Κύρωση της Συμφωνίας Αεροπορικών Μεταφορών, μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ρωσικής Ομοσπονδίας.
Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ
Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή: Άρθρο πρώτο
Κυρώνεται και έχει την ισχύ που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος η Συμφωνία αεροπορικών μεταφορών μεταξύ της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ρωσικής Ομοσπονδίας που υπογράφηκε στην Αθήνα στις 6 Δεκεμβρίου 2001, της οποίας το κείμενο σε πρωτότυπο στην ελληνική και αγγλική γλώσσα έχει ως εξής:

της Κυβέρνησης της Ελληνικής Δημοκρατίας και της Κυβέρνησης της Ρωσικής Ομοσπονδίας
ΠΡΟΟΙΜΙΟ
Η Κυβέρνηση της Ελληνικής Δημοκρατίας και η Κυβέρνηση της Ρωσικής Ομοσπονδίας καλούμενες εφεξής τα Συμβαλλόμενα Μέρη,
ΛΑΜΒΑΝΟΝΤΑΣ ΥΠΟΨΗ το γεγονός ότι η Ελληνική Δημοκρατία και η Ρωσική Ομοσπονδία αποτελούν μέρη της Σύμβασης για τη Διεθνή Πολιτική Αεροπορία, η οποία ετέθη προς υπογραφή στο Σικάγο στις 7 Δεκεμβρίου 1944,
ΕΠΙΘΥΜΟΥΣΕΣ τη σύναψη Συμφωνίας με σκοπό την εγκατάσταση αεροπορικών δρομολογίων μεταξύ και πέραν των αντίστοιχων εδαφών τους,
ΣΥΜΦΩΝΗΣΑΝ ΤΑΑΚΟΛΟΥΘΑ:
Η παρούσα Συμφωνία θα τεθεί σε ισχύ από την ημερομηνία της τελευταίας γραπτής γνωστοποίησης που επιβεβαιώνει ότι τα Συμβαλλόμενα Μέρη έχουν ολοκληρώσει όλες τις εσωτερικές τους διαδικασίες προκειμένου να τεθεί σε ισχύ η παρούσα Συμφωνία.
Από την ημερομηνία κατά την οποία η παρούσα Συμφωνία τίθεται σε ισχύ, τερματίζεται η ισχύς της «Συμφωνίας μεταξύ της Κυβερνήσεως του Βασιλείου της Ελλάδος και της Κυβερνήσεως της Ενώσεως Σοβιετικών Σοσιαλιστικών Δημοκρατιών», που υπεγράφη στις 22 Ιανουαρίου 1973, καθώς και όλων των συμπληρώσεων, Παραρτημάτων και τροποποιήσεων της ως άνω Συμφωνίας όσον αφορά τις σχέσεις μεταξύ της Ελληνικής Δημοκρατίας και της Ρωσικής Ομοσπονδίας.
Έγινε στην Αθήνα την 6.12.2001 σε δύο (2) αντίτυπα στην ελληνική, ρωσική και αγγλική γλώσσα και τα τρία κείμενα θεωρούμενα εξίσου αυθεντικά.
Σε περίπτωση διαφοράς στην ερμηνεία θα υπερισχύει το αγγλικό κείμενο.

