Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ

Εκδίδομε τον ακόλουθο νόμο που ψήφισε η Βουλή: Άρθρο πρώτο

Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η Συμφωνία μεταξύ του Υπουργείου Εθνικής Άμυνας της Ελληνικής Δημοκρατίας και του Υπουργείου Άμυνας της Δημοκρατίας της Τυνησίας για τη συμμετοχή στο Πολυεθνικό Κέντρο Εκπαίδευσης Επιχειρήσεων Υποστήριξης της Ειρήνης (Π.Κ.Ε.Ε.Υ.Ε.), που υπογράφηκε στην Αθήνα στις 2 Σεπτεμβρίου 2002, της οποίας το κείμενο σε πρωτότυπο στην ελληνική και αγγλική γλώσσα έχει ως εξής:

ΤΟΥ ΥΠΟΥΡΓΕΙΟΥ ΑΜΥΝΑΣ ΤΗΣ ΔΗΜΟΚΡΑΤΙΑΣ ΤΗΣ ΤΥΝΗΣΙΑΣ

ΓΙΑ ΤΗΝ ΣΥΜΜΕΤΟΧΗ ΣΤΟ ΠΟΛΥΕΘΝΙΚΟ ΚΕΝΤΡΟ ΕΚΠΑΙΔΕΥΣΗΣ ΕΠΙΧΕΙΡΗ ΣΕΩΝ ΥΠΟΣΤΗΡΙΞΗΣ ΤΗΣ ΕΙΡΗΝΗΣ (MPSOTC)

Το Υπουργείο Εθνικής Άμυνας της Ελληνικής Δημοκρατίας, που εφεξής θα καλείται 'Φιλοξενόν Έθνος', και το Υπουργείο Άμυνας της Δημοκρατίας της Τυνησίας, που εφεξής θα καλείται 'Μέρος'.

Επαναδιαβεβαιώνοντας την αφοσίωση τους στους σκοπούς και τις αρχές που προβλέπονται στον Χάρτη των Ηνωμένων Εθνών.

Λαμβάνοντας υπόψη την Συμφωνία Στρατιωτικής Συνεργασίας μεταξύ του Υπουργείου Εθνικής Άμυνας της Ελληνικής Δημοκρατίας και του Υπουργείου Άμυνας της Δημοκρατίας της Τυνησίας, που έχει υπογραφεί στην Τύνιδα στις 3 Σεπτεμβρίου 1998.

Θεωρώντας ότι η ανάπτυξη αμοιβαίας συνεργασίας θα συνεισφέρει στην σταθερότητα της ευρύτερης περιοχής και θα βοηθήσει στην δημιουργία και στην βελτίωση καλών σχέσεων.

Γνωρίζοντας ότι η πολιτικο-στρατιωτική συνεργασία αποτελεί το βασικό στοιχείο ενίσχυσης των δυνατοτήτων των Ηνωμένων Εθνών στην ασφάλεια και την διατήρηση

της ειρήνης/ .

Σίγουροι ότι πρέπει να υπάρξει μία περαιτέρω εξέλιξη στην συνεργασία και τον διάλογο μεταξύ των χωρών σε θέματα Επιχειρήσεων Υποστήριξης της Ειρήνης (PSOs).

Επιθυμώντας να συμβάλλουν στην ενίσχυση της εκπαίδευσης και δια-λειτουργικότητα των ενόπλων δυνάμεων τους, σύμφωνα με τις νέες επιχειρησιακές απαιτήσεις των Επιχειρήσεων Υποστήριξης της Ειρήνης.

Συμφώνησαν στα ακόλουθα:

ΑΡΘΡΟ 11 ΔΙΑΡΚΕΙΑ

Η παρούσα Συμφωνία θα έχει αόριστη ισχύ, εκτός εάν τα Μέρη συμφωνήσουν διαφορετικά. r y

αρθρο 12

τερματισμός

1. Η παρούσα Συμφωνία μπορεί να τερματιστεί από οποιοδήποτε Μέρος ανά πάσα στιγμή.

2. Οποιοδήποτε Μέρος ενδιαφέρεται να τερματίσει την παρούσα Συμφωνία, θα στείλει μία έγγραφη ειδοποίηση στο άλλο Μέρος.

3. Ο τερματισμός θα ισχύσει ένα μήνα μετά την λήψη της έγγραφης ειδοποίησης που αναφέρεται στην παράγραφο 2 του παρόντος άρθρου.

4. Σε περίπτωση που εκκρεμούν οικονομικά ζητήματα ή αξιώσεις κατά τον χρόνο του τερματισμού, οι διατάξεις της παρούσας Συμφωνίας που αναφέρονται σε αυτά τα ζητήματα θα εξακολουθήσουν να ισχύουν, ανεξαρτήτως του τερματισμού της Συμφωνίας.

Έγινε στην Αθήνα στις 2 Σεπτεμβρίου 2002 σε δύο πρωτότυπα αντίγραφα, το κάθε ένα στην Αραβική, την Αγγλική και την Ελληνική γλώσσα, που το καθένα είναι εξίσου αυθεντικό. Σε περίπτωση διαφορών στην ερμηνεία, το Αγγλικό κείμενο θα υπερισχύει.

