Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ

Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή:

Άρθρο πρώτο

Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η Συμφωνία μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Δημοκρατίας του Λιβάνου επί των διεθνών οδικών μεταφορών επιβατών και εμπορευμάτων που υπογράφηκε στη

Βηρυτό στις 21 Ιανουαρίου 2004, όπως συμπληρώθηκε με την ανταλλαγή των υπ' αριθμ. 584/2004 από 6.7.2004 και F.3144.2/8/AS 725 από 9.8.2004 ρηματικών διακοινώσεων της Πρεσβείας του Λιβάνου στην Αθήνα και του Υπουργείου Εξωτερικών της Ελληνικής Δημοκρατίας αντίστοιχα, των οποίων το κείμενο σε πρωτότυπο στην ελληνική και αγγλική γλώσσα έχει ως εξής:

ΜΕΤΑΞΥ ΤΗΣ ΚΥΒΕΡΝΗΣΗΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΚΑΙ ΤΗΣ ΚΥΒΕΡΝΗΣΗΣ ΤΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΤΟΥ ΛΙΒΑΝΟΥ ΕΠΙ ΤΩΝ ΔΙΕΘΝΩΝ ΟΔΙΚΩΝ ΜΕΤΑΦΟΡΩΝ ΕΠΙΒΑΤΩΝ ΚΑΙ ΕΜΠΟΡΕΥΜΑΤΩΝ

Η Κυβέρνηση της Ελληνικής Δημοκρατίας και η Κυβέρνηση της Δημοκρατίας του Λιβάνου οι οποίες κατωτέρω χάριν συντομίας αναφέρονται ως «Συμβαλλόμενα Μέρη»,

Επιθυμώντας να συνεισφέρουν στην ανάπτυξη των εμπορικών και οικονομικών σχέσεων και να ενισχύσουν τις φιλικές σχέσεις που υφίστανται μεταξύ των δύο χωρών,

Έχοντας ως σκοπό την ανάπτυξη και την διευκόλυνση των διεθνών οδικών μεταφορών επιβατών και εμπορευμάτων από και προς τις χώρες τους καθώς και κατά την διέλευση μέσω των εδαφικών τους περιοχών και επίσης να δημιουργήσουν σχέσεις διαρκείας βασιζόμενες στις αρχές της αμοιβαιότητας, της μη διακριτικής και του αμοιβαίου οφέλους,

Συνεφώνησαν τα ακόλουθα:

ΜΕΡΟΣ

ΓΕΝΙΚΕΣ ΔΙΑΤΑΞΕΙΣ

Άρθρο 19

Έναρξη Ισχύος και διάρκεια της Συμφωνίας

1. Η παρούσα Συμφωνία θα ισχύσει 30 ημέρες μετά την ημερομηνία λήψεως της δευτέρας γνωστοποιήσεως μέσω της διπλωματικής οδού, δια της οποίας οι Συμβαλλόμενοι θα πληροφορούν ο ένας τον άλλον ότι οι εσωτερικές κρατικές τους διαδικασίες που απαιτούνται για την θέση σε ισχύ της παρούσας Συμφωνίας έχουν ολοκληρωθεί.

2. Η παρούσα Συμφωνία θα παραμείνει σε ισχύ για περίοδο ενός έτους μετά την ημερομηνία ενάρξεως ισχύος της και αυτοδικαίως θα ανανεώνεται για ετήσιες περιόδους εκτός εάν οποιοδήποτε Συμβαλλόμενο Μέρος εκφράσει την επιθυμία του, εγγράφως, προς το έτερο Συμβαλλόμενο Μέρος να καταγγελθεί η Συμφωνία τρεις μήνες το ελάχιστο προ της ημερομηνίας λήξεως.

Το παρόν συνήφθη σε δύο πρωτότυπα αντίτυπα συντεταγμένα το καθένα στην Αραβική, την Ελληνική και την Αγγλική γλώσσα, όλα δε τα κείμενα είναι εξ ίσου αυθεντικά.

