ΣΥΜΦΩΝΙΑ

ΜΕΤΑΞΥ ΤΗΣ ΚΥΒΕΡΝΗΣΗΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΚΑΙ ΤΗΣ ΚΥΒΕΡΝΗΣΗΣ ΤΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΤΗΣ ΜΟΛΔΑΒΙΑΣ ΠΑ ΤΗΝ ΑΜΟΙΒΑΙΑ ΣΥΝΔΡΟΜΗ ΜΕΤΑΞΥ ΤΩΝ ΤΕΛΩΝΕΙΑΚΩΝ ΤΟΥΣ ΔΙΟΙΚΗΣΕΩΝ

Η Κυβέρνηση της Ελληνικής Δημοκρατίας και ή Κυβέρνηση της Δημοκρατίας της Μολδαβίας, αποκαλούμενες στο εξής ως τα Συμβαλλόμενα Μέρη,

Λαμβάνοντας υπόψη τη σημασία του ακριβούς υπολογισμού των τελωνειακών

Τελωνειακές Διοικήσεις είδικώχ^έτρώ| ο^αγόρε^οτις;mpiopiapbu και ελέγχου,

Αναγνωρίζοντας/όϊι οι παραβάσεις ?ής τελωνειακής^γρροθρσ[ας^ παραβλάπτουν τα κοινωνικά, οικον^^,^μφήοηίά^κά^ άλλα συμφέροντα των;^ώ]ρών τους,

Πεπεισμένες ότι ^.-;ενίσχφη της συνεργασίας μεταξύ των ^ Τελωνειακών τους Διοικήσεων θα : συμβάλει - επην αποτελεσματικότερη δράση ,για την πρόληψη, διερεύνηση και καταστολή των τελωνειακών παραβάσεων, συμπεριλαμβανομένης της παράνομης δια)<ί^^ φαρμάκων και ψυχοτρόπων ουσιών ή των

ουσιών που τις υποκαθιστούν, της παράνομης μεταφοράς δια τών συνόρων όπλων, εκρηκτικών και πυροβολικών, πυρηνικού υλικού, καθώς και αντικειμένων πολιτιστικής αξίας και αρχαιολογικών θησαυρών.

Λαμβάνοντας υπόψη τις διατάξεις της ΕΥιαίας Σύμβασης του 1961 για τα Ναρκωτικά Φάρμακα, όπως τροποποιήθηκε με τό Πρωτόκολλο του 1972, της Σύμβασης του 1971 για τις Ψυχοτρόπες Ουσίες και της Σύμβασης των Ηνωμένων Εθνών του 1988 κατά της Παράνομης Διακίνησης Ναρκωτικών Φαρμάκων και Ψυχοτρόπων Ουσιών

Λαμβάνοντας υπόψη τις ισχύουσες διεθνείς Συμβάσεις που ενθαρρύνουν τη διμερή αμοιβαία συνδρομή καθώς και τις Συστάσεις του Συμβουλίου Τελωνειακής Συνεργασίας,

Λαμβάνοντας υπόψη τις υποχρεώσεις που απορρέουν από τη συμμετοχή της Ελληνικής Δημοκρατίας στην Ευρωπαϊκή Ένωση,

Συμφώνησαν ως ακολούθως:

Άρθρο 14

Έναρξη ισχύος της Συμφωνίας και Λήξη

1. Η παρούσα Συμφωνία τίθεται σε ισχύ την τριακοστή ημέρα από την ημερομηνία κατά την οποία τα Συμβαλλόμενα Μέρη γνωστοποιούν το ένα στο άλλο, εγγράφως, δια της διπλωματικής οδού, ότι έχουν εκπληρωθεί όλες οι εσωτερικές διαδικασίες για τη θέση της σε ισχύ.