Σημειώσεις:
α) Ενδιάμεσα σημεία και σημεία πέραν μπορούν να παραλειφθούν από τις διορισμένες αεροπορικές εταιρείες κατά τη διακριτική τους ευχέρεια.
β) Η εξυπηρέτηση δύο διαδοχικών σημείων στην επικράτεια του άλλου Συμβαλλόμενου Μέρους δεν επιτρέπεται.
γ) Το δικαίωμα των διορισμένων αεροπορικών εταιρειών του ενός Συμβαλλόμενου Μέρους να μεταφέρει επιβάτες, φορτίο και ταχυδρομείο μεταξύ σημείων στην επικράτεια του Κράτους του άλλου Συμβαλλόμενου Μέρους και σημείων στην επικράτεια τρίτων χωρών θα υπόκειται σε συμφωνία μεταξύ των Αεροπορικών Αρχών.
δ) Μία μόνο αεροπορική εταιρεία κάθε Συμβαλλόμενου Μέρους μπορεί να διορισθεί για την εξυπηρέτηση των τακτικών δρομολογίων ανά ζεύγος πόλεων επί των διαδρομών που αναφέρονται στις παραγράφους 1 και 2 του ανωτέρω ΠΑΡΑΡΤΗΜΑΤΟΣ.
ε) Οι διορισμένες αεροπορικές εταιρείες κάθε Συμβαλλόμενου Μέρους θα έχουν το δικαίωμα πραγματοποίησης έως επτά εβδομαδιαίων συχνοτήτων σε κάθε διαδρομή. Ο αριθμός των συχνοτήτων μπορεί να αλλάξει με συμφωνία των Αεροπορικών Αρχών των Συμβαλλόμενων Μερών.
στ) Αναφορικά με τους περιορισμούς χωρητικότητας οι διορισμένες αεροπορικές εταιρείες μπορούν να χρησιμοποιήσουν κάθε τύπου υποηχητικά αεροσκάφη επιβατών (τα οποία να μην υπερβαίνουν τις πεντακόσιες (500) θέσεις) και φορτίου σύμφωνα με τους νόμους και κανονισμούς κάθε Συμβαλλόμενου Μέρους.
ζ) Κάθε είδους συμφωνίες εμπορικής συνεργασίας, όπως κοινής εκμετάλλευσης, προκράτησης θέσεων και χρήσης κοινού κωδικού με αεροπορικές εταιρείες τρίτων χωρών θα υπόκεινται σε ειδική συμφωνία μεταξύ των Αεροπορικών Αρχών και των δύο Συμβαλλόμενων Μερών. Τέτοιες συμφωνίες μεταξύ των διορισμένων αεροπορικών εταιρειών των Συμβαλλόμενων Μερών θα εγκρίνονται από τις Αεροπορικές Αρχές των δύο Συμβαλλόμενων Μερών.
η) Η εκτέλεση αεροπορικών δρομολογίων με μισθωμένα αεροσκάφη και πλήρωμα θα εγκρίνεται από τις Αεροπορικές Αρχές κάθε Συμβαλλόμενου Μέρους.
θ) Αιτήματα για ναυλωμένες πτήσεις, πρόσθετες και μη τακτικές πτήσεις θα υποβάλλονται στις Αεροπορικές Αρχές τουλάχιστον εβδομήντα δύο (72) ώρες πριν την αναχώρηση εκτός Σαββάτου - Κυριακής και εορτών.
ι) Οι ναυλωμένες πτήσεις κλειστού κύκλου περιήγησης από την επικράτεια του Κράτους του άλλου Συμβαλλόμενου Μέρους δεν επιτρέπονται.
κ) Κατά την αξιολόγηση θεμάτων που αφορούν τις ναυλωμένες πτήσεις μη διορισμένων εταιρειών επί συμφωνημένων διαδρομών μεταξύ των Συμβαλλόμενων Μερών τις οποίες εκμεταλλεύονται οι διορισμένες αεροπορικές εταιρείες, οι Αεροπορικές Αρχές θα λαμβάνουν υπόψη τα συμφέροντα των διορισμένων αεροπορικών εταιρειών ώστε να μην επηρεασθεί δυσμενώς η δυνατότητα τους να προσφέρουν δρομολόγια στις ως άνω διαδρομές.
λ) Μη διορισμένες αεροπορικές εταιρείες μπορούν επίσης να εκτελούν ναυλωμένες πτήσεις μεταξύ σημείων στην επικράτεια των Κρατών των Συμβαλλόμενων Μερών σε διαδρομές που δεν αναφέρονται στο ως άνω Παράρτημα.
μ) Αναφορικά με τις διατάξεις του Άρθρου 2 της Συμφωνίας οι διορισμένες και μη διορισμένες ελληνικές αεροπορικές εταιρείες μπορούν να υπερίπτανται του Ευρωπαϊκού Τμήματος της επικράτειας της Ρωσικής Ομοσπονδίας στις διαδρομές που έχουν καθορισθεί για διεθνή αεροπορικά δρομολόγια και είναι στη διάθεση κάθε άλλης ξένης αεροπορικής εταιρείας χωρίς προσγείωση ή με προσγείωση για λόγους μη εμπορικούς στην επικράτεια της Ρωσικής Ομοσπονδίας συμπεριλαμβανομένων των διαδρομών που ακολουθούν μια γραμμή Νότια της Μό-σχας-Όρενμπουργκ και πέραν μέσω Τασκένδης, καθώς και μέσω των περιοχών Νότια των Ιμαλαίων.
Κάθε εκμετάλλευση σε Υπερσιβηρικές, Υπερασιατικές διαδρομές και διαδρομές υπεράνω των πόλων θα υπόκειται σε ειδική συμφωνία μεταξύ των Αεροπορικών Αρχών.
Αναφορικά με τις διατάξεις του Άρθρου 2 της Συμφωνίας οι Ρωσικές διορισμένες και μη διορισμένες αεροπορικές εταιρείες μπορούν να υπερίπτανται της επικράτειας της Ελληνικής Δημοκρατίας σε διαδρομές που έχουν καθορισθεί για διεθνή αεροπορικά δρομολόγια και είναι στη διάθεση κάθε άλλης ξένης αεροπορικής εταιρείας χωρίς προσγείωση ή με προσγείωση για λόγους μη εμπορικούς στην επικράτεια της Ελληνικής Δημοκρατίας.