Σε περίπτωση αποκλίσεων ως προς την ερμηνεία, υπερισχύει το Αγγλικό κείμενο.

AGREEMENT

BETWEEN THE GOVERNMENT OF THE HELLENIC REPUBLIC AND THE GOVERNMENT OF THE REPUBLIC OF LEBANON ON INTERNATIONAL TRANSPORT OF PASSENGERS AND GOODS BY ROhO

The Government of the Hellenic Republic and the Government of the Republic of Lebanon,

Hereinafter referred to as "Contracting Parties",

Desiring to contribute to the development of trade and economic relations and to strengthen the friendly relations existing between the two countries,

Aiming at developing and facilitating the international transportation of passenger and goods by road to and from their countries as well as in transit through their territories and to establish lasting relations based on reciprocity, non-discrimination treatment and mutual benefits,

Have agreed as follows:

PARTI GENERAL PROVISIONS Article 1 Scope

1. The provisions of this Agreement shall apply to the international transportation of passenger and goods by road, from or to the territory of one of the Contracting Parties and in transit through the territory of the other Contracting Party, by using vehicles registered in the territory of one of the Contracting Parties.

2, The present Agreement does not affect the rights and obligations arising from the other international commitments of the two parties, nor does it affect the legislation of both countries and the agreements between one. of the Contracting

Article 2 Definitions

For the purpose of this Agreement:

1. 'Transport Operator" or "carrier" means any natural person, any legal person, or joint venture, registered in the territory of one of the Contracting Parties, which transports passengers or goods for which it is paid, in accordance with the requirements of the national legislation regulating the access to the occupation of transport operator and to the market.

2. 'Vehicle" means a motor vehicle:

- on its own or α combination of vehicles, registered in the territory of one of the Contracting Parties;

- intended for the carriage of passengers or goods by road,

- at the disposal of the transport operator through being its own property or through α hiring or leasing contract.

3. "Registration" means the allocation of an identification number to the vehicle by α competent authority. In the case of α combination of vehicles, the motor vehicle is the determining factor in permit issue or exemption.

4. "Transport" means the runs by α vehicle, either laden or unladen even if the vehicle, trailer or serni trailer is carried by train or boat for part of the journey.

5. "Cabotage" means the transport operations on the territory of the Contracting Party, the host country, with the loading and unloading points being located on that territory, of α transport operator established on the territory of the other Contracting Party.

6. "Transport on own account" means passenger and goods transport intended solely for or stemming from its own economic activity or serving its own employees, or is performed by α non-profit organization that transports its members in accordance with its social purposes; that transport is carried out without payment provided that:

- the transport activity is only an auxiliary activity of the enterprise or the organization;

- the vehicles used are owned by the enterprise or the organization; they τ$&Λψ&^ or obtained by means of a long-term contract or by means of leasing;i$j$£^^s<£ operated by a driver who is part of the staff of the enterprise or the orfi^|a^n7S*

7."Multimodal transport" means the transport of goods whereby the lorry, trailer, sS/mi-trailer, swap body or container, with or without tractor, use the road for the

initial or terminal leg of the journey and travel by rail, waterway, sea or air for the other leg, "*·'

8. "Territory of α Contracting Party" means respectively the territory of the Republic of Libanon and the territory of the Hellenic Republic.

9. * "Country of establishment" means the territory of a Contracting Party within which the transport operator is established and the vehicle registered.

10. "Host country" means the territory of a Contracting Party in which the vehicle is operating without being registered there and without the transport operator being established there.

11. "Bus" and "Coach" mean vehicles which are purpose built and designed for the transport of persons which has, in addition to the driver's seat, more than eight sitting places.

12. "Hire car" means a vehicle registered in one the Contracting Parties, which is built and designed to carry up to nine people and their luggage, including the driver, and is used for paid transport for account of a third party.