AGREEMENT BETWEEN THE GOVERNMENT OF THE HELLENIC REPUBLIC AND THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA ON MUTUAL ASSISTANCE BETWEEN THEIR CUSTOMS ADMINISTRATIONS

The Government of the Hellenic Republic and the Government of the Republic of Moldova, hereinafter referred to as the Contracting Parties,

Considering the importance of accurate assessment of Customs duties and other taxes and of ensuring proper enforcement by Customs Administrations of specific measures of prohibition, restriction and control,

Having regard to the provisions of the' Single Convention on Narcotic Drugs of 1961, amended by the Protocol of 1972; the Convention on Psychotropic Substances of 1971 and the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances Of 1988,

Having regard also to the provisions of the relevant international Conventions in force encouraging bilateral mutual assistance and the Recommendations of the Customs Cooperation Council,

Having regard to the obligations arising from the Hellenic Republic s membership in the European Union,

Have agreed as follows;

ARTICLE 1 Definitions

For the purposes of this Agreement:

a) "Customs legislation" shall mean all legislative and regulatory provisions applied by the Customs Administrations of the Contracting Parties governing the import, export and transit of goods and their placement under any customs regime, including measures of prohibition, restriction and control;

"Customs Administration" shall mean for the Hellenic Republic - the Directorate General of Customs and Excise at the Ministry of Economy and Finance and for the Republic of Moldova - the Customs Service;

"Customs offence" shall mean any breach or attempted breach of the Customs legislation;

"Customs duties and taxes" shall mean Customs duties and all other duties, taxes, fees or other charges which are collected on or in connection with the importation or exportation of goods but not including fees and charges which are limited in amount to the approximate cost of services rendered;

"person" shall meaniej|hj^

"narcotic tirftg£" shajl mean any substances, natural pr synthetic, enumerated in Schedules I ,and II of the §}ngle Convention oji|slarcot!Cprugs of 1961 with the relevant amendments; -"^ .**v*^|,

"psychotrbpiq substances" shall mean any sui>s|ances, natural or synthetic, enumerated on the Lists I, II, III, and tV ofi^ti^fionvention on Psychotropic Substances of 1971; :; ; - , ··· ':'· ·; /'./'·

"requested Administration" shall mean the Customs Administration from which assistance is requested;::

"requesting Administration" shall mean the Customs Administration which requests assistance.

ARTICLE 2 Scope of the Agreement

By this Agreement the Contracting Parties establish mutual assistance between their Customs Administrations for the prevention, investigation and combating of Customs offences and for the proper application of Customs legislation.

The mutual assistance between the Contracting Parties is provided in accordance with the provisions of the legislation in force in the territory of its States and in the framework of their competence and available resources.

The application of this Agreement shall not affect the obligations of the Contracting Parties under any other international Agreements in which they are Contracting Parties.

ARTICLE 3 Scope of mutual assistance

1. Upon request, the Customs Administrations of the Contracting Parties inform each other:

a) whether goods imported into the territory of the State of the requesting Contracting Party have been lawfully exported from the territory of the State of the requested Contracting Party;

b) whether goods exported from the territory of the State of the requesting Contracting Party have been lawfully imported into the territory of the State of the requested Contracting Party.

2. The Customs Adnrynisiratipn of one Contracting Party shall provide, upon request of the Customs Administration Of the other Contracting Party and to the extent of its abi^rintoririation concerning: ?:

a) meahs of transport for which there are reasonable grounds for believing that they have been, are or may be used in the contravening of Customs legislation; ; : ^

b) goods known or suspected by the requesting Administration to be the object of illegal activities;; ··;; |

c) persons known or suspected by the requesting Administration of being involved in illegal activities; f

d) new methods and channels known or suspected by the requesting Administration of being involved in illegal activities.

Such information shall be supplied, by the initiative of the Customs Administration of a Contracting Party, in cases which could involve substantial damage to the economy, public health, public security or any other vital interest of the State of the other Contracting Party, such as the illicit traffic in narcotic drugs, psychotropic substances or substances substituted for them, arms, explosives and ammunition, nuclear material, archaeological treasures, works of art or other cultural treasures.

3. The Customs Administration of one Contracting Party shall provide, upon request of the Customs Administration of the other Contracting Party all available information regarding activities which may result in Customs offences and other illegal activities within the territory of the State of the requesting Administration.

4. The Customs Administrations of the Contracting Parties shall provide upon request the necessary data relating to the transportation and shipment of goods such as administrative, shipping, commercial documents or any other information regarding the value, origin and the destination of these goods.

