Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ

Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή: Άρθρο πρώτο

Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η Συμφωνία αεροπορικών μεταφορών μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Ομοσπονδιακής Κυβέρνησης της Ομοσπονδιακής Δημοκρατίας της Γιουγκοσλαβίας, που υπογράφηκε στο Βελιγράδι στις 9 Μαΐου 2002, της οποίας το κείμενο σε πρωτότυπο στην ελληνική και αγγλική γλώσσα έχει ως εξής:

ΣΥΜΦΩΝΙΑ ΑΕΡΟΠΟΡΙΚΩΝ ΜΕΤΑΦΟΡΩΝ ΜΕΤΑΞΥ ΤΗΣ ΚΥΒΕΡΝΗΣΗΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΚΑΙ ΤΗΣ ΟΜΟΣΠΟΝΔΙΑΚΗΣ ΚΥΒΕΡΝΗΣΗΣ ΤΗΣ ΟΜΟΣΠΟΝΔΙΑΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΤΗΣ ΓΙΟΥΓΚΟΣΛΑΒΙΑΣ

Η Ομοσπονδιακή Κυβέρνηση της Ομοσπονδιακής Δημοκρατίας της Γιουγκοσλαβίας και η Κυβέρνηση της Ελληνικής Δημοκρατίας (εφεξής καλούμενες τα "Συμβαλλόμενα Μέρη").

Αποτελούσες μέρη της Σύμβασης για τη Διεθνή Πολιτική Αεροπορία, η οποία ετέθη προς υπογραφή στο Σικάγο στις 7 Δεκεμβρίου 1944,

Επιθυμούσες τη σύναψη μίας Συμφωνίας με σκοπό την εγκατάσταση και λειτουργία αεροπορικών δρομολογίων μεταξύ και πέραν των αντιστοίχων εδαφών τους,

Συμφώνησαν τα ακόλουθα:

Άρθρο 21

ΕΝΑΡΞΗ ΙΣΧΥΟΣ

Η παρούσα Συμφωνία θα τεθεί σε ισχύ από την ημερομηνία κατά την οποία αμφότερα τα Συμβαλλόμενα Μέρη θα έχουν γνωστοποιήσει αμοιβαία, με ανταλλαγή διπλωματικών διακοινώσεων, ότι έχουν ολοκληρώσει τις εσωτερικές νομικές τους διαδικασίες που είναι αναγκαίες για το σκοπό αυτό.

ΣΕ ΠΙΣΤΩΣΗ των ανωτέρω οι υπογράφοντες, νόμιμα γι' αυτό εξουσιοδοτημένοι από τις αντίστοιχες Κυβερνήσεις τους, υπέγραψαν την παρούσα Συμφωνία.

Έγινε στο Βελιγράδι στις 9.5.2002, σε δύο αντίτυπα, στην Ελληνική, Σερβική και Αγγλική γλώσσα και τα τρία κείμενα θεωρούμενα εξίσου αυθεντικά. Σε περίπτωση απόκλισης στην ερμηνεία θα υπερισχύει το αγγλικό κείμενο.

Α. Η διορισμένη αεροπορική εταιρεία της Ομοσπονδιακής Κυβέρνησης της Ομοσπονδιακής Δημοκρατίας της Γιουγκοσλαβίας θα έχει δικαίωμα να εκτελεί τακτικά διεθνή αεροπορικά δρομολόγια και προς τις δύο κατευθύνσεις στις διαδρομές που καθορίζονται κατωτέρω:

Γ. Η πιθανή άσκηση εμπορικών δικαιωμάτων πέμπτης ελευθερίας θα συμφωνείται από τις Αεροπορικές Αρχές των Συμβαλλομένων Μερών για οποιαδήποτε ενδιάμεσα σημεία και σημεία πέραν.

Δ. Κατά την εκτέλεση των συμφωνημένων δρομολογίων στις καθορισμένες διαδρομές, η διορισμένη αεροπορική εταιρεία του ενός Συμβαλλόμενου Μέρους μπορεί να προβεί σε συμφωνία χρήσης κοινών κωδικών με την αεροπορική εταιρεία του άλλου Συμβαλλόμενου Μέρους.

Αυτού του είδους η συμφωνία θα τελεί υπό την έγκριση των αντίστοιχων Αεροπορικών Αρχών.