d) "designated airline", - an airline which has been designated and authorized in accordance with the provisions of Article 3 of the present Agreement.
e) "capacity" in relation to an aircraft, the payload of that aircraft available on a route or section of a route and the term "capacity" in relation to "an agreed service" means, the capacity of the aircraft used on such service, multiplied by the frequency operated by such aircraft over a given period and a route or section of a route.
f) "territory" - land areas, internal waters, territorial sea and air space above them under the sovereignty of that State according to the meaning of Article 2 of the Convention. ·.-,.■■'■'
g) "air service", "international air service", "ahline" and "stop for non-traffic purposes" shall have the meanings respectively assigned to them in Article 96 of the Convention. .
h) "tariff' - the prices to be paid for the carriage of passengers, baggage and cargo and conditions for agency and other auxiliary services under which these prices apply, but excluding remuneration and conditions for the carriage

It is understood that the titles given to the Articles of the present Agreement do in no way restrict or extend the meanings of any of the provisions of the present Agreement. ~
.. t:^^>Article'2----:::^-A · Grant of Rights
1. In accordancefv^ffi. provisions'of the Annex to the present Agreement the airlines by each Contracting Party shall enjoy while operating international air service on a specified route''me foUowmg^ghts:';" :
a) to fry across thel territory of the State of the other Contracting Party without landing; /
b) to make stops m the terntory of the State of the other Contracting Party for non-traffic purposes. 5
2. Each Contracting Parry"'grants to mFoluher'Cohfractmg Party the rights specified in the' present^Agreement yfor--the/ purpose/of estabhshing and operating nitemational-.arr^r^e^ in Annex to the present Agreement (heremafteVcahW^ services" and "the specified routes" respectively). c"" "™~J
3. The designated airlines by each Contracting Party while operating international air service on a specified route in addition to the rights mentioned in paragraph 1 of this Article shall have the right to make stops in the territory of the State of the other Contacting Party at the points specified for that route in Annex to the present Agreement for the purpose of taking on and/or putting down international traffic in passengers, cargo and mail.
4. Nothing in this Article shall be deemed to confer on the designated airline of one Contacting Party the right of taking on board passengers, cargo and mail carried for hire or reward, between the points in the territory of the State of the other Contracting Party.
5. The flight routes of aircraft on the agreed services and the points for crossing national boundaries shall be established by each of the Contracting Parties within its territory.
6. The commercial matters concerning the operation of aircraft and transportation of passengers, cargo and mail on-the agreed services shall be settled by agreement between the designated airlines and if necessary shall be

'· 7. For the purposes of realising the ground technical services of its' ancraft the designated airlines of each Contracting Party may conclude the" respective agreements with the enterprises of the other Contracting Party which have the needed license to provide such service in the territory of the State of the other Contracting Party.

Designation and Authorizations
1. Each Contracting Party shall have the right to designate, and inform, through diplomatic channels the other Contracting Party, an ahline or airlines according to the provision's ; of . the Annex for the purpose of operating the agreed services on the specified routes, and to withdraw or alter such designation.
2. On receipt of such designation, the competent authorities of the other Contracting Party shall, subject to the provisions of paragraphs 3 and 4 of the present Article, grant without delay to the airline so designated, the appropriate operating aumorizatiori. \ \-^SB^L3. The AeroriautiCjal^AuthorM may require that the airline designated by^e^eJConh^c^g^ar^proves to be qualified to fulfil the conditions prescnt)Vd'^d^th|^e^slation normally appUed to the operation of international air services by sucH~authorities in conformity with the provisions of the Convention.
4. Each Contracting Party shall have the right to refuse to grant the operating authorization referred to in paragraph 2 of this Article, or to impose such conditions as it may deem necessary on the exercise by the designated airline of the rights specified in Article 2 of the present Agreement, in any case, where the said Contracting Party is not satisfied that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in the nationals of such Contracting Party, or both.
. 5. At any time, after the provisions of paragraph (1) and (2) of this Article have been complied with, the airline so designated and authorized may start to operate the agreed services provided that such services shall not be operated unless a tariff established in accordance with the provisions of Article 13 of this Agreement is in force in respect of those services.
Article 4 Suspension and Revocation
1. -Each Contacting Part^ sr^ me right to revoke an operating aumbnzatldn or to suspend me iexefcise^of me" rights specified in Article 2 of this "Agreement by the airline designated by the other Contacting Party, or to impose such conditions, as it may deem necessary on the exercise of these rights in any case, where:
a) such airline is unable^to^rove^iat^it ^qualified to fulfil the conditions prescribed under the 'legislation normally and reasonably applied to the operation of international air services by these Authorities in conformity with the Convention; or, >
b) it is not satisfied-'that substantial ownership and effective control of that airline are vested in ,the Gonfcicbng-Party .designating the airline or in its State nationals; or, ;'. i