5. The Customs Administrations of the Contracting Parties, upon request and within the scope of their competence and capacity, exert special surveillance for a certain period of time on the movements of goods, known or suspected

to be the object of Customs offences, including movements of persons and means of transport involved in them.

ARTICLE β Execution of requests

1. The requested Administration shall take all reasonable measures to execute the request. The provided information may be transmitted by electronic means. The transmission shall contain explanations, necessary for the interpretation and use of this information.

2. Requests for assistance submitted under this Article, shall be executed in accordance with the legislation in force in the territory of the State of the

requested Administration. In case that the execution of the request is not possible, the requested Administration informs the requesting Administration in relation to that.

3. The Customs Administration of one Contracting Party may, following a request submitted by the Customs Administration of the other Contracting Party, carry out all necessary customs investigations, including the questioning of experts, witnesses or persons suspected of having committed Customs offences.

4. The Customs Administration of one Contracting Party may, following a request submitted by the Customs Administration of the other Contracting Party, proceedjiQ':^^c^ij, coritrbf-lil^d^^^g^n jn order to find out facts related tb?cis§:fejiing under the sqQp^pj^his Agreement and for which the requested AdmilisJraJioil^ competent ™| \

5. With theiconsient ofjthe requested Admrnistratlbn, officials of the requesting Administra^on^ayiiave consultation with officials in Uie.territory of the State of the requested Administration in re|a|on. |o^ customs investigations or reports about Custorris offences of interest ito %ie requesting Administration and may examine the releyant data. ·','£ 16. In cases where the .requesting Adminisira|ion .submits a request for

assistance which itself would be unable ttf iSxecute, it shall then be to the discretion of the requested Administration to decide about its execution and inform the requesting Administration about this fact.

ARTICLE 7 Confidentiality

1. Intelligence, documents and other information received in the framework of the provisions of mutual assistance may be used by the receiving Contracting Party solely for the purposes defined in the present Agreement and only by the competent authorities, including their use in judicial or administrative proceedings. Such intelligence, documents and other information may be used by the receiving Contracting Party for other purposes only with the consent of the providing Contracting Party for that.

2. Intelligence, documents and other information received under this Agreement shall be treated as confidential and shall not be communicated to any person, except as provided for in this Agreement.

3. Intelligence, documents or other information provided on the basis of this Agreement shall be accorded the same degree of confidentiality that the receiving Contracting Party applies as regards intelligence, documents and other information obtained in its territory.

4. The provisions of paragraph 2 of this Article shall not apply to cases concerning offences relating, to narcotic drugs, psychotropic substances or substances substituted for them. Such information may be communicated to other authorities of the requesting Contracting Party directly involved in combating illicit traffic in narcotic drugs, psychotropic substances or substances substituted for them.

5. In cases where personal data are exchanged under this Agreement, the Contracting Parties shall provide the same protection as that applied by the Contracting Party furnishing them, in accordance with the legislation in force in the territory of its State.

2. Files, documents and . other data which have been transmitted shall be returned at thaearlie§t Opportunity.

3. The rights of the requested Administration or of third Parties mentioned in the files and documents shall remain unaffected.

ARTICLE 9 Experts and witnesses

1. The Customs Administration of one Contracting Party may authorize its officials, upon request of the Customs Administration of the other Contracting Party, to appear as experts or witnesses in judicial or administrative proceedings relating to the issues covered by the present Agreement in the territory of the State of the other Contracting Party and produce files, documents or certified copies there of, as may be needed for the proceedings. The request for appearance must indicate specifically before which judicial or administrative authority the official will have to appear, on what matters and by virtue of what title or qualification the official will be questioned.

2. The requesting Administration is duty bound to take all necessary measures for the full protection of the personal security of the officials during their stay in its territory and the confidentiality of the testimony, under paragraph 1 of this Article. The transport and the daily expenses of these officials shall be covered by the requesting Administration.

3. The request for appearance of Customs officials as experts and witnesses shall be made in accordance with the legislation of the States of the Contracting Parties.