Οι δύο συνεργαζόμενες αεροπορικές εταιρείες πρέπει να διευκρινίζουν στον καταναλωτή, σχετικά με τις διαδικασίες κράτησης θέσεων και τις δραστηριότητες πώλησης εισιτηρίων, ποια αεροπορική εταιρεία ενεργεί ως ο πραγματικός αερομεταφορέας (με τα αεροσκάφη του οποίου εκτελούνται τα δρομολόγια) και ποιος ως ο αερομεταφορέας που συμμετέχει στην εμπορική εκμετάλλευση της πτήσης.

Τα δρομολόγια χρήσης κοινού κωδικού δεν θα αφαιρούνται από τις συχνότητες τις οποίες δικαιούται ο αερομεταφορέας που συμμετέχει στην εμπορική εκμετάλλευση της γραμμής.

AIR SERVICES AGREEMENT BETWEEN THE GOVERNMENT OF THE HELLENIC REPUBLIC AND THE FEDERAL GOVERNMENT OF THE FEDERAL REPUBLIC OF

YUGOSLAVIA

The Federal Government of the Federal Republic of Yugoslavia and the Government of the Hellenic Republic (hereinafter referred to as the "Contracting Parties");

Being parties to the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December 1944;

Desiring to conclude an Agreement for the purpose of establishing and operating air services between their respective territories and beyond,

Have agreed as follows:

Article 1 DEFINITIONS

For the purpose of the present Agreement, unless the context otherwise requires:

1) The term "Aeronautical Authorities" means, in the case of the Federal Republic of Yugoslavia, the Federal Ministry of Transport and Telecommunications and, in the case of the Hellenic Republic, the Governor of the Civil Aviation Authority and any competent person or body authorized to perform any functions at present exercised or which may be exercised in future by the said Authority or similar functions;

2) The term "the Convention" means the Convention on International Civil Aviation, opened for signature at Chicago, on the seventh day of December, 1944, and includes any Annex or any amendments thereto adopted under Article 90 of that Convention insofar as such amendments are effective for those Contracting Parties; any amendment of the Convention under Article 94 thereof insofar, as. those amendments have been approved by both Contracting Parties;

3) The terra "the Agreement" means the present Agreement, the Annex attached thereto, constituting its integral part, and any Protocols amending the present Agreement or the Annex;

4) The term "designated airline" means an airline which has been designated and authorized in accordance with the provisions of Article 3 of the present Agreement;

5) The tenn "agreed services" means the scheduled air services on the routes specified m the Annex to the present Agreement, for , the transport of passengers, cargo and mail, separately or in combinations;

6) The tenn "capacity" in relation to an aircraft means the payload of that aircraft available on a route or section of a route, and the tenn "capacity", in relation to the agreed services means the capacity of the aircraft used on such services, multiplied by the frequency operated by such aircraft over a given period on a route or section of a route;

7) The tenn "territory" in relation to a State has the meaning of .Article 2 of the Convention.

8) The tenns "air service", "international air service", "airline" and "stop for non-traffic purposes" have the meanings assigned to them in Article 96 of the Convention;

9) The term "tariff means iiie price to be paid for the carnage of passengers, baggage and cargo and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary services performed by the earner in connection with the air transportation but excluding remuneration and conditions for the carriage of mail;

10) The tenn "user charges" means, in accordance with Article 11 of the present Agreement, the charges levied from the airlines, for the use of an airport, its facilities, technical and other installations and services as well as for the use of air navigation facilities, aviation security property, communication facilities and services.

The titles of each Article of the present Agreement in no way η meanings of any of the provisions of the present Agreement.

Article 2 GRANT OF RIGHTS

Each Contracting Party grants to the other Contracting Party the rights specified in the present Agreement for the operation of scheduled international air services by the designated airline of the other Contracting Party, as follows:

1) to fly, without landing, across the territory of the other Contracting Party;

2) to make stops in the territory of the other Contracting Party for non-traffic purposes, and

3) to make stops in the territory of the other Contracting Party at points specified in the Annex to the present Agreement for the purpose of taking on board and discharging international traffic in passengers, cargo and mail, separately or m combinations.

The provisions of this Article shall not confer on the designated airline of either Contracting Party the right to embark passengers, cargo and mail canned for remuneration between the points in the territory of the other Contracting Party.