13. "Regular passenger service" means a service, which carries passengers over a specified route, according to a timetable and for which set fares are charged. Passengers are picked up or set down at predetermined stopping points and the service is accessible to everyone notwithstanding, in some cases, the need to book.

Mo matter who is organizing the service, the term "regular passenger service" includes also a service which carries specified categories of passengers to the exclusion of other categories of passengers in case that this service meets the above criteria. This service is called "special regular service".

14. "Shuttle service'' means a service whereby, by means of repeated outward and return journeys, previously formed groups of passengers are carried^ place of departure to a single place of destination. Each group, passengers who made the outward journey, is carried back to the pK^fMSpartur^ on one of the next later journeys. Place of departure and destinaoi

\jjrtjsan the place where the journey begins and the place where the journey ends, together with the surrounding locality within a 50 km radius.

The first return journey and the last outward journey in a series of shuttles are made unladen.

The definition of a service as a shuttle service is not influenced by the fact that some of the passengers join another group on their return journey.

A shuttle service which provides accommodation for at least 80 per cent of passengers at destination and, if need be, during the journey, with or without meals, is called a "shuttle with accommodation".

15. "Occasional service" means a service falling neither within the definition of a regular passenger service nor within the definition of a shuttle service.

16. "Control document" means the waybill for buses and coaches, the form of which is agreed upon and confirmed by the Joint Committee referred to in Article 17.

Ρ A R Τ II PASSENGER TRANSPORT Article 3 Regular passenger services

1. Regular passenger services operated by bus or coach are subject to a system of authorisations issued by the competent authorities in the country of departure, destination and transit.

2. The authorisation application should be made to the competent authority in the country of establishment of the transport operator. If the authority approves the application, the authorisation is communicated to the competent authority of the other Contracting Party. If there is no reciprocity, an authorisation forjjjgtfateral regular service may be refused. /fv^a ΪΤ ""\\

The Joint 'Committee set up under Article 17 hereof decides o^w/j^^^N^k authorisation; the procedure and the supporting documents requir|a^^n""

^Authorisations are issued by joint agreement by the competent authorities of the Contracting Parties.

The decision to grant or refuse an authorisation is taken within a period of three months unless there are special circumstances.

4. Changes in operating conditions and the cancellation of the service are decided under the procedure set out in item 2 and 3. If there is no longer any demand for the service, the operator can cancel it giving a four-week prior notice to the competent authorities who issued the authorisation and to customers.

5. If a service is being operated on a sub-contracted basis, an authorisation is issued to the leading firm in which the names of the sub-contractors are mentioned provided that the transport is carried out on behalf of the leading firm.

Article 4

Shuttle services

1. Shuttle services operated by bus or coach with or without accommodation are subject to a system of authorisations issued by the competent authority in the country of departure, destination and transit.

2. The authorisation application should be made to the competent authority in the country of establishment of the transport operator.

The Joint Committee set up under Article 17 decides on the form and the content of the authorisation application, the procedure and the terms of agreement as well as the supporting documents required.

3. The Joint Committee may establish more liberal regime for shuttle services.

Article 5

Occasional services

1. Occasional services operated by bus or coach are subject to a system of authorisations issued by the competent authority in the country j^g^Faf^e, destination or transit. 2. As an exception to item 1, the services listed below are exempted from any authorisation system on the territory of the host country;

2.1 closed-door tours whereby the same vehicle is used to carry the same group of passengers throughout the journey and to bring them back to the place of departure;

2.2 services, which make the outward journey laden and the return journey unladen;

2.3 services which make the outward journey unladen and the return journey laden, provided that passengers:

a) constitute a group formed under a contract of carriage concluded before their arrival in the territory of the Contracting Party, where they are picked up and carried to the territory of the country of establishment;

b) have been previously brought by the same carrier into the territory of the Contracting Party where they are picked up again and carried into the territory of the country of establishment;

c) have been invited to travel into the territory of the country of establishment, the cost of transport being borne by the person issuing the invitation.