ARTICLE 10

Exceptions to the obligation to provide assistance

1. In cases where the requested Contracting Party considers that execution of the request might infringe the sovereignty, seeut|% public order or any other substantial interests of its State or violate an'Industrial, commercial or professional secret^^^|n^e m'aV'b^^f^^^^^yided subject to certain conditions or '^^twOBB^'i^ t^dsdf! 3. In cases where assistance is refused or'postponed, the reasons for the refusal or postoonebent shall be given in*2^rien;fbrm to the requesting Administration without Belay, * . , -·^ ~"άΦ

ARTICLE 11 CoSts of assistance

The Contracting Parties mutually waive any claim for reimbursement of costs incurred during the implementation of this Agreement, except for expenses for witnesses and fees for experts and translators who are not government officials, which shall be covered by the requesting Contracting Party.

ARTICLE 12 Implementation of the Agreement

1. Competent authorities for the implementation of this Agreement are the Customs Administrations of the Contracting Parties which shall communicate directly in order to settle matters arising from this Agreement and which after consultations, if necessary, issue administrative directives for the implementation of this Agreement and endeavour by mutual accord to resolve problems or questions arising from its interpretation or during its implementation.

2. The Contracting Parties agree to meet at least once a year in order to review the implementation of this Agreement, unless they mutually agree, in writing, that such meetings are not necessary.

3. Upon the Contracting Parties mutual consent, amendments or additions may be introduced to this Agreement. These amendments or additions shall enter into force according to the procedure described in Article 14 of this Agreement.

ARTICLE U ' ν Entry into force and termination ;■

1. This Agreement shall enter into force on the thirtieth day following the date on which the Contracting Parties have notified eacn other in writing through diplomatic channels that all internal requirements for its entry into force have been met.

2. This Agreement is concluded for an unspecified period of time.

3. This Agreement shall be terminated on written notification of one of the Contracting Parties, through diplomatic channels. In this case it shall cease to be in force six months after receipt of such notification. Ongoing proceedings at the time of termination shall nonetheless be completed in accordance with the provisions of this Agreement.

Done at Athens on June 12 in two originals, in the Greek, Moldavian and English languages, all texts being equally authentic. In case of divergence in interpretation the English text shall prevail.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει με τη δημοσίευση του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται, από την πλήρωση των προϋποθέσεων του άρθρου 14 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.

' Σημειώνεται ότι φωτοαντίγραφα διπλοτύπων, ταχυδρομικές Επιταγές για την εξόφληση της συνδρομής, δεν γίνονται δεκτά και θα επιστρέφονται.

' Οι οργανισμοί τοπικής αυτοδιοίκησης, τα νομικά πρόσωπα δημοσίου δικαίου, τα μέλη της Ένωσης Ιδιοκτητών Ημερησίου Τύπου Αθηνών και Επαρχίας, οι τηλεοπτικοί και ραδιοφωνικοί σταθμοί, η Ε.Σ.Η.Ε.Α., τα τριτοβάθμια συνδικαλιστικά Όργανα και οι τριτοβάθμιες επαγγελματικές ενώσεις δικαιούνται έκπτωσης πενήντα τοις εκατό (50%) επί της ετήσιας συνδρομής (τρέχον έτος + παλαιότητα).

' Το ποσό υπέρ Τ.Α.Π.Ε.Τ. [5% επί του ποσού συνδρομής (τρέχον έτος + παλαιότητα)], καταβάλλεται ολόκληρο (Κ.Α.Ε. 3512) και υπολογίζεται πριν την έκπτωση.

Στην Ταχυδρομική συνδρομή του τεύχους Α.Σ.Ε.Π. δεν γίνεται έκπτωση.

Οι πολίτες έχουν τη δυνατότητα ελεύθερης ανάγνωσης των δημοσιευμάτων που καταχωρούνται σε όλα τα τεύχη της Εφημερίδας της Κυβερνήσεως πλην εκείνων που καταχωρούνται στο τεύχος Α.Ε.-Ε.Π.Ε και Γ.Ε.ΜΗ., από την ιστοσελίδα του Εθνικού Τυπογραφείου (www.et.gr).

Οι υπηρεσίες εξυπηρέτησης πολιτών λειτουργούν καθημερινά από 08:00 μέχρι 13:00
