Ο ΠΡΟΕΔΡΟΣ ΤΗΣ ΕΛΛΗΝΙΚΗΣ ΔΗΜΟΚΡΑΤΙΑΣ

Άρθρο πρώτο

Κυρώνεται και έχει την ισχύ, που ορίζει το άρθρο 28 παρ. 1 του Συντάγματος, η Συμφωνία μεταξύ του Υπουργείου Εθνικής Άμυνας της Ελληνικής Δημοκρατίας και του Υπουργείου Άμυνας της Δημοκρατίας της Κροατίας για τη συμμετοχή κροατικού προσωπικού στο Πολυεθνικό Κέντρο Εκπαιδεύσεως Επιχειρήσεων Υποστήριξης της Ειρήνης (Π.Κ.Ε.Ε.Υ.Ε.) που υπογράφηκε στο Ζάγκρεμπ στις 9 Σεπτεμβρίου 2002, της οποίας το κείμενο σε πρωτότυπο στην ελληνική και αγγλική γλώσσα έχει ως εξής:

ΠΡΟΟΙΜΙΟ

Το Υπουργείο Εθνικής Άμυνας της Ελληνικής Δημοκρατίας, στο εξής αποκαλούμενο ως το "Ελληνικό Μέρος", και το Υπουργείο Άμυνας της Δημοκρατίας της Κροατίας, στο εξής αποκαλούμενο ως το "Κροατικό Μέρος", συλλογικά αποκαλούμενα στο εξής ως "τα Μέρη".

Επαναβεβαιώνοντας την προσήλωση τους στους σκοπούς και τις αρχές οι οποίες προβλέπονται από τον καταστατικό χάρτη των Ηνωμένων Εθνών.

Λαμβάνοντας υπόψη τις διατάξεις της "Συμφωνίας Στρατιωτικής Συνεργασίας Μεταξύ του Υπουργείου Εθνικής Άμυνας της Ελληνικής Δημοκρατίας και του Υπουργείου Άμυνας της Δημοκρατίας της Κροατίας", η οποία υπεγράφη στην Αθήνα την 27η Ιουνίου 2000.

Πιστεύοντας ότι η ανάπτυξη αμοιβαίας συνεργασίας θα συνεισφέρει στην σταθερότητα της ευρύτερης περιοχής και θα βοηθήσει στην βελτίωση των καλών σχέσεων μεταξύ των Μερών,

Γνωρίζοντας ότι η πολιτικο - στρατιωτική συνεργασία αποτελεί το βασικό στοιχείο για τη βελτίωση των δυνατοτήτων των Ηνωμένων Εθνών στους τομείς της ασφάλεια και της διαφύλαξη της ειρήνης.

Πιστεύοντας ότι πρέπει να υπάρξει μία περαιτέρω ανάπτυξη στη συνεργασία και στο διάλογο μεταξύ των χωρών επί θεμάτων Επιχειρήσεων Υποστήριξης της Ειρήνης (EYE).

Επιθυμώντας να συνεισφέρουν στην βελτίωση της εκπαίδευσης και της διαλειτουργικότητας των ενόπλων δυνάμεων τους, σύμφωνα με τα νέα επιχειρησιακά δεδομένα των EYE.

Έχουν συμφωνήσει τα παρακάτω:

ΑΡΘΡΟ 13 ΤΕΡΜΑΤΙΣΜΟΣ

1. Η παρούσα Συμφωνία μπορεί να τερματίζεται οποιαδήποτε στιγμή από οποιοδήποτε εκ των Μερών.

2. Το Μέρος το οποίο ενδιαφέρεται για τον τερματισμό της Συμφωνίας αυτής, θα αποστείλει γραπτή ειδοποίηση προς το Υπουργείο Άμυνας του άλλου Μέρους.

3. Ο τερματισμός θα λάβει χώρα έναν (1) μήνα μετά την λήψη της ανωτέρω αναφερόμενης γραπτής ειδοποίησης.