2. Unless mnnediate^re^cation/ pr-suspension or imposition ot the conditions mentioned in paragfaph^l-of^ttis* Article is essential to prevent further infringements of legislation, such right shall be exercised only after consultation between the Aeronautical Authorities in conformity with Article 15 of this Agreement.
Article 5
Applicability of laws and Regulations
1. The legislation of the State of the Contracting Party relating to entering into, remaining in or departing from its territory of aircraft engaged in international air navigation or to the operation and navigation of such , aircraft shall be complied with by the designated airline of the other Contracting Party upon entrance into, while within and departure from the said territory.
' 2. .The legislation of the State of one Contracting Party respecting entry, clearance, staying or transit, emigration or immigration, passports, customs, currency and quarantine shall be complied with by the designated airline of the other Contracting Party and by or on behalf of its crews, passengers, cargo and mail upon transit of, admission to, while withmarid departure from the territory of such Contracting Party.
3. Passengers, baggage and cargo :m'<hrect transit'a'CT the State of one Coritractmg Party of the airport
reserved for such purpose shall, except m respect of security measures against acts of violence and air piracy, as well as transportation of narcotics, be subject to no more than a simplified control. Baggage and cargo in direct transit shall be exempt from the imposition of customs duties, taxes and charges.
Charges for the services ^performed, storage and customs clearance shall be charged in accordance ^&.-me~mtemal3egislation of the Contacting Parties. /'·/"* ,: ·
,. Article 6
Recognition of Certificates and Licenses
1. Certificates of airworthiness, certificates of competency and licenses issued or rendered valid by one Contracting Party, and still in force, shall be recognized as valid by the other-.^Otiac^gVs^JoT the purpose of operating services provided for in this Agreement, provided that the requirements under which such certificates or licenses were issued or rendered valid are equal to or above the rmrnminri ?stanriard^whicn are'orlnay be established pursuant to the Convention. 2. If the privileges or conditions of the hcenses or certificates referred to in .paragraph (lj above, issued by the Aeronautical Authorities of one Contracting Party to any person or designated airline or in respect of an aircraft operating the agreed services on the specified routes would permit a clifference from the standards established under the Convention, and which difference has been filed with the International Civil Aviation Organization, the Aeronautical Authorities of the other Contracting Party may request consultations in accordance with Article 15 of this Agreement with the Aeronautical Authorities of that Contracting Party with a view to satisfying themselves that the practice in question is acceptable to them. Failure to reach a satisfactory agreement will constitute grounds for the application of Article 4 of this Agreement.
Article 7 Aviation Safety Provisions
ί. Each Contracting Party may request consultations at any time concerning safety standards in any area relating to aircrew, aircraft or their operation adopted by the other Contracting Party. Such consultations shall take place within 30 days of that request.
2. If, foubv^g such corisultati