3. The occasional services exempted from authorisation requirement and operated using buses or coaches must be covered by a control document. The conditions of use and content of the control document are laid down by the Joint Committee referred to in Article 17 hereof.

Article 6

- Common provisions'to passenger services

1. Transport authorisations are persona! and are not transferable to other transport operators,

2. Authorisations for regular services are granted for a maximum period of three years whereas for shuttle services for a maximum period of one year.

3. The running of cabotage service is prohibited. Local trips organised solely for a group of passengers brought to that location by the same transport operator are not deemed to be cabotage services provided that they are entered on the waybill.

GOODS TRANSPORT

Article 7 Types of transport

1. Transport operators established on the territory of a Contracting Party may carry out international road transport of goods for the account of other persons (natural or legal):

a. between the two Contracting Parties (bilateral)

b. in transit through their territories

c. the point of departure being the territory of the other Contracting Party and the point of destination being a third country, and vice versa (triangular).

2. Bilateral and transit transport for own account is permitted.

3. The running of cabotage services is prohibited.

Article 8 Access to the market

1. Transport referred to In paragraphs la and lb as well as in paragr^Ki? of article, 7 is subject to a system of permits. The number of permits exchange b&rween the'

'/Pities shall be determined annually so as to absolutely satisfy their needs, in full ^cordance with the request of the relevant competent authorities of either Party. 2. The transport referred to in paragraph 1 c of article 7 is subject to a system of special permits, numerically restricted, issued by the Contracting Party from or to which the transport is carried out.

Article 9

Exemptions from permit requirements

1 As an exception to Article 8, the following categories of transport are exempted from permit requirements:

1.1 Transport on an occasional basis, to or from airports, in cases where air services are diverted.

1.2 Transport of vehicles, which are damaged or have broken down and the transport of breakdown repair vehicles.

1.3 Unladen runs by a goods vehicle sent to replace a vehicle, which has broken down in another country, and also the return run, after repair, of the vehicle that had broken down.

1.4 Transport of livestock in special purpose-built or permanently converted vehicles for such kind of transport, and are recognised as such by the competent authorities in the country of establishment.

1.5 Transport of spare parts for ocean and river going ships and aircraft.

1.6 Transport of goods needed for emergencies, more particularly in response to natural disasters and humanitarian needs.

1.7 Transport of works and objects of art for fairs and exhibitions or for noncommercial purposes.

1.8 Transport for non-commercial purposes of properties, accessories and arjjmalsj^ or from theatrical, musical, film, sports or circus performances, and t]^d^s§r3ee^ for radio recordings, or for film or television production.

1.9 First run of unladen, newly purchased motor vehicles.

1440 Funeral transport.

1.11 Transport of-household goods while removed.

1.12 Post transport.

The Joint Committee, referred to in Article 17 hereof, may exempt from permit requirements other types of transportations of separate loads or of all loads along definite destinations.

Article 10 Permit conditions

1. The competent authorities of the two Contracting Parties exchange the agreed number of blank permit forms every year.

Permits are issued to resident transport operators by the competent authority or by a body designated by the said authority.

2. Permits are persona! and are not transferable to third parties.

3. Permits can only be used for one vehicle at a time. The permits shall be valid until 31 January of the successive calendar year. In case of combination of vehicles, the motor vehicle is the determining factor in permit usage or exemption.

4. The Joint Committee referred to in Article 17 hereof determines the number and type of permits in compliance with Article 8, which the Contracting Parties shall exchange each year, as well as any further conditions governing permit issuance.

PART IV COMMON PROVISIONS Article 11 Tolls

Each Contracting Party may impose the payment of tolls or user charge^jr^ted to the use of road infrastructure, in accordance with its national legislatiwt^fthout

^crimination between national operators and operators established in the other Contracting Party.

Article 12 Tax provisions

1. The transport by vehicles registered in the state territory of one of the Contracting Parties, under the terms of this Agreement, is exempted from payment of all taxes related to the ownership, registration and driving of a vehicle.