Article 3

DESIGNATION OF AIRLINES AND AUTHORIZATIONS

Each Contracting Party shall have the right to designate in writing to the other Contracting Party, an airline for the purpose of operating the agreed services on the specified routes as well as to withdraw or alter in writing such designation.

On receipt of such designation, the competent authorities of the other Contracting Party shall, subject to the provisions of this Article, grant without delay to the airline so designated, the operating authorization.

The Aeronautical Authorities of one Contracting Party may, prior granting the operating authorization, require the airline designated by the othep^Ull|^»ehng Party to prove that it fulfils the conditions prescribed by the laws am^gSaTtons^plied to operation of international air services by such authontie^l^b^^ the provisions of the Convention. ^ * ^ "**'

Each Contracting Party shall have the nght to refuse to grant the operating authorization, referred to in this Article, or to impose on the designated airline conditions on the exercise of the rights specified in Article 2 of the present Agreement if it is not satisfied that substantial ownership and effective control of that airline are vested in' the Contracting Party designating the airlme or in its nationals.

The airline designated and authorized according to the provisions of this Article may start to operate the agreed services provided the time-table established according to the provisions of .Article 12 of the present Agreement is in force and provided the tariff is established in accordance with the provisions of .Article 13 of the present Agreement.

Article 4

REVOCATION AND SUSPENSION OF OPERATING AUTHORIZATION

Each Contracting Party shall have the nght to revoke the operating authorization or to suspend the exercise of the rights specified in Article 2 of the present Agreement or to impose such conditions necessary for the exercise of these rights by the airline designated by the other Contracting Party, if:

1) such airline cannot prove that it fulfils the conditions prescribed by the laws and regulations applied to the operation of international air services by these Authorities in conformity with the Convention;

2) it is not satisfied that substantial ownership and effective control of that airlme are vested in the Contracting Party designating the airline or in its nationals;

3) that airlme fails to comply with the laws and regulations of the Contracting Party granting these rights;

4) the airlme otherwise fails to operate the services in accordance with the conditions prescnbed under the present Agreement.

Unless immediate revocation, suspension or imposition of conditior>s^rpe^^

the first paragraph of this Article is essential to prevent further infri/^^l^flts^f^D^

and regulations, such right shall be exercised only after consultation with the other Contracting Party, in confonnity with Article 15 of the present Agreement.

Article 5

APPLICABILITY OF LAWS AND REGULATIONS

The laws and regulations of one Contracting Party governing entry into, remaining in or departure from its territory of aircraft engaged in international air services or operation and navigation of such aircraft while in its territory shall apply to the aircraft of any airline designated by the other Contracting Party.

The laws and regulations of one Contracting Party relating to arrival, stay in and departure from its territory of passengers, crew, cargo and mail and which are related to procedures regarding passports, customs, currency and sanitary measures shall apply to passengers, crew, cargo and mail of the aircraft of the designated airline of the other Contracting Party while within its territory.

Passengers, baggage and cargo in direct transit across the territory of one Contracting Party and not leaving the area of the airport reserved for such purpose shall only be subject to no more than a routine control except in respect of security measures and measures against violence, air piracy and smuggling of controlled drugs and radioactive substances.

Baggage and cargo in direct transit shall be exempt from custom duties and other similar taxes.

Article 6

RECOGNITION OF CERTIFICATES AND LICENSES

Certificates of airworthiness, certificates of competency and licenses issued or rendered valid by one Contracting Party, and still in force, shall be recognized as valid by the other Contracting Party for the purpose of operating services provided for in this Agreement, provided that the requirements under which such certificates or licenses were issued or rendered valid are equal to or above the minimmn standards which are or may be established pursuant to the Convention. ~d£^icpK Contracting Party reserves the right, however to refuse to recognize, fpr-JJhe^li^sh of flights above its own territory, certificates of competency and heed's grari;^d\q,jr

its own nationals or rendered valid for them by the other Contracting Party or by any other State.

If the privileges or conditions of the licenses or certificates referred to in the above paragraph, issued by the Aeronautical Authorities of one Contracting Party to any person or designated airlme or in respect of an aircraft operating the agreed services on the specified routes would permit a difference from the standards established under the Convention, and which difference has been filed with the International Civil Aviation Organization, the Aeronautical Authorities of the other Contracting Party may request consultations in accordance with Article 15 of this Agreement with the Aeronautical Authorities of that Contracting Party with a view to satisfying themselves that the practice in question is acceptable to them. Failure to reach a satisfactory agreement will constitute grounds for the application of Article 4 of this Agreement.