3. Notwithstanding the obligations mentioned in Article 33 of the Convention it is agreed that any aircraft operated by the airline or airlines of one Contacting Party on services to or from the territory of another Contacting Party may, while within the territory of the other Contacting Party, be made the subject of an examination by the authorised representatives of the other Contacting Party, on board, and around the aircraft to check both the vahdity of the aircraft documents and those of its crew and the apparent condition of the , aircraft and; its ; equipment :(in this Article called "ramp inspection"), provided this does not lead to unreasonable delay.
4. If any such inspection or series of such inspectionsgives rise to:
a) serious concerns mat'ahwauOraftj an aircraft does not comply with the minimum standards;:eslab1islied at that time pursuant to the Convention, or b) serious concerns that there is a lack of effective maintenance and administation of safety standards estabUshed at that time pursuant to the Convention,
the Contacting Party carrying out the inspection shall, for the purposes of Article 33 of the Convention, be free to conclude that the requirements under which the certificate or licences on respect of that aircraft or in respect of the crew of that aircraft had been issued or rendered valid, or that the requirements under which that aircraft, is operated, are not equal to or above the minimum standards estabUshed pursuant to the Convention.
5. In the event that access for the purpose of undertaking a ramp inspection of an aircraft operated by the airhne or airUnes of one Contacting Party in accordance with paragraph 3 above is denied by the representative of that airhne or airlines, the other Contacting Party shall be free to infer that serious "concerns of the type referred to in paragraph 4 above arise and draw the conclusions referred in that paragraph.
.6.; EacK; Contracting* Party reserves the right tolsuspend - or- vary.. the Operating authorisation of an amine or amines of me "Other Contracting Party immediately in the event the first Contracting Party concludes, whether as a result, of aramp inspection, a series of ramp inspections, a denial of access for ramp inspection, consultation or otherwise, that immediate action is essential to the safety of an airline operation.
7. Any action by one Contracting Parkin accordance with paragraphs 2 or 6 above shall be m^continued-ohce mejbasis tfor the taking of that action ceases to exist. .·-:1.U~Z :z~^ .
Article 8 : . ■ Aviation Security
1. Consistent with mentighteTand obHgations under international law, the Contracting Parties reaffirm that their obligation to each other to protect the security of civil aviation against acts of unlawful interference forms an integral part of this Agreement.': Wiffioutr;hmting '*^e/'geherality' of their rights and obHgations under international law, the Contracting Parties shall in particular act in conformity J with the . .provisions of the ,,Convention of Offences and Certain Other Acts Committed' on Board Aircraft, signed at Tokyo on 14 September 1963, the'^Convention for the Suppression^ Unlawful Seizure of Aircraft,.signed at the Hague on 16 .December!970. and the Convention for the suppression of Unlawful Acts -' agar^^m?e^Saie^-of'"Civn Aviation, signed at Montreal on 23 September 197,i^theft0tbcol."for the Suppression of Unlawful Acts Against the Safety of International Airports, signed at Montreal on 24 February 1988 and all other international instruments in the same field which may be ratified in the future by the Contracting Parties.
2. The. Contracting Parties shall provide upon request all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities, and any other threat to the security of civil aviation.
3. The Parties shall, in their mutual relations, act in conformity with the aviation security provisions and technical requirements estabUshed by the International Civil Aviation Organization and designated as Annexes to the Convention on International Civil Aviation to the extent that such security provisions and technical requirements are apphcable to the Parties; they shaU require that operators of aircraft of their registry or operators of aircraft who have their principal place of business or permanent residence in the territory of their States and the operators of international airports in their territory act in conformity with such aviation security provisions.

loading. Each Contracting Party"shall also give "positive consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat.
5. When an incident or threat , of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew,"airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such incident or threat thereof Λ ,.: "'"*·'-.*. :t] ::·--::·
Article 9 -Commercial Opportunities
1. The designated airline of one Contracting Party shall have the right to maintain its own representation in the territory of the State of the other Contracting Party.
2. The designated airline of one Contacting Party may, in accordance with the legislation of the other Party relating to entry, residence and employment, bring in and maintain in the territory of the State of the other Contracting Party managerial, sales, technical, operational and other specialist staff required for the provision of air services.
3. In case of nomination of a general agent or a general sales agent, this agent shall be appointed in accordance with the relevant applicable legislation of each Contacting Party.
4. Each designated akline shall have the right to engage in the sale of air tansportation using its own tansportation documents in the territory of the State of the other Contacting Party directly or through its agents and anyone shall be able to purchase such tansportation in accordance with the national legislation. r *
5. EachContracting Party shall grant to the designated airlines of .me other
Contract'ag*-Party 'the; right-.to transfer freely the excess^of ireceiptsfbver expenditure ^earned by the smd'mrlmes^'cormecu^
mterhational air services. The said tansfer shall be made m haro! currency according to the official exchange fate vahd for me o!ate and in
accordance with the financial legislation of the State of the Contracting Party, from which territory the transfer is made. - ?^ψ6. The provisions of the present Article do not affect the issues of taxation that are the subject of other agreement between φβ Contracting Parties.
7. If one Contracting Party imposes restrictions on the transfer of the excess of receipts achieved by the designated airline of the other Contracting Party the other Contracting Party will also have the right to impose the same restrictions to the other party's airline. :; J:.