2. The fuel contained in the normal, by the manufacturer build-in fixed tanks of the vehicle intended to drive the vehicle as well as lubricants and spare parts are exempt from all import clearance in the state territory of the host country.

Article 13 Weights and dimensions

1. The permissible maximum weights and dimensions of vehicles must not exceed those entered in the registration documents or the upper limits in force in territory of the Contracting Parties.

2. A special permit, issued by the competent authorities, is required in case the gross weight or dimensions of the vehicle exceed the permissible upper limits in both the Contracting Parties.

Article 14 Equipment and other characteristics

1. Vehicles carrying dangerous goods or perishable goods π equipped in accordance with the requirements of the ADR and

2. Equipment used to monitor crew driving and rest time provisions of the AETR Agreement.

Μ The Contracting Parties undertake to promote, within the framework of this ^Agreement, the use of vehicles meeting safety and environmental standards.

Article 15 Control

All necessary documents must be kept in vehicles and produced at the request of control officers, such as: the original authorisation, the waybill that forms part of the control document, other permits as well as any document (such as consignment note, bill of lading, insurance certificate etc.) required by multilateral or bilateral agreements or by the legislation of the Contracting Parties. The control documents should be filled out before the departure.

Article 16

Obligations of transport operators and penalties

1. The transport operators of a Contracting Party have a duty, in the territory of the other Contracting Party, to comply with obligations arising from multilateral agreements to which the two parties are Contracting Parties, from the present Agreement as well as other bilateral agreements, and from national legislation, particularly traffic rules, custom arrangements etc.

2. The competent authorities in the country of establishment may, in the event of serious or repeated infringements committed on the territory of the host country, and at the latter's request, take the following administrative action:

- issue a warning,

- prohibit access to the territory of the Contracting Party where the infringement(s) was (were) committed.

In particularly serious cases, the competent authority of the host country may temporarily prohibit the access of the infringer to its territory pending a the authority in the country of establishment.

Article 17 Collaboration and Joint Committee

1. The competent authorities of the Contracting Parties shall take the necessary steps to implement and apply this agreement and pass on any useful information to each other. The competent authorities shall also keep each other mutually informed of any change in national law affecting the application hereof.

The competent authorities shall afford each other mutual assistance for the purpose of implementing this Agreement.

2. A Joint Committee shall be set up, comprising delegates from each Contracting Party for the reasons stated in item 1. Each meeting of the Joint Committee closes with the adoption of a protocol signed by the heads of the delegations.

The Joint Committee is responsible for implementing this Agreement and specifically for reviewing all questions concerning relations between the Contracting Parties in the field of road transport.

PARTV FINAL PROVISIONS Article 18 Competent authorities

According to this Agreement the competent authorities shall be as follows:

- for The Hellenic Republic - the Ministry of Transport and Communications

- for the Republic of Lebanon - the Ministry of Public Works and Transport

Article 17

Entry into force and duration of the Agreement

1. This Agreement shall enter into force 30 days following the date of receipt^fjhe second notification through diplomatic channels, by which the Contra;cg^PaSfis< inform each other that their internal State procedures required for jrfe^iltry, force of this Agreement, have been completed.

2. This Agreement shall remain in forge for a period of one year after its entry into force and automatically renewed for one-year periods unless either Contracting Party expresses its wish, in written form, to the other Contracting Party to terminate the Agreement at least three months prior to the expiry date.

The Embassy of the Republic of Lebanon in Athens presents its compliments to the Ministry of Foreign Affairs of the Hellenic Republic - A6 Directorate and with reference to the Agreement between Lebanon and Greece on International Transport of Passengers and Goods by Road signed in Lebanon on 21/01/2004, has the honor to inform the esteemed Ministry of the following: ~~

The Lebanese competent authorities suggest to add the following sentence "in the territory of the other Contracting Party" ίο the first paragraph of the of the article 12 of this Agreement, to read as follows:

" Article 12 I Tax Provisions '

1 - The transport by vehicles registered in the state territory of one of the Contracting Parties, under the terms of this Agreement, is exempted, in the territory of the other/ ; Gontracting\Party/from payment of all taxes related to the ownership, registration and driving of a vehicle. "

The Embassy of the Republic of Lebanon would appreciate if the Ministry of Foreign Affairs could'submit this suggestion to the relevant Greek authorities and inform this Embassy of their approval in order to proceed with the ratification of this Agreement.

