ΑΡΘΡΟ 9

ΔΙΑΡΚΕΙΑ - ΛΗΞΗ

Το παρόν Πρωτόκολλο θα παραμείνει σε ισχύ για μία περίοδο πέντε (5) ετών. Δύναται να καταγγελθεί οποιαδήποτε στιγμή από οποιοδήποτε Μέρος, μέσω γραπτής ειδοποίησης, που θα αποσταλεί στο άλλο Μέρος μέσω της διπλωματικής οδού.

Σε περίπτωση που κατά τον χρόνο της λήξης ή λύσης εκκρεμούν οικονομικά ζητήματα ή αξιώσεις, οι διατάξεις του παρόντος Πρωτοκόλλου που αφορούν τα συγκεκριμένα θέματα ή τις αξιώσεις θα εξακολουθούν να ισχύουν, μέχρι την οριστική επίλυσή τους.

Υπογράφεται στα Τίρανα την 8 Ιουλίου 2004 σε δύο πρωτότυπα αντίγραφα, κάθε ένα στην Ελληνική, Αλβανική και Αγγλική γλώσσα, όπου όλα τα κείμενα είναι εξίσου αυθεντικά. Σε περίπτωση αποκλίσεων στην ερμηνεία, θα υπερισχύει το Αγγλικό κείμενο.

PROTOCOL OF COOPERATION BETWEEN THE MINISTRY OF NATIONAL DEFENCE OF THE HELLENIC REPUBLIC AND

THE MINISTRY OF DEFENCE OF THE REPUBLIC OF ALBANIA FOR

The Ministry of National Defence of the Hellenic Republic hereinafter referred to as "The Hellenic Party" and the Ministry of Defence of the Republic of Albania, hereinafter referred to as "The Albanian Party", both Parties collectively hereinafter referred to as The Parties".

Confirming their devotion to the aims and principles of the charter of United Nations,

Respecting the commitments adopted according to the Final Act of Conference tor Security and Ccoperation in Europe, of Paris Charter and the Vienna Text of 1994, as well as other texts of OSCE,

Respecting the commitments arising under the PfP SOFA and the Additional Protocol signed in Brussels, on June 19, 1995,

Pursuing to apply their bipartite relationships, according to the text of negotiations on Building Measures of Trust and Security which was adopted in Vienna, on 1994; and introduce further measures of trust and security_r

Taking into ccrisideration the Armed Forces Assistance and Cooperation Protocol between the Ministries of Defence of the two countries, signed in Tirana on August 5,1997,

Having in mind the Treaty of Friendship, Cooperation, Good Neighborhood and Security between the Government of the Hellenic Republic and the Government of the Republic of Albania signed in Tirana on March 21, 1996

Taking into consideration the Agreement on Military Ccoperation between the Government of the Hellenic Republic and the'Government of the Republic of Albanian signed in Kastoria on November 10, 2003,

Desiring to further promote their bilateral cooperation.

Have agreed as follows:

ΦΕΚ 69

ARTICLE 1 PURPOSE OF THE AGREEMENT

The purpose of the present Protocol is to identify the fields and the mutual obligations, undertaken by the Parties for the development of a wider cooperation between the Engineer Corps of the Hellenic and Albanian Army.

ARTICLE 2 FIELDS OF COOPERATION

The Parties agree to cooperate in harmony for the development of the relations of the Engineer Corps of their Armies to the following general fields:

1. Offer of a set of a Bailey Bridge from the Hellenic Party to the Albanian Party.

2. Assignment of military personnel (officers, noncommissioned officers) of the Albanian Party to the Hellenic Party for specialized training in the Engineering Schooi of the Hellenic Army.

3. Conducting of Combined Engineering Exercise in Albania

ARTICLE 3

DEFINITION OF OBLIGATIONS IN EACH FIELD OF COOPERATION

For the implementation of the cooperation in the fields of the above-mentioned article of the present Protocol, the Parties agree to the blowing:

1. Field of grantinq-g set of a Bailev Bridge

The Hellenic Party will offer to the Albanian Party a set of a Bailey Bridge. The above-mentioned Bridge will be fully operational and delivered according to the handover protocol during a ceremony. The exact delivery date and place will be defined by the two Parties, after consultations through the Defense Attache of the Hellenic Embassy in Tirana, after the entry into force of the present Protocol of Cooperation in accordance with the procedure set forth in article 8.