;..:.; Customs Duties
1. Aircraft operated onJhe agreed services by the designated airlines of one Contacting Party; as well"as their regular equipment, spare parts, supplies of fuel and lubricants^ aircraft sfores' (including food, beverages and tobacco) on board the aircraft shall be exemptedfrom-the imposition of customs duties, taxes and other similar .payments .and/fees-on arriving m the territory of the State of the other Contacting JPar^provided"such equipment, spare parts, supphes and stores remain on board the aircraft up to such time as they are reexported.
2. There shall also be exempted from the imposition of customs duties, taxes and other similar payments and fees:
a) aircraft stores taken oh board in the territory of the State of one Contacting Party, v/ithin limits fixed by the authorities of the said Contacting Party, and for use on board the aircraft operated on the agreed services by the designated airline of the other Contacting Party;
b) equipment and spare parts intoduced into the territory of the State of one Contacting Party for the technical maintenance or repair of aircraft engaged in operation on agreed services by the designated airline of the other Contacting Party;
c) fuel and lubricants, intended for use in the operation of the agreed services by aircraft of the designated airline of one Contacting Party, if these aircraft stores are used on the part of the route„r within the territory of the State of the other Contacting Party where they are taken aboard;
d) the necessary documents with the airline's symbol used . by the designated anlines of the pmef 'Conhactmg Party mclucimg"ra^ bills that are imported or being imported, by the designated airlines of one Contracting Party to the territory of the State of the other Contracting Party in connection with the operation of the agreed services.
3. It is prohibited to use materials, supplies and spare parts as well as documents referred to in paragraph 2 of this Article above for other purposes than that directly specified in thi^s pafagjraph?The above mentioned objects may be required to be kept under Customs supervision or control in accordance with the internal legislation of the Contracting Parties.
4. Regular aircraft equipment; the materials, supplies and spare parts retained on board the aircraft operated by designated airlines of one Contracting Party on the agreed services, may be unloaded in the territory of the State of the other Contracting Party only with the approval of the Customs authorities of that Contracting Party. In such case they may be placed under the supervision of the said authorities up to such time as they are re-exported or otherwise disposed of in accordance with Customs regulations.

Article 11 ; User Charges
Fees and other charges for the use of each airport mcluding its installations, technical and other facilities and services as well as any charges for the use of air navigation facilities, communication faculties and services shall be made in accordance with the rates and tariffs established by each Contacting Party on the territory of its State, in accordance with the Convention.
Article 12
Capacity Regulations and Approval of Timetables
1. The designated airlines of the Contracting Parties shall be afforded fair and equal treatment in order that they may enjoy equal opportunities in the operation of the agreed services on the specified routes.
2. In operating the agreed services the designated airlines of each Contacting Party shall take into account the interests of the designated aklines of the other Contacting Party so as not to affect the services which the latter provides on the whole or any part of the same routes.

