obtained through other ways by each Party will be protected in accordance with the following principles :

The Party, which receives the information, will not communicate it to a third state without prior approval of the Party providing the information.

The Party, which receives the information will provide the same classification as the one given by the providing Party and consequently, will observe the necessary security measures.

The information will be used only for the purpose it was provided or

obtained.

The rights for patents, intellectual property or commercial secrets in the military field will be duly observed.

This information will be provided through official channels. Only authorised personnel will have access to it and will use it for military cooperation purposes only.

ARTICLE 5 JOINT COMMISSION

To further the objectives and the implementation of the provisions of this Agreement, the Parties hereby establish the Joint Co-operation Commission between the Ministry of National Defence of the Hellenic Republic and the Ministry of Defence of the Republic of Moldova (hereinafter referred as "The Commission"). The ^Commission, which will be consisted of equal number of persons of each Party, will convene once a year, in the Republic of Moldova and in the Hellenic Republic alternatively and the dates of these annual meetings will be fixed by mutual agreement between the Parties. The session of Commission will be chaired by the chief of the host country delegation.

The Parties agree, that the Commission's agenda will include the fields of cooperation of this Agreement

Those fields of activities which are to be included in the Commission's agenda, shall be defined and mutually agreed at least three (3) months before the date of Commission's meeting.

In their capacity as members of the Commission, the Military Attaches shall be 'involved in preparing and carrying out the activities which are to be developed in accordance with the provisions of this Agreement.

ARTICLE 6 PLANNING OF THE CO-OPERATION

Under the provisions of this Agreement, the Parties undertake the commitment to provide an annual Co-operation Program

This Co-operation Program will be signed by the Chief of Staff of the Hellenic National Defence General Staff and the Chief of the Main Staff of the National Army of the Republic of Moldova or by their authorised representatives no later than December 1* of the year before the implementation of the program

The presentation of the above program shall be completed by November 15 of the year before the implementation of the program after consultations between the members of the Commission.

The co-operation program will include:

Activities.

Duration and period of Activities. Place of Activities.

Number of participants and institutions involved.

ARTICLE 7 FINANCIAL ASPECTS

All expenses for the military personnel which is involved in co-operation missions according to the provisions of this Agreement will be covered on the basis of reciprocity, as follows:

The Receiving State will provide accommodation and food, transportation on its own territory, as well as medical services in emergency cases.

The Sending State will bear the transportation expenses, as well as the expenses which are not mentioned above.

ARTICLE 8 LEGAL ISSUES

All legal issues arising out of the implementation of this Agreement will be settled according to the Agreement Among the State Parties to the North Atlantic Treaty and the Other States Participating in the Partnership for Peace regarding the Status of their Forces.

ARTICLE 9 SETTLEMENT OF DISPUTES

Any dispute arising from the interpretation or the implementation of this Agreement and not failing within the scope of the Agreement Among the State Parties to the North Atlantic Treaty and the Other States Participating in the Partnership for Peace regarding the Status of their Forces, will be resolved amicably and expeditiously

by consultation and negotiation between the Parties and will not be referred to any third party or tribunal for settlement.

ARTICLE 10

COMMITMENTS OF THE PARTIES FROM OTHER INTERNATIONAL AGREEMENTS

This Agreement shall not influence the conimitments undertaken by each of the Parties in accordance with other international agreements and will not affect the security and territorial integrity of other states.

ARTICLE 11 AMENDMENTS AND REVISION

The terms of this Agreement may be amended by mutual consent at any time at the request of either Party. Any such amendments shall enter into force according to the procedure set forth in article 13 and shall constitute an integral Party of this Agreement

ARTICLE 12 DURATION AND TERMINATION OF VALIDITY

This agreement shall remain in force for a period of five (5) years and will be automatically renewed for successive periods of one (1) year. This present Agreement can be terminated by one of the parties through written notification of its intention to terminate the Agreement. The termination will enter into Force after three (3) months after receiving the mentioned notification.

ARTICLE 13 TEXT AND SIGNATURE

The present Agreement shall enter into force on the date both Parties have notified each other about the completion of their internal procedures required for its entry into force.

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευσή του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 13 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.

Για την παροχή δικαιώματος ηλεκτρονικής πρόσβασης σε Φ.Ε.Κ. προηγούμενων ετών, η τιμή προσαυξάνεται πέραν του ποσού της ετήσιας συνδρομής έτους 2004, κατά 25 euro ανά έτος παλαιότητας και ανά τεύχος.

* Οι συνδρομές του εσωτερικού προπληρώνονται στις ΔΟΥ (το ποσό συνδρομής καταβάλλεται στον κωδικό αριθμό εσόδων ΚΑΕ 2531 και το ποσό υπέρ ΤΑΠΕΤ (5% του ποσού της συνδρομής) στον κωδικό αριθμό εσόδων ΚΑΕ 3512).Το πρωτότυπο αποδεικτικό είσπραξης (διπλότυπο) θα πρέπει να αποστέλλεται ή να κατατίθεται στην αρμόδια Υπηρεσία του Εθνικού Τυπογραφείου.

* Η πληρωμή του υπέρ ΤΑΠΕΤ ποσοστού που αντιστοιχεί σε συνδρομές, εισπράττεται και από τις ΔΟΥ.

* Οι συνδρομητές του εξωτερικού έχουν τη δυνατότητα λήψης των δημοσιευμάτων μέσω internet, με την καταβολή των αντίστοιχων ποσών συνδρομής και ΤαπΕτ .

* Οι Νομαρχιακές Αυτοδιοικήσεις, οι Δήμοι, οι Κοινότητες ως και οι επιχειρήσεις αυτών πληρώνουν το μισό χρηματικό ποσό της συνδρομής και ολόκληρο το ποσό υπέρ του ΤΑΠΕΤ.

* Η συνδρομή ισχύει για ένα ημερολογιακό έτος. Δεν εγγράφονται συνδρομητές για μικρότερο χρονικό διάστημα.

* Η εγγραφή ή ανανέωση της συνδρομής πραγματοποιείται το αργότερο μέχρι την 31ην Δεκεμβρίου κάθε έτους.

* Αντίγραφα διπλοτύπων, ταχυδρομικές επιταγές και χρηματικά γραμμάτια δεν γίνονται δεκτά.

Οι υπηρεσίες εξυπηρέτησης των πολιτών λειτουργούν καθημερινά από 08.00' έως 13.00'