4. Σε περίπτωση που υπάρχουν οικονομικά θέματα ή αξιώσεις οι οποίες παραμένουν ανεπίλυτες κατά την στιγμή του τερματισμού, η παρούσα Συμφωνία θα παραμένει σε ισχύ, έως ότου τα συγκεκριμένα θέματα επιλυθούν οριστικά.

Υπεγράφη στο Ζάγκρεμπ την 9 Σεπτεμβρίου 2002 σε δύο πρωτότυπα αντίτυπα, στην Ελληνική, Κροατική και Αγγλική γλώσσα, όλα εξίσου αυθεντικά. Σε περίπτωση διαφορών ως προς την ερμηνεία, το Αγγλικό κείμενο θα υπερισχύει.

ΠΑΡΑΡΤΗΜΑΤΑ

«Α» Οργανόγραμμα του ΠΚΕΕΥΕ

PREAMBLE

The Ministry of National Defense of the Hellenic Republic, hereinafter referred to as the "Hellenic Parry, and the Ministry of Defence of the Republic of Croatia, hereinafter referred to as the "Croatian Parr}'", collectively hereinafter referred to as "the Parties'\

Reaffiimrng their dedication to the purposes and principles provided by the United Nations charter.

Taking into account the provisions of the "Agreement on Mihtary Cooperation Between the Ministry of National Defence of the Hellenic Republic and the Ministry of Defence of the Republic of Croatia'', signed in Athens on June 27, 2000. "

Assuming diat development of mutual cooperation will contribute to the stability of the wider region and will help to improve good relations between the Parties.

Knowing that pohtico-military cooperation constitutes the basic element to enhance the UN capabilities in security and peacekeeping.

Confident thai there must be a further development in the cooperation and the dialogue between the countries in Peace Support Operations (PSOs) issues.

Wishing to contribute in the enhancement of training and interoperability of their armed forces, according to the new operation requirements of the PSOs.

Have agreed as follows:

ARTICLE 1 PURPOSE

The purpose of the present Agreement is to establish the legal framework that is necessary- for the participation of Croatian personnel in the "Multinational

Peace Support Operations Training Center (MPSOTC). hereinafter referred to as "the Center".

ARTICLE 2 PRINCIPLES

1. The Hellenic Party undertakes the obligation to provide for the required installations - facilities and the appropriate infrastructure for Communications and Information Systems Support, as well as the necessary Logistic and Host Nation Support, for the unimpeded function of the Center and the fulfillment of its mission.

2. The Parties assure that the activities of the Center are in accordance with the purposes and principles of UN.

3. The participation in the Center activities is not directed against any other state. Hie Center does not intend to train personnel or military force against any other country or group of countries.

4. Training offered by the Center will be transparent. The Academic Calendar will be promulgated in time, according to article 5 §3, to the Croatian Party and to the International Organizations.

5. The Center activities are in accordance with the EAPC founding principles and are also included in the framework of PfP, and will help the training of individuals and units from the Parties, in the accomplishment of PSOs possibly assigned to them by International Organizations.

6. This Agreement will not affect in any way the rights and obligations of tlie Parties, deriving from treaties and agreements that they have signed.

7. The Hellenic Parry retains the full right to start discussions and sign odier bilateral Agreements of similar nature with other countries or International Tlrganizations. The Croatian Party will be promptly informed upon the signature of any such Agreement.

8. English will be the working language of the Center, Interpretation services might be available in oilier languages, within the means and capabilities of the Center, after coordination between the Parties.

ARTICLE 3 MISSION OF THE CENTER

1. The basic aim of the Multinational Peace Support Operation Training Center (MPSOTC), is, to improve training according to the new operations requirements of Peace Support Operations (PSO), and to provide the appropriate venue for exchanging ideas and experiences regarding PSO issues.

2. The mission of the Center is to provide high level theoretical and practical education and training, with comprehensive coverage of PSOs, to cadres (Staff Officers, Platoon Leaders, Company and Unit Commanders, Observers), as well as to multinational troops (Platoons - Companies - Units), according to current international standards (UN- OSCE - NATO- WEU ).

3. In addition, the Center has the mission to provide the appropriate mission oriented pre-deployment training, on all relevant aspects of PSOs, to staff officers, military observers and national or multinational contingents, before their deployment for a specific mission, as well as to their replacements.