on the agreed services sliall-be-agreed upon^by the""Aeronautical Authorities upon recommendation made by designated airlines. "The designated airlines shall make such rccommendation'after due* consultations between them taking into account the principles laid down in paragraphsi 1.2 and 3 of this Article.
5. Id case of disagreeing^ of the Contracting Parties 'the ^issues referred to in paragraph 4 above shall be resolved by agreement ^between the Aeronautical Authorities of the two Contracting Parties. Until ;suchagreement has been reached- the capacity provided by the designated airlines""shall remaM"uhchanged.
6. The designated auline-of each Contracting' Party shall submit for approval to the Aeronautical Authonties of the other Contracting Party not later than forty five (45) dayjsjpriort on the specified routes the flight timetablel^
This shall, Hkewise, apply tolater changes. In special cases, this time limit may be reduced subj ect to the approval of the said authorities.
'., 7. When air services are provided by the designated airlines of one Contracting Party between the points on the territory of the State of the other Contracting Party and the points in the third countries the granted capacity shall be made in accordance with the general principles that capacity shall be related to the requirements of:
a) traffic between the countries of origin and destination;
b) traffic of the area through which the agreed services pass; and
c) through airline operations.
Article 13 Air Transport Tariffs .
iiil; The tariffs to be charged by^me Contacting Parties for
the agreed services shall be estabhshjd at reasonable levels, due regard being paid to all relevant factors including cost of operation, reasonable profit, characteristics of service and, where it is deemed suitable, the tariffs of other airlines operating scheduled services over th^whole or part of the same routes. :
2. The tariffs referred to^in paragraph 1 of this Article shall be estabhshed according to the foUowing rules":
a) When the designated airlines of both Contracting Parties are members of an mtemational'' ahline^ association, ; e.g;'£hitemarional Air Transport Association, with a rate -fixing rhe]chanism and^tanff resolution already exists in respect of the agreed services, the tariffs "shall be agreed upon by the designated airlines of the Contracting Parties in accordance with such tariff resolution. Unless otherwise determined in the application of this Article, each designated airline shall be responsible only'to its Aeronautical Authorities for the justification and reasonableness'!Of the tariffs so agreed.
b) When mereHs no 'lanK of the "agreed services or where either or bothsOf^the designated anmiesof the extracting Parties are not members of the samev auhne^ass^ (a) above, the designated airlines of uie-Gont^rmg!P^es%^'%ee between themselves on the tariffs to be charged in respectoTtheagreed services.
c) The tariffs so agreed upon shall be submitted for approval by the Aeronautical Authorities of the Contracting Parties at least sixty (60) days before the proposed date of their introduction. This time limit may be reduced, subject to the consent of the said Authorities.
d) In case the designated airlines of the Contracting Parties fail to agree on the tariffs to be charged, or where a Contracting Party has not designated its airline for the operating of the agreed services, or where during the first thirty (30) days of the sixty (60) days period referred to in subparagraph (c) above, the Aeronautical Authorities of a Contracting Party give the Aeronautical Authorities of the other Contracting Party notice of their dissatisfaction with any tariff agreed between the designated airlines of the Contacting Parties in accordance with subparagraphs (a) and (b) above, the Aeronautical Authorities of the Contracting Parties shall try to reach an agreement on the appropriate tariffs to be charged.
3. a) No tariff shall come into force if the Aeronautical Authorities of either Contracting Party have not approved it.

4. If the Aeronautical Authorities cannot agree on any tariff submitted to them under the provisions of this Article or the deteixnination of any tariff, the dispute shall be settled in accordance with the provisions of Article 16 of the present Agreement.
5. If the Aeronauticalv-Authorihes-^pfsOne of the Contracting Parties become dissatisfied with :yari:;^estabhshed'' ^tanf^'vthey shall so notify the Aeronautical Authorities of the other Contracting Party and the designated airlines shall attempt," where required, to reach an agreement. If within the period of ninety (90) days from, the day of receipt of such notification a new tariff cannot be estabhshed in accordance with the provisions of paragraphs (2) and (3) of this Article, the procedures as set out in paragraph (4) of this Article shall apply.
; Article 14 / : ·: Supply of Statistics
The Aeronautical.-AMorities -of eimer Contracting Party shall supply to the Aeronautical Authorities of the "other Contracting Party, at their request, such information an'd^stiuistics"relatiti^ on the agreed
services by the designated juri^^ Party to and from the
territory of the State of the5 ofer-Contracting Party as may normally be prepared and submitted by the designated airline to their National Aeronautical Authorities.
Article 15 Consultations and Modifications
1. Each Contracting Party or its Aeronautical Authorities may at any time request consultations with the other Contracting Party or with its Aeronautical Authorities.
2. A consultation requested by one of the Contracting Parties or their Aeronautical Authorities shall begin within a period of sixty (60) days of the date of receipt of the request.
3. Any modification to this Agreement shall enter into force when the two Contracting Parties will have notified each other of the fulfillment of their constitutional procedures relating to the conclusion and the entering into force of international agreements/

Article 16 Settlement of Disputes
1. If any dispute arises^, between,ώβ"Contracting Parties relating to the interpretation or appUcation^pfcmisvA^ement^andits Annex, the Contracting Parties shall in me first place try to settle it by negotiation between Aeronautical Authorities of both Contracting Parties.
2. If the said Aeronautical jAumorities; fail to reach an Agreement, the dispute shall be settled through'diplomatic channels.
3. If the Contracting Parties fail to reach a settlement pursuant to paragraphs 1 and 2 above,-the.dispute shall.be(link is external) referred to a Tribunal of three arbitrators, one to .be nominated by each Contracting Party and the third to be agreed upon by the two' so nominated. Each of the Contracting Parties shall nominate an arbitrator withmt a .period ·''of .sixty, (60) days from the date of receipt by eimer \^ notice, through diplomatic chanuels^re^ such a Tribunal and me third arbitrator -shM-be /ap^oint^^thm'a'ft^er period of sixty (60) days. If either of the Contraclhnl^ its arbitrator within the period specified, the Presidenfof the Council of the International Civil Aviation Organization may be requested by either Contracting Party to appoint an arbitrator or arbitrators as the case may require ; provided that if the President of the Council of the International Civil Aviation Organization is a national of either Contracting Party, the senior Vice-President of the Council or if he is such a national, the Senior Member of the Council who is not such a national may be requested to make the appointments as the case may be. The third arbitrator, however, shall be a national of a third state and shall act as the President of the Tribunal and shall detennine the place where arbitration will be held.
4. The Tribunal shall determine its own procedures.
5. The Arbitration shall reach its decision by a majority of votes. Such decision shall be binding on both Contracting Parties. Each Contracting Party shall bear the cost of its own member as well as of its representation in the arbitrate proceedings. The cost of the chairman and any other costs shall be borne in equal parts by the Contracting Parties.