2. Field of Training of Military Personnel of the Albanian Party bv the Hellenic Party

a. The training which will be provided to the personnel of the Albanian Party by the Hellenic Party in the Engineer School of the Hellenic Army, will include the following courses:

(Ό Basic training of the officers graduating from the Military Academy and the Non-Commissioned Officers School of Land Forces

For the basic training of the students of the Albanian Party who will graduate by the Military Academy and the Non-Commissioned Officers School of the Hellenic Party and belong to the Engineer Corps, the provisions of the relevant agreement shall apply. The duration of the training will be 38 weeks. The number of the participants every year and in every course is one or two (1-2) officers and two (2) NCO's for every training course.

(2) Advanced training Course for Officers

The duration of the training of the Albanian Officers in the Advanced Military Course of the Engineer School of the Hellenic Army will be 12 weeks. The number of the courses are two per year. The participants should be Captains of the Engineer Units. The participation in each course is one (1) officer. The purpose of the training is to prepare the Engineer Officers for the duties of the Commander Battalion.

(3) Training Course for Non Commission Officer's (Non graduates of the Non Commission Officer's School¹}

The duration of the training of the Albanian NCO's (Non graduates from the NCO 's School) in the relevant training course of the Engineer School will be four (4) weeks. The number of the courses are two per year. The participants will be Sergeant and Staff Sergeant of Engineer Units. The participation in each course is one (1) officer. The purpose of the training is to provide to the NCO's general knowledge for the Engineer Units.

b. As a necessary prerequisite of participation in all the training courses, candidates should have a knowledge of the Hellenic language up to a level of 'Very good " (70%) and higher. This will be certified by the competent Albanian authorities prior to the candidates' arrival in Greece.

cr "The~selected -from - the Albanian -Party- .officers ..-JSCOls; 1 shop Id be healthy- and have a health , certificate issued by the competent authorities of the Albanian Ministry of Defence, duly legalized, which will be translated by the Embassy of the Hellenic Republic in Albania.

d. After their graduation they will be granted an official education certification by the Engineer School.

e. In May of each year the Hellenic Party will communicate to the Albanian Party the Training Program of the Engineer School for the next year.

f. At least one month before the beginning of the training, the Albanian Party has to fill in the number of the candidates and their certificates about their competence of ihe Hellenic language in cooperation with the Hellenic Embassy in Tirana. The Hellenic Party must be informed in written form about the identification of the candidates, the place and date of am'vai to Greece, in order for the responsible Military Authorities of the Hellenic Party to be able to receive the Trainees and to submit them to the Engineer Schooi.

g. The Hellenic Party will provide accommodation and meals to the training personnel of the Albanian Party in proper place of the Engineer School.

h. The Albanian trainees will receive on a daily basis the sum of nine euros and sixty eight cents (9,68) for the officers and a sum of 7 euros and thirty four cents (7,34) for the NCO's .This sum will be adapted according to the order of the Hellenic National Defense General Staff.

i. The Hellenic Party will provide all the required training staff, as well as the training means.

ia. The transportation cost of the Albanian trainees from and to their country will be covered by the Albanian Party.

ib. The Albanian trainees must comply with the effectual Regulation of the Engineer School, as well as, the security regulations, discipline and penalties, such as the Greek trainees.

jc. The Commander of the Engineer School has the right to issue orders regarding the function of the school to all his subordinates, as well as to all the trainees.

id. The Commander of Engineer school may grant short or longer leaves to the Albanian trainees, this will permitted under the training program. In urgent cases he can furlough further leaves only after written notification by the Albanian Party.

ie. The trainees during the training must be dressed in field uniforms or uniform in accordance with the course program.

if. The regulations concerning the duration of the training period, the number of training courses every year and the maximum number of Albanian participants in each course can be amended at any time by the Hellenic Party, which jnjun^ Albanian Party at least six (6) months before thevalidation-blthenew

3. Conducting of Combined Engineering Exercise in Albania

a. The Hellenic and Albania Party will conduct in the future, in Albania, a Combined Engineering Exercise for a specific project (road construction).

b. The goals, objectives, timing, duration, logistics support, customs formalities of entrance and exit from Albania, the execution of the work, Host Nation Support, etc, for this exercise wiil be defined through the conclusion of a special Technical Agreement between the partes which will be effective only for the execution of the definite Combined Engineering Exercise.

c. The Technical Agreement wili be the product of cooperation of the qualified representatives of the Parties before the execution of the definite work, the completion of the elaboration of further deiails and the compilation of the final text. This will provide sufficient time for the finaiization and the preparations of the Parties.