— Α6 Διεύθυνση και, αναφορικά με τη Συμφωνία μεταξύ του Λιβάνου και της Ελλάδας για τη Διεθνή Οδική Μεταφορά Επιβατών και Αγαθών που υπεγράφη στο Λίβανο στις 21/01/2004, έχει την τιμή να ενημερώσει το σεβαστό Υπουργείο ως εξής:

Οι αρμόδιες αρχές του Λιβάνου προτείνουν να προστεθεί η ακόλουθη πρόταση «στην επικράτεια του άλλου Συμβαλλόμενου Μέρους» στην πρώτη παράγραφο του άρθρου 12 της εν λόγω Συμφωνίας, η οποία θα έχει τώρα ως εξής:

Η μεταφορά από οχήματα εγγεγραμμένα στην κρατική επικράτεια ενός εκ των Συμβαλλομένων Μερών, βάσει των όρων της παρούσας Συμφωνίας, απαλλάσσεται, στην επικράτεια του άλλου Συμβαλλόμενου Μέρους, από την καταβολή όλων των φόρων που σχετίζονται με την κυριότητα, την εγγραφή και την οδήγηση ενός οχήματος».

Η Πρεσβεία της Δημοκρατίας του Λιβάνου θα επιθυμούσε όπως το Υπουργείο Εξωτερικών υποβάλλει την παρούσα πρόταση στις αρμόδιες ελληνικές αρχές και ενημερώσει την Πρεσβεία σχετικά με την έγκρισή τους, ούτως ώστε να προχωρήσουμε στην επικύρωση της Συμφωνίας.

Η Πρεσβεία της Δημοκρατίας του Λιβάνου δράττεται της ευκαιρίας να εκφράσει εκ νέου την υψηλή εκτίμησή της προς το Υπουργείο Εξωτερικών της Ελληνικής Δημοκρατίας - Α6 Διεύθυνση.

ΡΗΜΑΤΙΚΗ ΔΙΑΚΟΙΝΩΣΗ

Το Υπουργείο Εξωτερικών της Ελληνικής Δημοκρατίας χαιρετίζει την Πρεσβεία της Δημοκρατίας του Λιβάνου στην Αθήνα και, αναφορικά με τη Διακοίνωση αυτής με αριθμό 584/2004 από 6 Ιουλίου 2004 σχετικά με τη Συμφωνία για τη Διεθνή Οδική Μεταφορά Επιβατών και Αγαθών, έχει την τιμή να την ενημερώσει ότι το Ελληνικό Υπουργείο Μεταφορών και Επικοινωνιών εγκρίνει την προτεινόμενη τροποποίηση του Άρθρου 12.

Το Υπουργείο Εξωτερικών της Ελληνικής Δημοκρατίας δράττεται της ευκαιρίας να εκφράσει εκ νέου την υψηλή ε-κτίμησή του προς την Πρεσβεία της Δημοκρατίας του Λιβάνου.

Άρθρο δεύτερο Άρθρο τρίτο

Τα Πρωτόκολλα που καταρτίζονται από τη Μικτή Επι- Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευτροπή της παραγράφου 2 του άρθρου 17 της Συμφωνίας σή του στην Εφημερίδα της Κυβερνήσεως και της Συμεγκρίνονται με κοινή πράξη των αρμόδιων κατά περίπτω- φωνίας που κυρώνεται από την πλήρωση των προϋποθέση Υπουργών. σεων του άρθρου 19 παρ. 1 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.