Article 17 Termination

Article 19 Registration
This Agreement and all amendments thereto shall be registered with the International Civil Aviation Organization.
Article 20 Entry into Force
The present Agreement shall enter into force on the date of the last written notification confirming that the Contracting Parties have fulfilled all their internal procedures for the entry into force of this Agreement.

g) Any type of co-operative marketing arrangements such as joint operation, block-space agreement and code-sharing operations with airlines of third countries will be subject to a special agreement between the Aeronautical Authorities of both Contacting Parties. Such agreements between the designated ahlines of the Contacting Parties shall be approved by the Aeronautical Authorities of the two Contacting Parties.
h) The operation of air services by wet leased aircraft shall be approved by the Aeronautical Authorities of each Contacting Party. - - - i) The application for the charter, extta and non-scheduled flights shall be submitted to the Aeronautical Authorities at least seventy two (72) hours before departure, except weekends and holidays. j) The inclusive tour charter operation from the territory of the State of the other Contracting Party is not permitted.
k) While considering matters related to charter nights of non designated airlines on agreed routes between the Contracting Parties operated by their designated ahlines, the Aeronautical Authorities shall take into account the interests of the designated airlines so as not to affect unduly their opportunity to offer services on the above mentioned routes.

Any operation on Trans-Siberian, Trans^Polar, Trans-Asian Routes shall be subject to a special agreement between the Aeronautical Authorities.
With reference to^;me"provisions ,of Article .2 of the Agreement Russian designated as well as χν^^ύψ^^^^-ΰ^-ον^χ^ the territory of the
Hellenic Republic on routes aumorised*fbr;mternational air services and available for any other foreign carrier without landing or with landing for non-traffic purposes on the territory of the Hellenic Republic.

Το κόστος για την ετήσια συνδρομή σε ηλεκτρονική μορφή για τα προηγούμενα έτη προσαυξάνεται πέραν του ποσού της ετήσιας συνδρομής του έτους 2002 κατά 6 euro ανά έτος παλαιότητας και κατά τεύχος
* Οι συνδρομές του εσωτερικού προπληρώνονται στις ΔΟΥ που δίνουν αποδεικτικό είσπραξης (διπλότυπο) το οποίο με τη φροντίδα του ενδιαφερομένου πρέπει να στέλνεται στην Υπηρεσία του Εθνικού Τυπογραφείου.
* Η πληρωμή του υπέρ ΤΑΠΕΤ ποσοστού που αντιστοιχεί σε συνδρομές, εισπράττεται και από τις ΔΟΥ.
* Οι συνδρομητές του εξωτερικού έχουν τη δυνατότητα λήψης των δημοσιευμάτων μέσω internet, με την καταβολή των αντίστοιχων ποσών συνδρομής και ΤΑΠΕΤ.
* Οι Νομαρχιακές Αυτοδιοικήσεις, οι Δήμοι, οι Κοινότητες ως και οι επιχειρήσεις αυτών πληρώνουν το μισό χρηματικό ποσό της συνδρομής και ολόκληρο το ποσό υπέρ του ΤΑΠΕΤ.
* Η συνδρομή ισχύει για ένα χρόνο, που αρχίζει την 1η Ιανουαρίου και λήγει την 31η Δεκεμβρίου του ίδιου χρόνου. Δεν εγγράφονται συνδρομητές για μικρότερο χρονικό διάστημα.
* Η εγγραφή ή ανανέωση της συνδρομής πραγματοποιείται το αργότερο μέχρι τον Φεβρουάριο κάθε έτους.
* Αντίγραφα διπλοτύπων, ταχυδρομικές επιταγές και χρηματικά γραμμάτια δεν γίνονται δεκτά.