Article 7 AVIATION SAFETY

Each Contracting Party may request consultations at any time concerning safely standards in any area relating to aircrew, aircraft or their operation adopted by the other Contracting Party. Such consultations shall take place within 30 days of that request.

If, following such consultations, one Contracting Party finds that the other Contracting Party does not effectively maintain and administer safety standards in any such area that are at least equal to the minimum standards established at that time pursuant to the Chicago Convention, the first Contracting Party shall notify' the other Contracting Party of those findings and the steps considered necessary to conform with those minimum standards and that other Contracting Party shall take appropriate corrective action. Failure by the other Contracting Party to take appropriate action within 15 days or such longer period as may be agreed, shall be grounds for the application of Article 4 of this Agreement.

Notwithstanding the obligations mentioned in Article 33 of the Chicago Convention it is agreed that any aircraft operated by the airline or airlines of one Contracting Party on services to or from the territory of another Contracting Party may, vvhile^ within the territory of the other Contracting Party, be made the subject of ah examination by the authorised representatives of the other Contracting Party; "on

[board and around the aircraft to check both the validity of the aircraft documents and 'those of its crew and the apparent condition of the aircraft and its equipment (in this Article called "ramp inspection"), provided this does not lead to unreasonable delay.

If any ramp inspection or series of ramp inspections gives rise to:

1) serious concerns that an aircraft or the operation of an aircraft does not comply with the minimum standards established at that time pursuant to the

2) senous concerns that there is a lack of effective maintenance and administration of safety standards established at that time pursuant to the Chicago Convention.

of the Chicago Convention, be free to conclude that the requirements under which the certificates or licences in respect of that aircraft or in respect of the crew of that aircraft had been issued or rendered valid, or that the requirements under which that aircraft is operated, are not equal to or above the minimum standards established pursuant to the Chicago Convention.

In the event that access for the purpose of undertaking a ramp inspection of an aircraft operated by the' airline or airlines of one Contracting Party in accordance with the provisions of this Article is denied by the representative of that airline or airlines, the other Contracting Party shall be free to infer that senous concerns of the type referred to in this Article arise and draw the conclusions referred to therein.

Each Contracting Party reserves the right to suspend or vary the operating authorisation of an airline or airlines of the other Contracting Party immediately in the event the first Contracting Party concludes, whether as a result of a ramp inspection, a senes of ramp inspections, a denial of access for ramp inspection, consultation or otherwise, that immediate action is essential to the safety of an airlme operation.

Article 8 AVIATION SECURITY

Consistent with their rights and obligations under international law, the Contracting Parties reaffirm that their obligation to protect the security of civil aviation against acts of unlawful interference forms an integral part of the present Agreement. Without limiting the generality of their rights and obligations under international law, the Contracting Parties shall in particular act in conformity with the provisions of the Convention on Offences and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at the Hague on 16 December 1970 and the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, signed at Montreal on 23 September 1971, the Protocol for the Suppression of Unlawful Acts Against the Safety of International Airports, signed at Montreal on 24 February 1988 and any other Convention on aviation security which shall become bindmg for both Contracting Parties.

The Contracting Parties shall provide, when necessary, all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities and any other threat to the security of civil aviation.

The Contracting Parties shall, in their mutual relations, act in conformity with the aviation security provisions, established by the International Civil Aviation Organization and designated as Annexes to the Convention on International Civil Aviation to the extent that such security provisions are applicable to the Contracting Parties, and shall require the operators of aircraft of their registry or operators of aircraft who have their principal place of business or permanent residence in their territory and the operators of airports in their territory to act in conformity with such aviation security provisions.

Each Contracting Party agrees that such operators of aircraft may be required to observe the aviation security provisions referred to in this Article, required by the other Contracting Party for entry into, while within or departure from the territory of that other Contracting Party. Each Contracting Party shall ensure that adequate measures are effectively applied within its territory to protect the amy^^and to screen passengers and their carry-on items and to carry out appropriat^^ecks^vthe crew, baggage, cargo and aircraft stores prior to and during bo^t^mp^n^^mg\ Each Contracting Party shall give positive consideration to any;^e^ue^fr^n\ the.1

other Contracting Party for reasonable special security measures to meet a particular threat.