ARTICLE* LEGAL ISSUES

The legal issues pertaining to the personnel of the Hellenic Party during their stay in Albanian territory and to the personnel of the Albanian Party during their stay in Hellenic territory according to the present Protocol shall be governed by the PfP/SOFA/NATO (Agreement among the North Atlantic Treaty Member States and the other states participating in the Partnership for Peace regarding the legal status of their armed forces), and the additional protocol to the Agreement

ARTICLE 5

PROTECTION OF CLASSIFIED INFORMATION

The Parties guarantee the security of information and data acquired in the framework of bilateral contacts, including, any confidential information, and undertake the obligation not to make use thereof without the prior consent' in" 'writing of the Party offering such information and not to disclose said information to any third party.

The oral and written information and data acquired in the framework of bilateral contacts are safeguarded according to each party's internal legislation and must not be disclosed to the mass media.

ARTICLE 6 SETTLEMENT OF DISPUTES

Any- disputes which may arise from the interpretation or implementation of the present Protocol will be settled directly between the Parties by way of mutual consultations, without recourse to outside jurisdiction.

ARTICLE 7 AMENDMENTS

The Parties have the right to propose written amendments to any article of this protocol.

if agreed by the Parties such amendments shall enter into force in accordance with the procedure set forth in article 8 of the present Protocol.

ARTICLE 8 ENTRY INTO FORCE

The present Protocol of cooperation shali enier into force on the date of the receiving of the last notification whereby the Parties notify each other_; in written form that the necessary requirements of their internal legislation have been fulfilled.

ARTICLE 9 DURATION - TERXBNATK3N

This Protocol shall remain in force for a period of five (5) years. It may be denounced at any time by either Party, through a written notification, which will be sent to the other Party through diplomatic channels.

In case there are financial issues or claims which remain unresolved at the time of termination, the provisions of the present Protocol which are related to those issues or claims shall apply, until the specific issues are definitely settled.

Signed in Tirana on July 8, 2004 in two original copies, each in the Hellenic, Albanian and English language, all texts being equally authentic. In case of divergence of the interpretation the English text shall prevail.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευσή του στην Εφημερίδα της Κυβερνήσεως και του Πρωτοκόλλου που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 8 αυτού.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.

* Οι συνδρομές του εσωτερικού προπληρώνονται στις ΔΟΥ (το ποσό συνδρομής καταβάλλεται στον κωδικό αριθμό εσόδων ΚΑΕ 2531 και το ποσό υπέρ ΤΑΠΕΤ (5% του ποσού της συνδρομής) στον κωδικό αριθμό εσόδων ΚΑΕ 3512).Το πρωτότυπο αποδεικτικό είσπραξης (διπλότυπο) θα πρέπει να αποστέλλεται ή να κατατίθεται στην αρμόδια Υπηρεσία του Εθνικού Τυπογραφείου.

* Η πληρωμή του υπέρ ΤΑΠΕΤ ποσοστού που αντιστοιχεί σε συνδρομές, εισπράττεται και από τις ΔΟΥ.

* Οι συνδρομητές του εξωτερικού έχουν τη δυνατότητα λήψης των δημοσιευμάτων μέσω internet, με την καταβολή των αντίστοιχων ποσών συνδρομής και ΤΑΠΕτ .

* Οι Νομαρχιακές Αυτοδιοικήσεις, οι Δήμοι, οι Κοινότητες ως και οι επιχειρήσεις αυτών πληρώνουν το μισό χρηματικό ποσό της συνδρομής και ολόκληρο το ποσό υπέρ του ΤΑΠΕΤ.

* Η συνδρομή ισχύει για ένα ημερολογιακό έτος. Δεν εγγράφονται συνδρομητές για μικρότερο χρονικό διάστημα.

* Η εγγραφή ή ανανέωση της συνδρομής πραγματοποιείται το αργότερο μέχρι την 31ην Δεκεμβρίου κάθε έτους.

* Αντίγραφα διπλοτύπων, ταχυδρομικές επιταγές και χρηματικά γραμμάτια δεν γίνονται δεκτά._

Οι υπηρεσίες εξυπηρέτησης των πολιτών λειτουργούν καθημερινά από 08.00' έως 13.00'