AGREEMENT BETWEEN

THE MINISTRY OF NATlON^&j^^CE OF THE HELLENIC REPUBLIC AND

THE MINISTRY OF PfclTE^CE OF REPUBLIC OF TUNISIA

FOR PARTICIPATION IN THE MULTINATIONAL PEACE SUPPORT OPERATIONS TRAINING CENTER (MPSOTQ

The Ministry of National Defense of the Hellenic Republic from now on called the "Host Nation" and the Ministry of Defence of the Republic of Tunisia from now on called the "Party".

Reaffirming their dedication to the purposes and principles provided by the United Nations Charter.

Taking into account the Agreement on Military co-operation between The Ministry of National Defense of the Hellenic Republic and the Ministry of Defence of the Republic of Tunisia signed in Tunis on September 3,1998,

Assuming that development of mutual cooperation will contribute to the stability of the wider region and will help to create and improve the good relations.

Knowing that the politico - military cooperation constitutes the basic element to enhance the UN capabilities in security and peacekeeping.

Confident that there must be a further development in the cooperation and the dialogue between the countries in Peace Support Operation (PSOs) issues.

Wishing to contribute in the enhancement of training and interoperability of their armed forces, according to the new operation requirements of the Peace Support Operations.

Have agreed as follows:

ARTICLE 1 AIM

The basic aim of the Multinational Peace Support Operation Training Center (hereinafter referred to as 'MPSOTC'), is to improve training according to the new operations requirements of PSOs, and to provide the appropriate venue for exchanging ideas and experiences regarding PSO issues.

ARTICLE 2 PRINCIPLES

1. The Host Party undertakes the obligation to provide for the required installations/facilities, and the appropriate infrastructure for Communications and Information Systems Support, as well as the necessary Logistic and 'Host Nation Support', for the unimpeded function of the MPSOTC and fulfillment of its mission.

2. The Host Nation and the Party (hereinafter referred to as 'the Parties') assure that the MPSOTC activities are in accordance with the purposes and principles of UN. ______

3. The participation in the MPSOTC activities is not directed against any other state, and it does not intend to train personnel or military force against any other country or group of countries.

4. Training offered by MPSOTC will be transparent. The Academic Calendar will be promulgated in time, according to article 5 para 3, to the other Party and to the international organizations.

5. The Center activities are in accordance with the EAPC founding principles, and will help the training of individuals and units from the Parties, in the accomplishment of Peace Support Operations, possibly assigned to them by international organizations.

6. This Agreement will not affect in any way the rights and obligations of the Parties, deriving from treaties and agreements that they had previously signed.

7. The Host Party retains the full right to start discussions and conclude other bilateral Agreements of similar nature with other countries or international organizations. The other Party will promptly informed upon conclusion of any such Agreement.

8. English will be the working language of MPSOTC. Interpretation services may be available in other languages, within means and capabilities, after coordination, between the Parties.

ARTICLE 3 MISSION OF MPSOTC

1. The mission of MPSOTC is, to provide high level theoretical and practical education and training, with comprehensive coverage of PSOs, to cadres (Staff Officers, Platoon Leaders, Company and Unit Commanders, Observers), as well as to multinational troops (Platoons -Companies - Units), according to current international standards.

2. In addition, the MPSOTC has the task to provide the appropriate mission oriented pre-deployment training, on all relevant aspects of PSOs, to staff officers, military observers and national or multinational contingents, before their deployment for a specific mission, as well as to their replacements .

ARTICLE 4

ESTABLISHMENT - ORGANISATION - SUBORDINATION

1. The MPSOTC is a establishment staffed with personnel of the three Branches of the Armed Forces which is subordinate to the National Defense General Staff of the Host Party.

2. The organizational chart of the MPSPTC is depicted in ANNEX 'A' which may by modified by the Host Party in accordance with the functional requirements of the MPSOTC.

3. The MPSOTC's permanent Staff (both teaching and administrative) will be consisted of military (Army, Navy, Air Force) , as well as civilian personnel.

4. The Host Party will provide all necessary military and civilian personnel, except of the following posts which should be filled by international personnel, after previous agreement between the Host Party and the interesting country and the signing of a relevant MOU:

a. Staff Officers.

b. Instructors

5. The Party may provide one (1) instructor after signing of a relevant MOU.

6. The Party maintains the right to withdraw their personnel from the MPSOTC, after a timely notice to the Host Party. This notice must be a formal written notification from the competent authority of the Party provided to the Host Party one (1) month in advance .

ARTICLE 5 TRAINING

1. The MPSOTC will provide, among others, the following courses: '

a. Multinational PSOs Officers (basic and advanced)

Course.

(1) Duration: two (2) weeks.

(2) Number of courses per year: four (4)

(3) It is designed for junior and senior officers, (training of trainers)

(4) The purpose of the course is to train and prepare officers for PSOs related duties and for tasks as military observers, election supervisors, or other PSOs missions in support of relevant international organizations.