When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to tenninate rapidly and safely such incident or threat thereof.

Article 9

REPRESENTATIVE OFFICES OF THE AIRLINES AND TRANSFER OF EARNINGS

The designated airline of one Contracting Party shall have the right to establish its own Representative Office in the territory of the other Contracting Party, in accordance with national legislation of that Contracting Party.

The designated airline of one Contracting Party may, in accordance with the laws and regulations of the other Party relating to entry, residence and employment, bring in and maintain in the territory of the other Contracting Party managerial, sales, technical, operational and other specialist staff required for the provision of air services.

One Contracting Party- shall grant to the designated airline of the other Contracting Party the right to sell its own air transportation in the State territory of the other Contracting Party, in local or foreign currency, directly or through its agents, and any person shall be able to purchase such air transportation, in accordance with the national legislation of that Contracting Party.

One Contracting Party shall grant to the designated airline of the other Contracting Party the nght to transfer to its country, on demand, the excess of receipts over expenditure, earned in the State territory of the Contracting Party in connection with the sale of its own air transportation, in accordance with the foreign exchange regulations of that Contracting Party.

If one Contracting Party imposes restrictions on the transfer of excess of receipts* over expenditure earned by the designated airline of the other Contractihg^Pafty^^the

other Contracting Party will also have the right to impose the same restrictions on the other Contracting Party's designated airline.

Article 10

CUSTOMS AND OTHER DUTIES AND TAXES

Aircraft operated on the agreed services by the designated airline of either Contracting Party as well as their regular equipment, supplies of fuel and lubricants, aircraft stores (including food, beverages and tobacco) on board such aircraft shall be exempt from all customs and other unport duties, inspection fees and other charges or taxes on arriving in the terntory of the other Contracting Party, provided that such equipment and supplies remain on board the aircraft until they leave the terntory of that Contracting Party.

There shall also be exempt from the same duties and taxes, with the exception of charges corresponding to the services perfonned:

1) aircraft stores taken on board in the territory of either Contracting Party and intended for use on board the aircraft engaged on international air services of the other Contracting Party;

2) spare parts and equipment entered into the territory of either Contracting Party for the maintnance or' repair of aircraft used on international services by the designated airline of the other Contracting Party;

3) fuel and lubricants destined to supply the aircraft operated on international services by the designated airline of the other Contracting Party, even in case when these supplies are to be used on the part of the journey over the territory of the Contracting Party in which they are taken on board.

The Contracting Parties may require that the supplies, spare parts and equipment mentioned in the aforesaid items (1), (2) and (3) of this Article are kept under customs supervision or control.

The regular airborne equipment, supplies and spare parts of the aircraft retained, on board aircraft operated by the designated airlme of either Contracting Party "may be unloaded in the territory of the other Contracting Party only with the app'rovaTof the customs authorities of that Contracting Party and they may be placed under the

supervision of its customs authorities until it leaves the territory of the said Contracting Party or is otherwise disposed of in accordance with customs regulations.

Ihe necessary documents of the designated airline of either Contracting Party including air tickets, airwaybills as well as advertising material shall be exempt from customs and other import duties and taxes in the territory of the other Contracting Party.

Baggage, cargo and mail in direct transit shall be exempt from customs and other import duties, charges or taxes.

There shall also be exempt from the same duties, charges and taxes:

1) all types of telecommunication equipment such as teletype apparatus and walkie talkie or other wireless equipment for use within airport;

2) airline computer systems for reservation and operational purposes.

Article 11 USER CHARGES

Charges for the use of airport, its installations, technical and other facilities and serv ices as well as the charges for the use of air navigation facilities, communication facilities and services shall be made in accordance with the rates established by each Contracting Party in its terntory, in accordance with its national regulations.

Article 12

CAPACITY REGULATION AND APPROVAL OF SCHEDULES

The designated airlines of the Contracting Parties shall have equal opportunities for operation of the agreed services on the specified routes between their territories.

In operating the agreed services the designated airline of each G<5f^^ciln^^rty' shall take into account the interests of the designated airline of thivp^^Carrtr^nNag Party so as not to affect unduly the services which the airline p^/^s ojfifh^vv]\^re or part of the same routes.