ARTICLE 4

ESTABLISHMENT - ORG ANISATION - SUBORDINATION

1. The Center is an establishment staffed with personnel of all the three Branches of the Armed forces, which is subordinated to the National Defense General Staff of the Hellenic Partv.

2. Trie organizational chart of the Center is depicted in ANNEX "A", which may be modified by the Hellenic Part}' at any time in accordance with the functional requirements of the Center.

3. The Center's permanent Staff (both faculty and administrative) will consist of military ( Army, Navy, An Force) as well as civilian personnel.

4. The Hellenic Part}' will provide all necessary military and civilian personnel except of the following posts, which should be filled by international personnel, after previous agreement between the Hellenic Party- and any other mterested part}; and the signing of a relevant MOU:

a. Staff Officers.

b. Instructors

The Croatian Party may provide one (1) instructor after the conclusion and signature of a relevant MOU between the Parries.

5. The Croatian Party maintains the right to withdraw their personnel from the Center, after a timely notice to the Hellenic Party. This notice must be a formal written notification coming from the responsible authority of the Croatian Parry, provided to the Hellenic Part}' MOD one (I) month in advance.

ARTICLE 5 TRAINING

1. The Center will provide the following courses:

a. Multinational PSOs Officers (basic and advanced) Course.

(1) Duration: two (2) weeks.

(2) Number of courses per year: four (4)

(3) Ιί is designed for junior and senior officers (training of

trainers).

(4) The purpose of the course is to train and prepare officers for PSOs related duties and for tasks as militarv observers, election

supervisors, or other PSOs missions in support of relevant International Organizations (UN , NATO , OSCE and WEU).

(5) Maximum National participation per course: five (5)

trainee officers.

b. Multinational PSOs companies (basic and advanced) Course

(1) Duration: two (2) weeks. During the first week training will be conducted per platoon, while during second week per company.

(2) Number of courses per year: two (2).

(3) The purpose of the course is to train and prepare platoons and companies for participation in PSOs, either in multinational or national formations, and also to provide the necessary mission tailored pre-deployment training. Course curriculum provides for both theoretical and practical (exercises) lessons conducted "in-door" and in the field.

(4) Minimum national participation is one organic platoon.

c. Miutinational PSOs Logistics Course

(1) Duration: one (1) Week .

(2) Number of courses per year: One (I)

(3) The purpose of the course is to train and prepare officers from different countries for assignment as Logistic Staff Officers in Multinational Brigade HQs, or Multinational service support HQs and/or in National Contigents for the conduct of PSOs.

f. Military Observers Course.

(1) Duration: one week.

(2) Number of courses per year: one.

(3) The purpose of the course is to train officers from different countries for assignment as Military Observers in PSOs and to familiarize the trainees with NATO C2 structure procedures. SOPs and terminology.

(4) The course curriculum provides for both theoretical and practical (exercises) lessons conducted in-door and in the field.

(5) Maximum national participation per course: five trainee

officers.

g. Upon graduation, the trainees will receive official course certificates, prepared by the Center.

2. During May every year, the Hellenic Party shall provide the Academic Calendar for the next year to the Croatian Party and to the International Organizations.

3. The Hellenic Party retains the full right to modify- the structure and organization of the courses offered by the Center but is obliged to notify the Croatian Party at least six (6) months hi advance about any such modification.

ARTICLE 6 PROCEDURES

1. The necessary information concerning the size of the participation (number of cadres or troops) and the procedures of transportation, armament clearance during entrance and exit, as well as any other details, will be provided by the competent Directorate of the Ministry' of Defence of the Republic of Croatia to the Center MPSOTC and to the Hellenic National Defense General

Staff, so as to enable the Hellenic Part}- to plan for the reception and transportation from the entry point to the Center.

2. Trie above mentioned rnfonnarion shall be included in a "Joining Report", to be sent to the Hellenic National Defence General Staff at least one (1) month pnor to the date of arrival of the Croatian personnel.