(5) Maximum National participation per course: five (5) trainee officers.

b. Multinational PSOs companies (basic and advanced)

Course

(1) Duration of two (2) weeks. During the first week training will be conducted per platoon, while during second week per company.

(2) Number of courses per year: two (2).

(3) The purpose of the course is to train and prepare platoons and companies for participation in PSOs, either in multinational or national formations, and also to provide the necessary mission tailored pre-deployment training. Course~curriculum provides for both theoretical and practical (exercises) lessons conducted "indoor" and in the field.

(4) Minimum national participation is one organic

platoon.

c. Multinational PSOs Logistics Coarse

(1) Duration of one (1) week.

(2) Number of courses per year: One (1)

(3) The purpose of the course is to train and prepare officers from different countries for assignment as Logistic Staff Officers in Multinational Brigade HQs, or Multinational service support HQs and/or in National Contigents for the conduct of PSOs.

(4) Course curriculum provides for both theoretical and practical (exercises) lessons conducted in-door and in the field.

(5) Maximum National participation per course: five (5) trainee officers.

d. Military Observers Course

(1) Duration of one (1) week.

(2) Number of courses per year: One (1)

(3) The purpose of the course is to train and prepare officers from different countries for assignment as Military Observers in Peace Support Operations.

(4) Course curriculum provides for both theoretical and practical (exercises) lessons conducted in-door and in the field.

(5) Maximum National participation per course: five (5) trainee officers.

e. Border Securing Course

(1) Duration: one (1) week (2) Number of courses per year: One (1)

(3) The purpose of the course is to train familiarize officers and NCOs from different countries with all aspects of Border

Control regime, to be capable to establish, organize, man,^quip and train Border control units.

(4) Course curriculum provides for both theoretical and practical (exercises) lessons conducted in-door and in the field.

(5) Maximum National participation per course: five (5) trainee officers.

2. Upon graduation, the trainees will receive official course certificates, prepared by the MPSOTC .

3. During May every year, the Host Party shall provide the Academic Calendar for the next year to the Party and to international organizations.

4. The provisions of this article concerning thw courses may be modified at any time , by the Host Party, which is obliged to notify the Party six (6) months before the new provisions come into force .

ARTICLE 6 PROCEDURES

1. The necessary information concerning the size of the participation (number of cadres or troops) and the procedures of transportation, armament clearance, during entrance and exit, as well as other details, will be provided by the responsible body of the Party to the reception and transportation from the entry point to the MPSOTC.

2. The above information has to be provided at least one month before the date of arrival of the participants, by sending "Joining Report."

3. The Party may dispatch to the MPSOTC for troop training organic platoons or companies, fully equipped and will coordinate with the Host Party the structure of its contingent, as well as the arrival, accommodation and departure details.

4. The MPSOTC retains the right, during the course, to specifically organize the trainees, in order to form the suitable force for the conduct of the training.

5. Leaves or days off are normally not authorized during the course. In emergency situations and after a vvritten notification from the relevant authority of the Party, the Commandant of the MPSOTC can grant short leaves either for Greece or for the country of origin.

6. The trainees, during the course, have to wear' either duty uniforms or field uniforms, as it will be indicated in the course schedule.

7. Foreign trainees (military or civilians) should conform with the security regulations of the Host Party's Armed Forces.

ARTICLE 7 HOST NATION SUPPORT

1. Logistic support of the Center is a Host Nation responsibility.

2. Details of Host Nation Support will be defined in a separate MOU to be signed between the Parties.

3. The Host Party is responsible to keep the 'Logistic and Administrative Support Platoon' at the appropriate strength and readiness in order to provide the necessary support for the smooth function of the MPSOTC.

ARTICLE 8 SETTLEMENT OF DISPUTES

Any dispute arising during the implementation of this Agreement shall be settled by the Parties through negotiation, without recourse to any outside jurisdiction.

ARTICLE 9 AMENDMENTS

1. The Parties have the right to propose written amendments to any article of this Agreement.

2. If agreed upon by the Parties, these amendments shall enter into force according to the procedure described to Article 10 of the present Agreement.

3. The provisions of paras 1 & 2 of this article are without prejudice to articles 4 para 2 and 5 para 4 which provide for changes unilaterally effected by the Host Party.

ARTICLE 10 ENTRY INTO FORCE

This Agreement shall enter into force on the date of the exchange of diplomatic notes on the completion of internal legal procedures. However, where feasible, the Parties shall act according to the provision of this Agreement from the date of its signature.

ARTICLE 11 DURATION

This Agreement will be valid for an indefinite period of time, unless the Parties decide otherwise.

ARTICLE 12 TERMINATION

1. The present Agreement may be terminated by either Party at any time.

2. Either Party which is interested in terminating this Agreement, will send a written notification to the other Party.

3. The termination shall take effect one month after the receipt of the written notification mentioned in para 2 of this article.

4. In case of financial matters or claims pending at the time of termination, the provisions of this Agreement relating to these issues shall continue to apply notwithstanding the tennination of the Agreement.

Done in Athens on September 2nd 2002 in two originals, each in Arabic, English and Greek languages, all texts being equally authentic. In . case of differences of interpretation, the English text shall prevail.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευ-σή του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 10 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.