The agreed services provided by the designated airlines of the Contracting Parties shall have as their objective the provision, at a reasonable load factor, of capacity adequate to current and reasonably anticipated requirements for carriage of passengers, cargo and mail between the territories of both Contracting Parties.

Provision for carriage of passengers, cargo and mail both taken on board and discharged at the points on the routes to be specified in the territories of States other than that designating the airline shall be agreed upon between the two Contractmg Parties.

The capacity, frequency of services and the type of aircraft to be used by the designated airlines of the Contracting Parties on the agreed services shall be approved by the Aeronautical Authorities of the Contracting Parties.

The designated airline of each Contractmg Party shall submit its schedule for approval to the Aeronautical Authorities of the other Contractmg Party not later than thirty (30) days poor to the introduction of services on the specified routes, in special cases this time limit may be reduced subject to approval of the competent authorities of the Contracting Parties.

Article 13 TARIFFS

The tariffs to be charged by the airlines of the Contracting Parties for the agreed services shall be established due regard being paid to all relevant factors including cost of operation, reasonable profit and the tariffs of other airlines.

The tariffs referred to above shall be agreed upon by the designated airlines of both Contracting Parties.

The tariffs so agreed shall be submitted for approval to the Aeronautical Authorities of the Contracting Parties at least sixty (60) days before the proposed date of their introduction. This time limit may be reduced, subject to the consent of the said Authorities.

In case the designated airlines of the Contractmg Parties fail to agree i^TThc-«.tanfts to be charged, or where one Contracting Party has not designated/its &jfline~tQvpperate the agreed services, or if, during the first thirty (30) days of th^'six^C^^^y\^S>\iod

referred to above, the Aeronautical Authorities of one Contracting Party give the Aeronautical Authorities of the other Contracting Party a notice of their disagreement with any tariff agreed between the designated airlines of the Contractmg Parties in accordance with the provisions of this Article, the Aeronautical Authorities of the Contracting Parties shall take measures so that the designated airlines of the-Contracting Parties detennme the tariffs by the agreement between themselves.

No tariff shall come into force if the Aeronautical Authorities of the Contracting Parties have not approved it.

The tariffs established m accordance with the provisions of this Article shall remain in force until new tariffs have been established.

If the Aeronautical Authorities cannot agree on any tariff submitted to them under the provisions of this Article or the determination of any tariff, the dispute shall be settled in accordance with the provisions of Article 15 of the present Agreement.

Article 14 PROVISION OF STATISTICS

The Aeronautical Authorities of one Contracting Party shall supply to the Aeronautical Authorities of the other Contracting Party, at their request, periodical and other statistical data relating to the agreed services performed in the agreed period.

Article 15 CONSULTATIONS

Each Contracting Party or its Aeronautical Authorities may request consultations with the other Contracting Party or its Aeronautical Authorities.

The consultations requested by one of the Contracting Parties or dieij'^WKinautical Authorities shall begin within a period of sixty (60) days fi^k^ie_^aT^o1^the request, unless otherwise agreed by the Contracting Parties.

Article 16 MODIFICATIONS

If either Contracting Party considers it appropriate to modify any provision of the present Agreement, it may request consultations in accordance with Article 15 above with the other Contracting Party relating to the proposed modifications. Such consultations shall begin within a period of sixty (60) days from the date of receipt of the request unless the Aeronautical Authorities of the Contracting Parties agree upon the extension of that period. Any modifications so agreed shall come into effect when the Contractmg Parties will have notified each other, by the exchange of diplomatic notes, that they have completed their internal legal procedures.

Any modifications to the Annex to the present Agreement shall be made by agreement between the Aeronautical Authorities of the Contracting Parties and confirmed by an exchange of diplomatic notes.

Article 17 SETTLEMENT OF DISPUTES

If any dispute arises between the Contracting Parties relating to the interpretation or application of the present Agreement and its Annex, the Contracting Parties shall endeavour to settle it by negotiations.