3. The Ministry of Defence of the Pvepubhc of Croatia may dispatch to the Center for troop training fully equipped organic platoons or companies. In such a case it will consult with the Hellenic Part}' on the structure of its contingent, as well as on all details concerning its arrival, accommodation and departure.

4. Hie Center retains the right to specifically reorganize the trainees during the course, in order to form the suitable force for the conduct of the training.

5. Leaves or days-off are normally not authorized during the course. In emergency situations and after a written notification from the competent authority of the Ministry- of Defence of the Republic of Croatia, the Commandant of the Center can grant short leaves either for Greece or for the country- of origin.

6. During the courses the trainees have to wear either duty uniforms or field uniforms, as it will be indicated in the course schedule.

7. Foreign trainees (military and civilian) should conform to the security regulations of the Hellenic Party-'s Armed Forces.

ARTICLE 7 LEGAL ISSUES - CL AIMS

1. The legal status of the personnel of the Croatian Party while in Greece for the purposes of this Agreement shall be governed by the provisions of PfP SOFA (Agreement among the States Parries to the North Atlantic Treaty and the Other States Participating in the Partnership of Peace regarding the Status of

their Forces, signed in Brussels, on 19th June 1995). - The same applies to issues of claims.

2. The Commandant of the Center has the authority to issue orders regarding the imictioning of the Center, to all of his subordinates, as well as to all trainees. The Croatian personnel are to obey such orders, as long as they do not contradict their national laws and regulations.

3. Chain of Command and discipline within each national contingent are defined according to the national regulations of the country of origin.

4 The Centers official correspondence with the Republic of Croatia will be conducted through the designated Directorate of the MOD of the Republic of Croatia.

ARTICLE 8 HOST NATION SUPPORT

1. Logistic support of the Center is a Hellenic Party responsibility.

2. The Host Nation Support of the Hellenic Party to the personnel of the Croatian Party will consist of the following, free of any charge:

a. Accommodation for the entire duration of the courses.

b Meals.

c. Transportation to and from the Center.

d. Social Events.

No registration or tuition fees will be charged.

3. The Host Nation Hellenic Part}' is responsible for maintaining the Logistic and Aaministrative Support Platoon of the Center at the appropriate strength and readiness in order to provide the necessary support for the smooth function of the Center.

ARTICLE 9 SETTLEMENT OF DISPUTES

All disputes arising from the interpretation or implementation of this Agreement shall be settled by direct consultations between the Parties, without recourse to outside jurisdiction.

ARTICLE 10 AMENDMENTS

1. The Parties have the right to propose in written form amendments to any article of this Agreement, with the exception of art. 4 §2 and 5 §4.

2. If agreed upon by the Parties these amendments will come into force according to the procedure described in art. 11 and shall be an integral pari of this Agreement

3. The provisions of para. 1 & 2 of this article are without prejudice to articles 4 §2 and 5 §4, which provide for changes effected by the Hellenic Party unilaterallv.

ARTICLE 11 ENTRY INTO FORCE

The present Agreement shall enter into force on the date of the receipt of the last diplomatic note whereby the Parties notify' each other that the requirements of their internal legislation for its entry into force have been fulfilled. However, where feasible, the Parties shall act according to the provisions of this Agreement from the date of its signature

ARTICLE 12 DURATION

This Agreement shall remain in force for an mdefinite period of time

ARTICLE 13 TERMINATION

1. The present Agreement may be terminated by either Party at any

time.

2. The Party mat is interested in terminating this Agreement will send a written notification to the Ministry of Defense of the other Party.

3. Terrnination shall take effect one month after the receiot of the above mentioned written notification.

4. In case that there are financial issues or claims which remain unresolved at the time of termination, the present Agreement will remain in force until the specific issues are definitely settled.

Άρθρο δεύτερο

Η ισχύς του παρόντος νόμου αρχίζει από τη δημοσίευσή του στην Εφημερίδα της Κυβερνήσεως και της Συμφωνίας που κυρώνεται από την πλήρωση των προϋποθέσεων του άρθρου 11 αυτής.

Παραγγέλλομε τη δημοσίευση του παρόντος στην Εφημερίδα της Κυβερνήσεως και την εκτέλεσή του ως νόμου του Κράτους.