If the Contracting Parties fail to reach a settlement by negotiations, the dispute shall be referred, at the request of either Contracting Party, to an Arbitral Tribunal of three arbitrators, one to be nominated by each Contracting Party and the third to be agreed upon by the two so nominated. Each Contracting Party shall nominate an arbitrator within a period of sixty (60) days from the date of receipt by either Contracting Party from the other of a notice, through diplomatic channels, requesting arbitration of the dispute by such a Tribunal and the third arbitrator shall be appointed within a further period of sixty (60) days. If either Contracting Party fails to nominate its arbitrator within the period specified, the President of the Council of the International Civil Aviation Organization may be requested by either Contracting Party to appoint an arbitrator or arbitrators, as the case may require. If the President of the Council of the International Civil Aviation Organization is,an"3TioTTalof either Contracting Party, the Vice-President of the Council, who is a,n^fljfiaal oT^ine third country, may be requested to appomt the said arbitrators.

The Arbitral Tribunal shall determine its own procedure.

Each Contractmg Party shall pay the expenses of the arbitrator it has nominated.

The expenses of the Arbitral Tribunal shall be shared equally by the Contracting Parties.

The Contractmg Parties undertake to comply with any decision of the Arbitral Tribunal

Article 18

DENUNCIATION AND TERMINATION OF THE AGREEMENT

Either Contracting Party may, at any time, give a written notice, through diplomatic channels, to the other Contracting Party of its intention to terminate the present Agreement. Such notice shall be simultaneously sent to the international Civil Aviation Organization. In such case, the Agreement shall tenmnate twelve (12) months after the date of receipt of the notice by the other Contracting Party unless the notice on termination is withdrawn by agreement before the expiry of this period. If the other Contracting Party fails to acknowledge the receipt, the notice shall be deemed to have been received fourteen (14) days after the International Civil Aviation Organization has received it.

Article 19

CONFORMITY WITH MULTILATERAL AGREEMENTS

If any multilateral agreement relating to any issue incorporated in the present Agreement, accepted by both Contracting Parties, comes into force, the Agreement and its Annex shall be deemed to be amended without further agreement as may be necessary to confonn with the provisions of that multilateral agreement.

D. While operating the agreed services on the specified routes, the designated airline of one Contracting Parry' may enter into code share arrangement with the designated airline of the other Contracting Party.

Such arrangement shall be subject to the approval of the respective Aeronautical Authorities.

The two partner airlines must clarify to the consumer in respect of reservation procedures and ticket sales activities which airline acts as the operating carrier and which as the marketing one.

Code share services do not count against the frequency entitlement of the marketing carrier.

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευσή του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 21 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.

Το κόστος για την ετήσια συνδρομή σε ηλεκτρονική μορφή για τα προηγούμενα έτη προσαυξάνεται πέραν του ποσού της ετήσιας συνδρομής του έτους 2003 κατά 6 euro ανά έτος παλαιότητας και κατά τεύχος

* Οι συνδρομές του εσωτερικού προπληρώνονται στις ΔΟΥ που δίνουν αποδεικτικό είσπραξης (διπλότυπο) το οποίο με τη φροντίδα του ενδιαφερομένου πρέπει να στέλνεται στην Υπηρεσία του Εθνικού Τυπογραφείου.

* Η πληρωμή του υπέρ ΤΑΠΕΤ ποσοστού που αντιστοιχεί σε συνδρομές, εισπράττεται και από τις ΔΟΥ.

* Οι συνδρομητές του εξωτερικού έχουν τη δυνατότητα λήψης των δημοσιευμάτων μέσω internet, με την καταβολή των αντίστοιχων ποσών συνδρομής και ΤΑΠΕΤ.

* Οι Νομαρχιακές Αυτοδιοικήσεις, οι Δήμοι, οι Κοινότητες ως και οι επιχειρήσεις αυτών πληρώνουν το μισό χρηματικό ποσό της συνδρομής και ολόκληρο το ποσό υπέρ του ΤΑΠΕΤ.

* Η συνδρομή ισχύει για ένα χρόνο, που αρχίζει την 1η Ιανουαρίου και λήγει την 31η Δεκεμβρίου του ίδιου χρόνου. Δεν εγγράφονται συνδρομητές για μικρότερο χρονικό διάστημα.

* Η εγγραφή ή ανανέωση της συνδρομής πραγματοποιείται το αργότερο μέχρι την 31ην Δεκεμβρίου κάθε έτους.

* Αντίγραφα διπλοτύπων, ταχυδρομικές επιταγές και χρηματικά γραμμάτια δεν γίνονται δεκτά.

Οι υπηρεσίες εξυπηρέτησης των πολιτών λειτουργούν καθημερινά από 08.00' έως 13.00'
